The streets are still clogged, still polluted as hell. Government says it improved things. I can only imagine what it would be like without this restriction, then.

If he didn't have COPD, he'd probably live another 5 or 10 years longer than whatever he's got.

I will back this argument with a family case.
My grandfather is 91. Smoked for most of his life. He now has emphysema, and we fear he will not see another year. Except for his lungs his health is perfect. He could easily live another 10 years. Not even "normal" problems like cholesterol, blood pressure or anything. Perfect health at 91. Except for having lost 80% of his lung capacity because of smoking.
Watching him is one of the main reasons I quit smoking 2 years ago. Just in time, according to my pneumologist, to avoid lung damage (my long are still considered normal, but were closing in on borderline).
And still mostly civilized countries don't consider bigotry as "free speech".
Say you go on air and accuse someone publicly of having committed a crime. Not saying he "might have", saying he actually did. You are going to get sued for it. Are you going to argue "free speech"?
"Free speech" is not a carte blanche for "irresponsible speech", "bigotry" or "verbal assault". Racist is considered a "hate crime" is most civilized countries. The fact it isn't in the US tells more about the USA than about freedom.
First Amendment is the standard go-to bullshit everyone proclaims right now. I mean, seriously? If I threaten your life, it is ok because I have a first amendment right? For me its a result of Monsanto patenting food staples and suing world + dog. I don't agree with a few multinationals owning patents of the world's food staples so I will do everything I can to avoid GMO products for this reason and this reason only. And I will continue to warn everyone I know against purchasing GMO products until they are no longer patented and the companies stop abusing the patents. THe End.

Also, it has the most successful alternative fuel program in the world (most successful by any measure you chose, be it price, adoption, w/e). Those two things alone paint a big target mark in the country's back, and make it a prime target for espionage. The USA tried to buy those technologies in the past, and was mostly refused, if I recall correctly.
Some people will say that Brazil once had a nuke program. Who cares? These fuel technologies are a bigger threat to the USA than any patched up nukes would be, by the simple fact Brazil is using them, and they are making a difference.
