What you are forgetting is that your alleged 'car theif' DID NOT TAKE ANYTHING. He used a matter-re-arranger to make a clone of his neighbors car out of dirt or air or garbage or something. That's kind of an important detail. If we were talking about shoplifting CD's, your analogy would work, kind of. But we're not.
You're right: Linux has a much smaller market share, and we can understand that less resources will be devoted to developing, maintaining, and supporting Linux drivers. We're (reluctantly) o.k. with that.
But, if they're going to bother developing linux drivers at all, I don't think it is too much to ask for the source, so we can do the maintaining and supporting ourselves.
I just have to say that the "Free Speech" arguments don't seem to hold a lot of water to me. Don't get me wrong, I hate DRM/DMCA/MPAA as much as the next guy, but free speech?
If this number should be protected by free speech, is it also free speech for me to publish your name, birthday, ssn, and credit card number?
Well, the DMCA does have a counter notifaction mechanism. It seems this is, at least in part, the means by which Viacom has detected the 50 mistakes "so far".
