    Can someone explain to me how you can win the trial, win the appeal, have the Supremes deny cert to the defendant, and then let the perps walk?

    Classic case of winning all the battles and losing the war through bad generalship.

    This is totally OT, but what the hell...

    The PPGs also use other sources, such as Monty Python. In the one where Blossom thinks she's Mojo, Mojo goes on a rant very similar to the instructions for the Holy Hand Grenade... He goes on about the number of MojoJojos shall be one and one shall be the number... you get the idea...

    PPGs is on the Cartoon Network, and though advertised for kids, I highly recommend it...

    Just watch out for CHEMICAL X!

    Wasn't 2600 a Federal case (DMCA violation)? In that case, if the [insert number here]th Circuit court of appeals rules that source isn't speech, and Judge Patel's ruling in Bernstein and the ruling in Junger stand, that would cause a conflict on a major Constitutional issue between circuits, and at that point the USSC would almost HAVE to get involved.

    But as others have pointed out, this particular case is a CA state case, and may not have any effect outside CA.

    California is part of the Ninth Circuit, so I wonder why the judge in this case didn't cite Bernstein v. Reno, wherein the Ninth Circuit explicitly held up source code as speech?

    Yes, I know that's federal and not state.

    Close. The Ninth Circuit handled the Napster case. The 2600 case was in New York, and I'm not sure which circuit that is.

    Interestingly, the Ninth also handled the Bernstein crypto case, and ruled that source code is speech. Did the judge cite that ruling -- don't recall from the link.

    Further interesting fact: the judge who ruled in the Bernstein case the code was speech is the same judge who nailed Napster to the wall (Marilyn C. Patel).

    you'll see that the judges are not establishing that the First Amendment always or typically trumps Copyright,

    Agreed. They explicitly state that there are Constitutional issues with Copyright. However, this is a "Trade Secret" suit, brought under UTSA, and the court held that the First Amendment trumps trade secrets, since there is no constitutional basis for trade secrets (unlike Copyright).

    Actually, it wasn't the comet with that consistency, the Caltech scientist in the novel came up with that as an explanation of the energies/masses involved.

    You think so? I find it much easier to use a gui than a command line when moving/copying/deleting files.

    Really? How do you delete all files with an A in the second position and a .BAK extension?

    Unix: rm ?A*.BAK
    DOS CLI: DEL ?A*.BAK
    GUI: ?????

    Plus, you need to build your own compiler, starting with hand-built machine code and bootstrapping your way up (see the classic C Compiler hack).

    Of course, you then need to build your own processor to ensure there are no hacks in the processor too...

    EVERY SINGLE BUILD of an ATL project re-registers the component.

    Ideally, in this environment, you'd want *TWO* machines. One with the "official" locked-down office automation environment, and one with your compilers and stuff.

    That's what we were going to do when my company was considering this ill-advised policy. Luckily, they rethought it.
