MS is free to compell the user to do whatever is written in EULA, as long as those deeds are not illegal as such.
Courts help enforcing the EULA, they can't chalenge it's fairness nor allow users to do stuff forbidden in the user-licence agreement.
If you don't like the licence, don't use the software.
Of course some customer-rights activists may seek to enforce the change of the EULA, but I am yet to notice something like that taking place, feel free to enlighten me on the subject, though...

Microsoft is free to bundle whatever they want with any of their products, as long as the customer is informed about it. And if someone doesn't like XP they can use something else anyway, gone are the days when Microsoft was an absolute monopoly in consumer/corporate OS business.

I however disagree about NT being "unstable", at least with all the latest SPs.
I am running NT at work and the system has NEVER crashed on me, but it's a Compaq and it's M$ certified. When however you are starting to mix tons of hardware you are bound to get even the stablest of OS's to crash.
And one thing that no OS can be protected against are video-driver crashes. Since the video driver is accessing h/w directly, when it goes down it takes the entire OS with it. So the user is left at the mercy of the driver coders. I've had many lock-ups in Linux, caused by my nVidia drivers, they are stable now, but that wasnt a case even 5 months ago. Also another example: Aureal Vortex soundcards on a par with VIA chipsets are known to cause occasional lockups in Linux.
Mandrake 7.2 was buggy as hell.(imo)

CDRs cost around $1 here, in Finland, I've never seen a CD-R selling cheaper than 80 cents.
