first off, i love java, and its use has employed me for >5 years now. and i agree that with modern JIT compilers, the language itself is pretty damn fast. not C fast, but pretty damn close to C++ fast. that being said:
for graphics, it still sucks. Swing is slow. SWT is better, but not great. JOGL is coming along, but immature. use java for server-side programming. that's where it kicks ass.

patents last 14 years. copyright lasts beyond the life of the original creator, or a fixed length of time for corporations. civ I is nowhere near expiration under any copyright law that has existed this century (or the last).

diff only gets you what has changed, not when or why. CVS history is infinitely more valuable to a developer merging two software branches than a simple diff would be.
i'm not stating that i agree that apple should open up their repositories - in fact i think there is valid rationale not to - but to confuse the usefulness of a diff and complete repository history is a definitely a fallacy.
