*Many* call centers have valid reasons to call consumers, usuallt that the consumer is their customer, or that the consumer gave them explicit permission to call them.

Also, how can you fine them for not making it through? This would effectively stop the calls, but the penalties would not be enforceable.

At our company we use a service provider called Gryphon Networks (http://www.gryphonnetworks.com/). You dial into their 800 number and do prospecting from there. If the number is on any state DNC list (and now federal) it will not allow the call to go through.

  8. Previous Rant on Recording Industry Extinction Predicted RSN · · Score: 1
This is a rant I posted on a previous message board, when it was announced that my favorite artist's Ben Folds' new CD would be coming with a DVD full of live videos:

the record companies seem like they are getting just a bit smarter. Remember, I said just a bit.

Why, you ask? Because they are starting to give use more content (more INCENTIVE) to purchase a CD. The record comapnies are feeling a lot of pressure from online file sharing, and instead of spending million on new copy protections that don't work, and millions more on lawsuits (mind you, they're doing both anyway -- that's why they're only a bit smarter) they are spending a few bucks (less than 50 cents a copy with production costs, I'm sure) on throwing in the DVD -- A medium not too easily shared through Kazaa or the like.

So if any of you out there are members of the board of directors of the RIAA, I have 2 things to say to you:

Fuck off and go to hell, and

Get Smart. YOU WILL NEVER PREVENT SOUND FROM BEING COPIED. NEVER. What you can do is come up with innovative solutions that make me WANT to go to the CD store and buy the CD. Give me more. I am glad you are seeing the light. Just think of this: Every CD you release has a couple of videos made for it. The production costs are already spent. Throw them on a DVD and add it to the CD. Throw in an interview with the artist. Put in some behind the scenes footage of the studio sessions. There is tons of shit to do. This makes people want to buy your (now less) overpriced crap.

  15. Let's get the terms correct on Microsoft: You Need Permission to Sell Our Software · · Score: 0
When large companies want to license Microsoft software, they usually opt for what is called an "Enterprise Agreement". This means that they pay Microsoft $x for every desktop computer they have. For the $x, Microsoft allows the company to put on each desktop:
    • the most current os
    • the most current office version
    • sql server CALs
    • Win2k CALs
    • etc.
In order to do this, the company signs a legal contract with Microsoft, and pays either a lower rate per desktop, or a yearly fee.

So in this case, being that K-Mart used it's large size to get better deals for their software, they simply can't resell those (especially if they are on a subscription) at the price they get for their huge quantity discount.

If they could, that would open a whole new market for a large company: but tons of extra licenses at your super-cheap price and resell them at retail. If you owned the software company, would you let that happen?

OK, maybe I'm a little biased. I was a happy TiVo owner for almost a year -- until the modem broked. TiVo only offered a 60 or 90 day warranty, so I would have had to send them the box, wait a few weeks, and pay them at least $99 to repair it.

So I bought an Ultimate TV. Since MSFT was shutting down the division, you could get them for $99 including the dish and installation.

Plus, with the UltimateTV, I can record 2 shows at once, in original quality(including Dolby Digital).

The reason I say it should die is their service policy. The failing modem is an extremely common problem with the units (just read any TiVo board), and they fail to recognize it.

TiVo has a far superior and faster interface. Their service releases give great new and timesaving features, and they listen to user feedback and do usability. If it weren't for their lousy service, I would be their biggest advocate.
