    T-Mobile should be told they'll lose their radio spectrum if they stop providing universal service (i.e. you can call anyone, and receive calls from anyone, regardless of the technology involved), since that's what the "publicly owned airwaves" were sold to them for.

    And then take it away from them if the don't immediately drop all blocking! Nothing less will do.

    The problem is that when I got my Vista upgrade discs through Dell for systems bought just before Vista was released, I don't have pretty hologram discs like that at all. I have just plain printed Dell labeled junk that anybody could counterfeit.

    I have one of the great little devices available plugs my MP3 player into a small FM transmitter, allowing me to wirelessly listen to my music over my car radio. Here I don't just have files sitting on a mass storage device, I'm actively broadcasting music copyrighted by record companies affiliated with the RIAA. And someone manufactured and sold me this device with this precise use in mind. Other people also have radio receivers, and this broadcast is unencrypted.

    Am I breaking the law?

    Are the people who made and sold this device breaking the law?

    If yes to the above, why haven't they been sued out of existence yet?

    (Note: this is an illustration to prove the ridiculous positions that the RIAA has attempted to stretch existing laws.)

    What if I personally declare and mark all "Goodmail" as spam? Will someone else decide I didn't actually mean it? Or don't have the right any more to mean it?

    While I applaud having bulk e-mail senders pay a penny or so each to have to send e-mail, it's not like I'm going to see that penny for reading their junk, or get an AdSense payment for clicking on their link.

    Wouldn't surprise me to see the ACLU complaining that this hurts the poor, promotes child pornography, or damages Free Speech. How long before there are subsidies for those who can't afford to send e-mail otherwise?

    The only advantage of making e-mail more expensive for the average user is that we'll see less of it. 10 billion Viagra spam messages sent for free through hijacked users, bot nets, and China, wouldn't be worth sending if the return per e-mail on average was less than the cost of sending them. And I wouldn't miss them for a moment!

    This is such a reach. Heck, under this interpretation, anyone shouting out loud at any public demonstration could not be videotaped by news crews without his permission. We know TV news crews aren't being busted for this. Where is the ACLU? They should eat this case up for lunch. Allow this to stand, and you cover up police misdeeds since they'll have the only record of the encounter as evidence. A total fucking crock!

    The officer probably didn't know of the wiretap law either, and the DA was fortunate to find it, or they'd be even worse off than they are now. Arrested for no reason at all. They clearly wanted to harass and scare the kid, which the obviously succeeded at. Now the city should fork over $100K compensation, along with a sincere apology in the process.

    If it ever goes to trial, and I was on the jury, it would be Jury Nullification all the way, baby!

    What outright B.S. It certainly doesn't help all subscribers from the start. It doesn't help at all the ones who actually use the network they were promised.

    The Road Runner service may not be used to engage in any conduct that interferes with Road Runner's ability to provide service to others, including the use of excessive bandwidth.

    That could apply to anybody who uses the network at all!

    These people should be sued for consumer fraud, and into Specific Performance. If you give me 6MBs, and charge me for 6MBs, I'd damn well better be able to get 6MBs most of the time on any application I choose to run!
