    in the context of having a capitalised firstletter, encroaches on my clients Trade Mark, the title Nevermind and the Intellectual Property represented by this trademark, the musical album 'Nevermind'.
    The context in which you use the Trademark, whilst non-commercial links the Trademark to sensitive issues which could damage the Trademark resulting in potential financial loss and mental cruelty to the members of the band Nirvana. It was Kurt Cobain's wish, as sent in a typed, unsigned letter to us 7 months after his death, that we protect the use of the Trademark from unauthorised usage.
    We therefore demand you produce a hasty apology and disclaimer and destroy any and all .mp3 tracks containing Nirvana IP that you have as well as providing an undertaking never to abuse our client's IP or Trademark again, except in an authorised fashion. ie. Listening to and buying Nirvana records.

    Sorry to disagree but this is not capitalism, this is Corporate Mercantilism.
    Capitalism is free trade, in every way no barriers no 'protected' marketplaces, what we see today is the rhetoric of the free market combined with protectionist legislation.
    These government built barriers such as Patents and Copyrights are a hang over from the days of Mercantilism and have been enhanced and extended at the request of the corporations until we have what have here today, a system of byzantine complexity which encourages and rewards those who obscure and lie and more importantly already have lots of money to buy the next set of laws.
    By the way in most countries Corporations do charge you for having cancer, they are the ones providing your care and drugs, even in the UK under the National Health service, the 'Back' office is increasingly run by private corporations.

    Maybe so, but where are the clear and distinguisable images captured by aircraft passengers?

    Why has not one single newscrew ever captured a picture of a Alien spacecraft in its full glory?

    Every picture thus far presented has after analysis been able to identified as some form of natural phenomena or simple misidentification of man made objects.

    I agree that this does not mean that they do not warrant investigation, but when morons like the recent group produce photoshop 'enhanced' images as evidence and widely publicise these easily debunked images, there can be no other result than to make UFO images and their proponents a laughing stock.

    State aid refers to the government passing laws or tarriffs that favour the companies involved.
    Like the extra you have to pay to buy audio cd-rs, and the levy they would like placed on ISPs just in case their customers download some music.

    ...nor do they need it.
    They do seem to be claiming they need it, so we need to help politicians see why they don't and these claims are based on laziness and greed.

    It's an interesting point you make, they are effectively a cartel and action should be taken to prevent them abusing their cartel powers to stifle competition.
    Some readers will no doubt take the existence of small independant record labels as evidence that the market is working and everthing is ok, but the samll indies know that if they step out of line the big boys will crush them or buy them out, they exist only on the suffrance of the powerful.
    Napster and Kazaa present their biggest problem because it has shown people that they don't have to go to a shop and buy a cd filled with trash in order to get the three songs they like.

    We shall no doubt see what the result of this is in time but it is well worth writing to MPs, senators etc to voice your opinion that 'state aid' should not be given to these companies, quite simply they don't deserve it.

    Yeah, they are greedy bastards, what they want is total control and for all the doomsaying it still is in the balance, they are making as big an effort as possible to persuade congress and other national governments to keep their market closed as they can.

    Kinda reminds me of this statement:

    I suspect that if Kazaa charged $5 per month per user, with unlimited downloads and people knew they couldn't be prosecuted for downloading and burning .mp3s then people would stay in droves.

    The recordcos could even sell higher quality versions of the files for the true audiophiles out there.

    Thats right, but, unless I miss my mark the derivative works created under this license will not belong to Bitstream. I can't imagine the Gnome people agreeing to a clause like that, nor could I see anybody in their right minds developing fonts with such a caveat

    In the mean time donate every copyright you own to the public domain

    I agree they can track to a large but limited extent what I do now, however in 5 years when this tech has matured they will be able to track everybody in a ruthlessly efficient manner and easily share this data with anybody willing to pay for it.
    That will quite simply lead to abuses, and yes you can probably learn a lot of what you want from these data cds
    But an active RF technology would mean a bug in every car.
    Maybe the idea of an adboard on a freeway is insane ;) but what about an adboard at the end of your road, waiting for you to go to work that morning, it might be far fetched but not too far fetched, and maybe the cable company you pay will create an ad schedule just for you.
    What we need to do it think about how this technology will affect us in the future, especialy given the current corporate big idea of synergising databases, and decide how we are going to deal with it.
    These data lists on CDs might tell you that I subscribe to Private Eye magazine and you could imagine that I might like to buy your satirical magazine also and ring me to tell me so, but they dont tell you that I spent 30 minutes last week reading lastminute.com looking for a flight to new york or that I browsed bushmaster arms website and two months ago downloaded a copy of the anarchists cookbook. Taken altogether it could paint a picture of somone with some nasty ideas, and could possibly save some lives, it could also lead to me recieving emails or phone calls from 7 different flight booking agencies each trying to undercut the other, and insurance sales guys, then when I finaly get to New York, and the RF transmitter in my shoes allows the police to remotely monitor me, and guide agents to give me a special full body cavity check, a thief acting on information his cracker friend got from breaking into the police databank robs my house.

    Thanks by the way for the backhanded compliment, its nice to see that you at least found it creative in some way :)

    I emailed them to let them know that as a previous user of both Unixware and OpenLinux I would never buy anything which would give them money ever again, and today I have thrown both sets of software into the bin.

    Coke have released the 'source' to their old products on numerous occasion usually in books, Open Cola gave away one of these formulas a year ago on their website, sadly it aint there no more. But I grabbed a copy while it was an I will email it to any interested parties.
    Still I don't see many people brewing their own 1950s vintage style Coke, and why because its easier to buy that £1.25 2 litres of Coke than buy all the lab kit to set it up and produce safe to drink cola.

    Well done to Real for taking a bold step, and lets hope that they take the even bolder step of releasing their codecs.
    In the mean time how long will it be before we can whip up a working helix based server that steams .oggs?

    I think you know as well as I do, that the diffence is of a whole different magnitude. Yes I can look at your numberplate and mark down that I saw you sat at the lights near the grocery store.
    Unless, I decide to follow you I can't do much more.
    Unless I have cameras at the side of the road, using which I can watch you as you drive round town, but then I can't watch Johnny, Billy-Bob and Sue-Ellen
    I can set up an OCR system which watches those camera feeds and tracks you but it's going to be expensive and will fuck up fairly often in various weather conditions.
    Or I can fund the use of an RF device and build montoring posts all over town, I can forbid you to remove these devices and force you to have your tyres changed by 'authorised' individuals.
    Using my monitoring station, I can check the average drive time from any point in town to any other point and automaticaly fine people who drive 5% above the average
    And what if I need a little extra revenue, well I can synergise my system with big business advertising.
    Now every morning on your way to work the new LCD billboards reveal an advert targeted just for you at the very moment you pass by.
    I can also sell your wife the data she would like to see which shows that you were parked outside her best friends house between 2am and 5am last week, when you were 'out drinking'
    I can determine that you were in the vicinity of a street robbery last week and if you refuse to testify I will have you for contempt of court.
    I can see that you drove along in a mass protest against fuel taxes, next time you pass by the toll both you are going to be stopped for a couple of hours so I can harass you, and this will happen more often because I have shared that information with the sherrif in the next town.

    Well I say what about active RF devices?
    There aren't any you say and how would you power them?
    You would make them kinetic energy based so driving round town powers the little RF transmitter to tell me where you are, the RF in your clothes lets me see where you are going when you enter the mall.
    It lets me see that you didn't pay for that dress in your bag that you got as a make up gift for your wife, and you have to spend 40 minutes trying to explain that you did pay for it only the clerk forgot to deactivate the RF tag.

    Well maybe, but next time I will be keeping a special eye on you and my friend the sherrif in the next town, he will also and so will his friends and their friends.

    Then do something about it, join the EFF or write to your MP/Congressman, put anti patent banners on your website use free software and share it with your friends, stop buying Music from theives who feel that you are a pirate, form your own political party for Open Government and organise and lobby.

    Or maybe lie back and light up another joint whilst listening to your kazaa dled .mp3 collection.

    Considering the problems they had with the Yorktown and its fantastic fallover NT Cluster. I am suprised that they would ever consider MS again.
    Just goes to show that hard headed stupidity reigns, just lets all hope that they don't have to reboot their systems in the middle of a combat op. because Microsoft Automated Missile Defense 2.1 caused a BSOD.
