Sad indeed, so it looks by all accounts its using something from windows media player. and what looks like some thinly veiled OEM mp3 players. There seems to be a total lack of technical info on their 'music store', I suppose its now the current fad to throw up a web music store and sell some players and thru a brand name you bought at bankruptcy auction in order to generate some capital.
Am I the only one that sees this as cynically as the rebirth of Atari?
I think the most ironic part is that you need WMP (with optional Commodore skin) to play your purchase from the Commodore music store. I wonder if they have the Amiga version ready yet?
I have to agree, but on more general grounds, I am still somewhat bewildered why nearly all internet traffic isn't encrypted by default in 2004? I mean only 'relatively' recently, has telnet been given the boot as default text connections to ssh. Its a mind shift that took a while to tip the balance. Why is everything else taking so long?
Of course even in my earliest days on the internet i has always assumed that it was a given that the administrator can read any file on the system.
Ok let us dig deeper here. The records that have been printed out are over 12 months old (from article), thus implying at some point the whole thing has been printed, from the existing system.
From this we can also conclude that they have been putting new data over the past year. The request was made in january. It is unclear how long it took to go thru red tape and on what date the request was denied.
The article also says that the new system will be up in December.
These facts and reasonable conclusions lead to some interesting questions. Is data still being put into the old system despite the fact that a large transaction will cause it to crash? If so how long has this 'problem' been known out, and is it not unwise to keep adding data to a possibly unstable system?
Is it now the end of June, 6 months from the time of request, 6 months until the new system is up and running, since we 'know' that a large transaction will crash the old system, it stand to reason that some data is already on the new system and data is currently being moved to it. That being the case, why not provide the data on the new system, and then provide the copies of the data as its being transferred to the new system? This is reasonable course of action assuming all statements are true. If all statements are true then why was the request denied, as there is a reasonable process to allow access.
Id really like to know 1) How much data we are talking about adn 2) what is it on. 10 years ago I was dumping mailing lists from a McDonnell/Douglas Microdata minicomputer which at that time i believe was over 10 years old, that same unit is still in service today and is being phased out. But i'll tell you this, if the IRS came and demanded a copy of the records saying it might crash certainly wouldn't mean you escape from complying.
Oh and BTW, just because you dont like conspiracies, it doesnt mean they dont exist.
Wow, i think I broke something whilst picking my jaw up off the floor.
If the computer will crash by accessing these records, then this implies the records are inaccessible. Not to mention that if the records magically 'disappear' all they have to say it "look we told you so"
I dont think anyone is gonna believe this for a second. More like a lot of people want this information permanently buried as to avoid letting the public know whats going on.
I find this a bit amusing, mainly because many games made in japan never make it to the us (as they would never sell), or the content is changes to suit the american palette (usually toned down).
So, this make me wonder, are the games that get sold in japan going to be toned down american games, or perhaps the opposite,, they will be toned up with a lot more sex and violence. Dont forget the tentacles!:)
It looks like you have chosen the degenerate case here, and one in which really wasn't part of the article, and isn't part of the court decision here.
From the article: The Supreme Court ruled Tuesday that a law meant to punish pornographers who peddle dirty pictures to Web-surfing kids is probably an unconstitutional muzzle on free speech.
This law and article is not about rape. Is not about kiddie porn. Is not about child rape. Is not about making kiddie porn of child rape.
That much being said, your comparison of immorality is flawed. because what you brought up isnt being discussed here. as for being kosher yes it is one of those social mores, however it is a religious law of orthodox jews. And like I said the government has no place implementing religious laws or beliefs. Im afraid you deserve as slashdot RTFA citation.
A friend passed along a url to me the other day about the ACLU. I strongly suggest people read it, not only to perhaps dispel a few preconceived notions, but to read the replies the author got and reflect.
There seems to be a portion of the citizenry that cannot seem to abstract their own beliefs (and belief systems) from reality. There also appears to be a distinct willful decision not comprehend separation of church and state. Individuals have the choice to restrict (or not) themselves, government does not have the choice to restrict or advocate. Why do I bring this point up? many of the "please think of the children" are running on their own religious views about sex, and sexual content, and are pushing their agenda unto to the government, pushing the govt into a role is it not only ill suited for, but has no place in. Let us examine a hypothetical, if used in a similar manner, laws could be passed to shut down any non-kosher restaurants and stores. Clearly no one pushes this because the govt has no role enforcing a set of religious beliefs or edicts, regardless the rhetoric they are couched in.
This of course puts the onus on the parents to handle the situation, and that is where the responsibility lies.
4. Because the IP space is still assigned to the carrier, the carrier would potentially be responsible to continue to respond to all SPAM and hacking complaints, DMCA violations, and all other forms of abuse.
While its 'potential' I just don't buy this. If it does turn out that a netblock does get ripped out of the hands of an ISP and grafted on elsewhere and traffic no longer goes thru the ISP, although the netblock ay be listed under the original ISP, there is nothing they can do as its not part of their network anymore. For instance if there was a DMCA complaint all they'd have to really do is hold up this decision and the fact atht the block took a walk and say "this effectively isnt ours anymore, we legally dont control it anymore, we cannot be held responsible."
If your say ex-wife gets your cell phone in a divorce and then makes a bomb threat, but your name is still on the contract at the end of the day you arent responsible for it as you legally have no control over it.
Of course the downside to this is repeatedly having to tell people this over and over may cost big bucks in legal fcosts, and could be justifiably be an undue burden.
Actually I didn't get that our of your post at all. It sounded very much you were talking a lot about your opinion on how sex is viewed by christians. Or more correctly how you believe sex is or should be viewed by christians. As you have stated that sex should be kept secret, we can reasonably conclude that 'flooded' means any.
I fear you have been lead down a primrose path of disinformation by someone about what is in games, and who they are targeted for.
There is also this interesting 'atheist/pagan' comment, it gives the implication that as Digital Paradise is pandering to some portion of the christian spectrum, other companies have a policy of making games to a 'non-christian' market. I put hat in quotes as it is presumptuous of me to claim to know if they are, or are not marketing to a particular philosophy. Also you gave *YOUR* viewpoint. It is presumptuous of you to assume that you are either qualified, or permitted to give a generalize christian view point.
actually this poses a question, what kind of games are they going to make?
Racing games? Well if someone crashes the car that's implied violence. And you cant hit another car as that is violent. If you race by yourself you might hit a wall and that again implies a car crash.. ok thats out.
ok well i suppose you can do puzzle games.. *shrug* ok. However i cant think of any successful pure puzzle games other than tetris. Even the venerable Myst series had a rather complex plot that with element that some may consider 'impure'. For instance if you look at that always amusing to read standby capalert.com anymore involving drama at all that isnt pushing christian dogma in it is reviewed badly.
So what would fall under these restrictions? A grocery shopping Sim? The dog walking challenge? or perhaps (waiting to be modded troll) a game where you can pray sim prayers and wait for your non-answer:)
Wow, nice piece of dogma there, even with a link to some christian bible stuff.
The only sexual behavior that is not bad behavior is that which occurs privately within the exclusive bounds of a faithful, marital relationship between one man and one woman.
This is your belief, you should state as such. As it is you are attempting to make a claim as being true just because you believe it to be.
In fact i really dont have to quote anymore then to say this is an opinion piece touted as fact or 'rules' or whatever. In the future you would do well to learn the difference between opinion and fact. Otherwise you are just FUDding yourself.
Unless of course your whole post is meant to be well crafted subtle sarcasm, In that case you've done a stellar job.
In some sense you are comparing apples and oranges.
Not only is Longhorn being bushed back in schedule (as its seems to be having a crap load of dubious features added) As I recall some have been dropped from the project.
And with a bit deeper analysis, this is logical, The Xbox2 maybe pushed out the door before the market is ready to buy it, the games are ready for the customers to buy it. and before it can advance far enough to be worth paying for.
Longhorn however being delayed because it may be too late to hit the market that wants it, and be chock full of features that may not be needed.
The while point is to hit the right balance, too soon isnt good and too late isnt good.
Not to mention that they are likely to not necessarily related groups working on each?
I have been saying the same thing for years, and it still seems not to get thru. It constantly amazes me that these spam guys try to sue claiming freedom of speech, and yet seem to forget they have no right to 'speak' over someone else's network if that network doesn't want them.
its akin to 'well if the door is unlocked im gonna walk in and vandalize the place. oh you locked your door? well its my right to come in and vandalize the place.
And before anyone says this analogy is invalid, i suggest you read some spam before you do see see how they have vandalized the english language.
Sole discretion? I dont think thats gonan cut it. As this AUP is in fact a contract, you cannot be expected to uphold clauses that dont exist except in the mind of the other party.
I have to agree, there are thing even in the default windows install that are totally undocumented in any reasonable manner. For instance in one version of windows (w2k) i think there is a setting called "dollyfied' (or something). What on earth does this mean? I was unable to find any reference to it. Its only slightle less annoying than all the hex code registry entries. How is anyone supposed to know what links to what in there.
The registry instead of being a simple repository for system information has ballooned into a monster to store all the settings for every application. Whats worse is most of the time the applications dont clean up after they uninstall. On more than one occasion i've had to manually remove registry entries in order to re-install an app that failed the first time. Throwing away the files is no longer enough.
If you try and clean up after them manually you may hose the system even if only touch the seemingly application related things.
How this method of managing *everything* became a good idea i'll never know.
But Schwarzenegger believes these new regulations will harm California's already tenuous relationship with high tech industries, giving them yet another reason to take their business elsewhere.
anyone want to put money down that the number of cellphone companies that are going to pack up and leave CA at any number greater than 0? Its not a bet i woudl take.
I agree with this sentiment. However i'd like to add a caveat. We are all aware of how history is re-written and adjusted by the powers in charge, and this may well be more of that. However, on the flip side it is not in the public's best interest to have fact distorted via a public medium. (which i have no idea of what is historical fact in this dispute).
For instance, there continue to be groups who claim the holocaust never happened. This opinion may be censored by a government, and the mere cat it is censored does not make it true.
I suppose the moral here is caveat emptor, watch out who you are buying your truth from.
Sad indeed, so it looks by all accounts its using something from windows media player. and what looks like some thinly veiled OEM mp3 players. IIRC HP has had rendezvous support in their printers for a while now.
tyler, you have a good point and a well reasoned post. I touched on some of your points elsewhere in the thread. Please take a look.

Alas they are, and they can be, but they shouldn't be, and in this and numerous categories prohibited by laws that supersede them.
Unfortunately, somehow, many lawmakers seem to decide to make law now, and let the court work it out later. A little proactive action may be in order.
It looks like you have chosen the degenerate case here, and one in which really wasn't part of the article, and isn't part of the court decision here.

why exactly should you have to call. sending an abuse letter without telling you the terms up front sounds vaguely fraudulent.
i wonder if any of this will be useful in finding prior art to all the stupid recently issued patents:)
Perhaps the worst part is that the organizations (and individuals) are getting others to put them above the law and into unaccountable positions.
The hi-tech dark age is marching toward us, and we dont have enough money to fight back.
