Obviously you missed the comedy that was the "Introducing the X-Box live" session. Which was basicaly a session telling developers that you could trust MS' pre-built libraries for all your X-Box online security needs.
One valuable tid bid I did get from it though, was that modded X-Boxes won't get blacklisted if they try connecting, just denied until the chip is removed/deactivated. I guess that shoots down that MS conspiricy theory over at The Register.

The diffrence is that if I Ransom a peice of software I produce, other people can produce identical pieces of software, just not with my code. In patients, if I even remotly do something that can be read as infringing a softwares 'style', I can be smacked round to the full extent of the law.
Also the ethos is a bit diffrent, Ransom is more aiming at a fair reward for work well done. Patents as they are now, are more about monoplising an idea for commercialising. If I Ransom something, you can still use the program to it's full extent, you just have to give me a little something if you want to screw around with it's code.

Vapourware isn't a problem. A Ransom licence (as proposed by the site in the article) only comes into effect when you actually have a set of binaries to go with the source.
The binaries are still released as a free download, but then you pay to actually get at the source. So for example, you wanted to re-compile the new Apache with your own personal code, and it was under the Ransom Licence, then you'd have to cough up the cash to get at the source (or wait for the time limit to expire).
So basically, you can't Random License vapourware, as you don't have any binaries to distribute.
but I think this is the fairest system yet. If you read the Theoretic site, it's the CODE that is held to ransom, not the binaries. You can still use the UltimateApp Ver 1.5 for nix, but if you want to hack it, cough up some cash to get at the source.
If you think about it, it's almost the system iD has been using with the older Quake games (in releasing Q1 and Q2 source). After they got thier money back from people enjoying thier binaries, they release the source code for people to tinker with after a period of time.
But back to the point, think about the effect this could have on the abandonware if this was applied to commercial license. You could finally fix that one bug that annoyed you in your fav program, or if you were really up for a challange, you could fix the bugs in Windows 95;)

In hong kong I believe they don't even acknoledge copyright law, and in the US it will probably get DCMAed (and I imagine they would try that even for the de-regioning chips). I would argue that this actually makes it easier to intercept messages. If this is gonna be ad hoc networking with full freedom, then what is to stop someone hopping into the loop and having a listen. On the other hand, assuming there is at least a little bit of centralisation to help with security, it is not safe to assume that just because someone can set up a hub they can admin it properly. At least with ISP's they have to keep records and follow laws to a large extent. The same with the CIA/FBI/KGB etc. They have rules set too. If someone breaks them, then usually the checks and balances will bring them to the attention of the general public (or slashdot).
Now imagine a place with no set rules, no standard recording techniques and nothing that binds them to any real legal resposibility (Note:IANAL). Remember an anonymous free system is a two edged sword, if people can do anything without beiung identified, there is a good chance they will.
That might be the case in your neck of the woods, but I know my TOS has the whole conditions apply bit, and in the fine print spells out all the caps and stuff. I know it's shady, but it's still there and legally binding, and I think any company with enough money for a laywer would have the same. You did read the fine print, right?
