Even if it were dual licensed, the fact is that the legitimate copyright owner (only) can control the terms of redistribution. Although IANAL, I would hesitate to remove a license notice by any copyright holder, regardless of the plurality of licenses.
Thanks for a nice post, showing respect and caution. This whole matter has become increasingly cloudy, not to mention no one wants to talk about this in a reasonable fashion - free of bias.
You bring up a valid point, but what seems to be the main problem is that the Linux 'fork' of the code has completely removed the original copyright. This is absolutly not acceptable until 'enough' of the code has changed to warrant a new copyright owner. The files themselves were dual licensed so it 'should likely' be ok to just use one of the two licenses - but as you say it isn't necessary and should be handled with caution.
In conclusion: the primary matter is copyright not licensing. Theo has made this cloudy since he is such a BSD license supporter, and Moglen is a GPL guy so their flame-worthiness has me in awe. It is easier for the geek media to stir up stories and discussion around the licenses though - where as the copyright issue would likely have to be determined in a German/EU court as the original write up by Theo on undeadly talked about:
Those files are still invalidly being distributed -- Nick and Jiri did
not proveably do enough original work to earn copyright on a
derivative work, since their work is just an adaptation.
I'm looking at this from an outsiders perspective, but it seems to me that in both countries (United States and Iran), there are a reasonable, sane majority of people just trying to get on with their lives, who are being pushed into war by a vocal, fundamentalist minority.
This is always the way it is; it is the douche bags in power that want a bigger piece of the pie.
Some Linux user either flamed through moderation or merely read him wrong.
They don't slap together bits and pieces from all over the place like Linux. That gives them a much more consistent feel.
He shouldn't have been moderated troll, but yet I personally feel what he said is wrong. Not completely, just a mis-representation. Sure, the BSD folks maybe be under the same banner and all have email accounts on the same server; but the Linux people are united in their goals and work together even if not with such a united appearance. The Linux "community" is amazingly healthy and there is little chaos even with so many working for different employers (whether IBM, Redhat, Novell or otherwise, or even flying solo.)
So there you have it, a mouthful of personal opinions. I bet you wanted to spend your time doing something else, like making out with your girlfriend (haha, just kidding, if you actually reading my opinion on OOXML you have no girlfriend to make out with).
So in effect I just made out with your "mouthful of personal opinions" instead of my non-existent girlfriend? WHY ME?!?
I'm not from the south, but from the looks of this picture, you can beat the shit out of someone for me. Thankfully South Dakota is basically outside of the environmental range for this stuff to grow properly.
***How the hell is an END USER supposed to jump to the conclusion that OFF doesn't mean OFF.*** You, sir, have permission to design consumer devices. A lot of other people posting to this thread seem to have flunked this snap quiz in User Interface Desgin 1A.
Yea, but they're all mac users so they will never admit to it.
There is no magical credibility because something is developed by professionals, that line is becoming blurred continually. Though 'fast' is just one metric of software and hardly the only one worth noticing.
I never thought of just stopping it at that, good point. You know, we could almost drop the "co" as well:...it appears mankind cannot peacefully exist. We don't want to leave other animals out of the discussion do we?
the IJ which works against government in ever lawsuit it files or every defendant it defends. Because the government is always wrong??
Yes. Because the government is always wrong. Government is created out of the simple necessity of a society to have some rules and protection but through out history governments have taken their simple power and blown it continually out of scope. If people/society/the rich/the poor were not so fucking evil then we wouldn't need government - however it appears mankind cannot peacefully coexist in some magical commune.
The employees are just doing their job, and it in no way makes the world a better place to harasses people.
In no way does doing their job include breaking the law and harassing a customer. Since when is it even good to harass a customer? The property rights that are paramount here, are the rights of the consumer who has exchanged legal tender for a product but then is being called into question - he has the right to refuse them permission to examine his goods.
Who knows, perhaps store security honestly thought that something had been stolen. Sure, the store can just let the stolen merchandise go away, but why. Again, no one forces anyone to shop at best buy, and the rules are well known, so in this case, I think the level of aggression displayed by the customers might have been an indication that something was up.
Obviously they thought he stole something but why would you say 'Oh, follow the rules or don't shop there' you fucking AC troll. The only people that showed aggression were the attendant who blocked their vehicle from leaving, and the manager who placed himself between the car's door and the person and kept repeating his intent to inspect the customers goods. Read this in case you missed the link earlier.
I for one welcome our new Anonymous Coward critiquing overlords. With your utmost esteem in the community may you continue to set the example we all may follow. I think there should be a new rule on slashdot where we all post as AC so that we may emulate your awesomeness.
I think this is a simple matter of people wanting to run Solaris on whatever hardware they want. IBM is probably more than happy to offer the option of Solaris on IBM hardware. With all the recent advances that came with Solaris 10 this is great for everyone. Having things like DTrace is awesome, and they open sourced it too so soon the Apple geeks can have at it.
And Guitar Hero 1 & 2 is basically an advertisement for Gibson.
This isn't exactly fair. If you make a game called Guitar Hero can you have a guy looking like Jeff Beck or Eric Johnson playing on a Fender Strat? It would be all wrong. So you are left with only Gibson as a good example: with the SG as the first design and now the Explorer, and the Les Paul as a prominent image in the game. There are other options but they may not have the cash to back the image. Dean, Ibanez, ESP, Jackson and others will hopefully be given an opportunity at having their "shapes" represented but it is a fairly minor issue.
By "be eternally vigilant" do you mean undercutting and hamstringing and tying the hands of government agencies so that they cannot take any steps to protect the country from the external forces who would do it harm because to do so might "harm your civil liberties" ?
It is fair to say that our government is to blame for current behavior by "external forces." If we the people were more vigilant about our government we would keep them from pissing off the rest of the world. The CIA in particular meddles too much with other peoples and their governments, but the CIA is a group for which our Constitution was not designed.
And do you further mean blaming the government for not taking steps to protect you from catastrophic events that occur due to the undercutting and hamstringing and tying of hands you previously insisted upon to "protect your civil liberties" ?
This is sickening, we the people at a local level need to be more responsible for ourselves. In particular state governments need more power and less taxes being relocated to the federal level (and then re-appropriated by their wishes.) I am guessing you are referring to something like Katrina; but why should the rest of the nation be responsible when idiots build below sea level? The current imbalance that favors the federal government doesn't work but because of people like you we will fail to cry foul!

here's the article on undeadly and and here's a synopsis from a misc post An excellent (and apparently sarcastic) quote:
Reyk can take them to court over this, but he must do it before the year 2047.Some Linux user either flamed through moderation or merely read him wrong.

As per your "sig": My Sig spits 40 cal lead... You carry a .40 in Shanghai?
So in effect I just made out with your "mouthful of personal opinions" instead of my non-existent girlfriend? WHY ME?!?
...and the government is wasting your tax money. Now do something about it, and stop voting for those Drug War assholes.I agree, regrettably the libertarian party hasn't taken off yet in America.

Yea, if you count not having plugins an advantage.
Disclaimer, I don't work for IBM ;-)

Whoever moderated this overrated is a pathetic tool, this is definitely funny even if you might feel slightly offended.
Then get of my damn lawn!

Holy bat shit how I did not want to reply... I have always combined the two into "grammar natzee", so go fuck yourself.
Actually it's not. Get an account you AC dolt.
oh lets bring up Godwin's law just because someone made a good, relevant comparison. look at me, i'm a tool. [/sarcasm]
