    Not that anyone would call this posting on /. substantial evidence of the RIAA stealing music from people's drives, but it raises an interesting question.

    If, during the course of raiding this file site and downloading potential evidence of infringment, the RIAA or their assigns commits an act of downloading and storing the copyrighted material of a private individual or company, are they not committing an act of infringement ? Would they not be liable for the same penalties that a private citizen (~voter) would face for committing the same act ? Would it matter who owns the material - the user being raided or another 3rd party ? Assuming that the RIAA is held to the same or similar standards, do you as a lawyer and officer of the court have an obligation to report the incident ?

    Is there a sort of double standard applied here ?

    In order to properly present a case you need to refer to certain evidence such as, in the case of P2P piracy, computer files containing music (MP3s). This evidence, as far as I know, is still required to satisfy rules for the chain of evidence in how it was collected and handled. In several cases reported through the media, the stories have indicated that the RIAA or their agents have collected this evidence directly. Computer files can be easily reproduced or altered.

    These files can not be validated since they can be easily forged or altered in their computerized format, and the injured party is actually handling this evidence, so how could this type of evidence past muster ? File names and sizes do not necessarily indicate content, so without the critical evidence of the violation (the actual file), how is it that any of these cases can be fairly brought to trial ? How would the rules for handling this evidence impact the small copyright holders - if I find a potential violation, can I just collect evidence myself and try to admit it in court ?

    IANAL - but for anyone who is, isn't there some recourse Mr. s4m7 can take since the RIAA has STOLEN *his* copyrighted material ?

    It's actually quite simple:
    Open IE and click on View | Explorer Bar | Search. This opens a side panel for searches. If your side panel has the animated search character, select Change Preferences and then select Change Internet Search Behavior. A list of popular search engines appears, and you can select your favorite from the list.

    This new default setting applies only to searches done from the side panel. Entering keywords into the address bar will still trigger an MSN search. But if you leave the side panel open, you can search with your favorite engine without having to navigate to its site first. And you'll get search refinement suggestions in the sidebar along with your engine's results.

    If you'd rather search from the address bar, after selecting Change Internet Search Behavior select With Classic Internet Search. Then close IE and reopen it. The side panel will now contain a Customize selection on the menu bar. Click on that to open the Customize Search Settings dialog. Click on the Autosearch settings button and you'll see a second dialog that lets you change the default engine for searches from the address bar itself. Once you've chosen the engine you prefer, you can close the side panel. Searches entered in the address bar will now be sent to your preferred search engine.

    The "big three" personal IM clients (AOL, MSN, Yahoo) are great for talking to Aunt Martha, but if you need reliability, accountability, security, logging, programmability, presence, etc... use tools suitable for the work environment like IBM SameTime IBM already has like 80% of the big corporate IM market - and this is more bad news for the AOL/MSNs of the world. (SMBs and those with Jabber, etc, please don't feel slighted - those are great tools also I hear)

    This should be good news for Lotus/IBM as companies abandon the toys (AOL/MSN/Yahoo) and go for the tools.

    (Sorry, obligatory SCO/IBM suit reference not included ;)

    This is an interesting idea. I have a few contacts in the local school system and I just don't have the time to demo some of the things that I suggest they look into... a roadshow seems like a great way to put this out there !

    Hilarious. The salon article was well done. My favorite line (it actually had me laugh out loud) has to be:

    For folks keeping score, "SCO" doesn't stand for "Santa Cruz Operation" any longer, and it's to be pronounced not as three separate letters but as a word that rhymes with "fiasco."

    Ok, is it me, or while so many people are focusing on problems downloading the supposed 'crap' that the big labels are feeding you, and on the 'war' to counter their countermeasures, and getting outraged, etc... what both sides are effectively doing is destroying the viability of the P2P model for music. Isn't this _exactly_ what the RIAA wants ? The threat to the them is that artists can distribute content globally, instantly, and without any help from the big labels, not that people will continue to download the Back Street Boys (and hence buy into the big label crap machine). I'm all for flagging RIAA backed content - for the Exclude filters !

    It's an old trick from a bunch of old thinkers, and as we over 30 know, age and treachery will always overcome youth and enthusiasm.

    Keep your eye on the ball people.

    It's the lawyers... in the future, the ABILITY exists to travel back in time, but the LIABILITY isn't covered. In order for you to be contacted, or to interact with these humans from the future, you'll need to sign the release forms in the present. You will also have to hope that your disclaimer and the cost of the trip will survive until such time (in the form of a funded provision in a will perhaps, al la Ben Franklin's gift to Philadelphia?)

    Due to the total control/destruction of information in 2112 (caused in part by current RIAA policies and the DMCA) almost none of these release forms survived - hence there are no time travelers contact you or anyone you know.

    The head of the Federal Communications Commission gave his blessing on Wednesday to an emerging technology that would provide high-speed Internet service through power lines.

    FCC Chairman Michael Powell toured a house in suburban Maryland that had been set up to showcase the new service, which transmits e-mail, Web pages, telephone service and other data over the existing power grid and through standard electrical outlets.

    In the living room, Powell listened to an Internet radio broadcast and watched the movie "Ice Age" on a flat-screen 42-inch television streaming from another computer miles away.
