    I'm pretty sure they aren't copyrighted, since US government info can't be by law; (ianal, of course). Thus, you should probably be able to mirror the images legally.

    It is probably a good idea to keep the attribution to Nasa/JPL there one way or the other, since you wouldn't want people to think that was just a picture of your barren backyard.

    This ain't too profound either, but of course, we have been there before: with Viking (x2), Mars Pathfinder, and of course Spirit.

    I agree with the OP and the Nasa hype that Meridiani is damn cool and imho way more interesting than Gusev in terms of what the rover can accomplish (yay, Hematite!). I'm so psyched it got there unharmed...

    Yeah, I saw the "magmatism is the main process by which water moves from the core of planets to their surface" thing and coughed quietly to myself *cough* *cough*.

    Core differentiation generally happens REALLY early in planet's history, and it seems to me that it isn't precisely correct to say magmatism in this context, (which implies "volcanism" at least to me). Bouyancy and heat are what really moves water to the surface, since it is a) much less dense than rock (think about it) and b) not real stable at real high T.

    In other words -- what moves water around is a whole mess of ugly chemistry and thermodynamics that I'll leave to my petrologist buddies to explain to me (dah? dah!) with odd pentagonal diagrams.

    IANAL, of course, but I'm not sure this is right. As far as I know, under common law principles, ISPs cannot be presumamptively liable for the actions of their users...and I doubt the DMCA changes things in this regard.

    Is there someone who actually knows with certainty the answer to this point? It is important for how this whole story will play out, methinks.

    I would argue that slashdot has just bought into hype surrounding one scientific paper. Seismic tomography work has been incrementally improving for many years.

    Moreover, I suspect this paper will be very controversial -- the inversion of tomographic data is necessarily model-dependent, and many scientists are going to be skeptical of the claim that the have settled the source claim of plumes once and for all. [It's much easier to understand why plumes would originate at the thermal boundary at the core; what causes a plume to begin if it starts somewhere in the middle of the mantle?]

    Enjoyable interview...I think his funniest comment was how the developers used real physics for the flight model. What are other people using, fake physics?

    Too bad the game won't come out until Q4 of 2004 -- I fear it might be obsolete by then.

    Criminal != civil. Since SCO isn't the government [thank god], they can't put you on trial for a "criminal act"...instead, they sue you for damages for violating their IP. (hah!)

    Anyway, I think they're bluffing...most end users won't have to worry about it even if they aren't (see how many people the RIAA have owned, and they have settled caselaw on their side).

    There are several measurements that are essentially impossible from orbiters that ARES would have attempted to make, I think, including: (1) atmospheric measurements (2) high-resolution measurements of the magnetic anomalies seen in the Martian highlands, and (3) regional-scale imaging. From my perspective, the most interesting of these would be #2, especially since its hard to conceive of another way to get such a measurement. (I'll admit right off the bat that I find atm. measurements pretty dull).

    In terms of remote control, I'm pretty certain that the plane's path would be established before the mission, for better or worse.

    I'm not trying to suggest that Phoenix is worthless, I'm just bummed that ARES didn't win, since I'm more interested in regional geology/geophysics than the interesting H2O chemistry on Mars...

    Personally, I think there are a couple of things worth noting regarding this decision. 1st -- although $325 million is a bit "staggering", it's interesting to note that this is the first mission competition that really was a winner take all competition. 30 proposals were submitted, 4 made the finals, and then one winner was picked. I have to think NASA will be doing a lot more of this, since it's got to be more economical in the long-run.

    2nd, one of the losers was the extremely cool ARES Martian Airplane proposal. I'm biased because some of the people in my lab were on the science team for that proposal, but I think it would have pushed both the scientific and engineering envelope more than Phoenix will. Was NASA being too conservative (like I think), or simply prudent? I think it's probably hard to tell right now. I sure hope ARES has a shot in 2011 if they run another Scout competition, since I think it'll remain a cool idea even then...

    ..that a free service along this lines doesn't exist [at least not in a legal way]. I've looked into trying to setup a way of getting real-time baseball statistics for free but have been largely stymied. I know from the research that I did last spring on this topic that ESPN runs a realtime stats server that is widely used -- whose name I'm forgetting. (Competing with Stats, Inc.) Help, anyone?

    I'm pretty sure it's fairly expensive, though. Are you sure you need realtime statistics????

    I wonder what the bands or artists in question would think about this practice -- I would bet the concert promoters get virtually the entire profit.

    Also, does this mean the band doesn't give that third encore, if it will put them over the CD's time limit? That would suck.

    Although I'm just learning how to utilize XML, I think it has value. Comparing XML and HTML utilization on the web is apples and oranges, only moreso, since they are markup languages for completely different purposes.

    For data exchange between disparate applications, XML is useful. For displaying text in bold, HTML works. For coding, one can rely on whatever programming language one wants; 'course XML _isn't_ a programming language, so it won't work for that.

    I gotta say, this series of equalities makes no sense to me...non-profit status is mostly just a tax thang. The government exerts no control over the groups that claim to be non profits.

    And to some extent, the copyright holders and government combined are bound to have jurisdiction to license (in some sense) internet radio, at least as long as copyright law remains in effect. Of course, the degree of piracy that happens nowadays makes a bit of a mockery of copyright law, but that's another story entirely.

    Seriously, though, I don't think that's really true. Xerox similar brand name power. I think the important thing is that brand name!=profit. Xerox has struggled mightily, and Tivo might very well do the same (if we are to believe that one-sided article).

    I apologize if you thought my response arrogant...it's just that charge of judicial legislation ALWAYS gets me riled up...it seemed to me you made the charge without any evidence, which is too easy to do. So...if you present evidence...I'll dam up my river of arrogance.

    As for his finding of fact, I don't think that's appealable (IANAL!!!), or they probably would have. In fact, I vaguely recall Jackson structuring his decision in this way to prevent the entire decision from being overruled.

    The standard for overruling a trial court's finding of fact is usually if the judge was "arbitrary and capricious" in making a factual determination. Although this is a high standard, it is appealable, and in a factually complex case like this one it wouldn't have been outrageous for them to reverse his fact findings.

    IMO (humble or not :), I think the Appeals Court was well within their discretion to reverse Penfield Jackson's remedy in light of his actions...to have a Judge talking to the media about the case before deciding it was a gross breech of judicial impartiality by any standard...

    Uh, no. You can believe this, but in fact it was perfectly reasonable to consider Jackson's judicial ethics when evaluating the case on appeal. And, communication about a decision that is PENDING before you has been considered as bad behavior in the past...(whether you agree with this or not.) If you truly believe the Court of Appreals "judicially legislated", don't you think they would have overturned his "findings of fact"? Furthermore, it wasn't a SINGLE judge -- it was a three judge panel... ...sorry, sometimes it seems like every single word in a /. commentary makes me sputter with disbelief.
