The Music industry has gotten way to much control... The copyrights should be held by the band and the writers of the music... not the companies that devolop and distribute the mediums... I think that is what needs to happen... That the Artists retain Copyrights and licence to the diffrent medium vendors... then suddenly alot of problems will go away. Music will be cheap once again instead of priced to extract every little penny possible out of your pocket with a miniscule ammount trickling into the artists hands.

Blah Blah.... No your missing it actually... Its all about exploitation. Spammers Exploit email to send thier UCE with virtually no cost to them when looking at returns gained.. They have Ablosutlely no reguard for the service providers they spam... at 650,000 emails a hour how much time and bandwidth and computer resources are tied up at the reciving end? Especially when its it unwanted so anti-spam measures are put into place which the spammers do everything they can to get around so even more resources are needed at the reciving end of the spam.. I love to see it when spammers get it back in the face..
Why has SMTP remained broken for so damn long?!? While spending millions and millions of dollars fighting Spammers (Hotmail/AOL/Earthlink and the like) Why don't they fund a OS project to fix whats wrong with SMTP and make it the defacto stanard protocol... After if they team up to do this and offer a good portable free open source product that defeats spammers who in thier right mind wouldn't move to it and eliminate spam. When you look at how many ISP's would jump at the new stanard to eliminate spam from thier networks due the simple fact.. Its cheap.. and reduces overall overhead of managing a email service.. Its a brain dead decision.. Just looking at the number of email addresses that would be covered by the top 15 or 20 email providers would mostlikely add up to be 70% or more of active email addresses.. That right there would suddenly Break Spammers business models... Not to mention including AOL would encompass 90% of the guliable public thats on the internet... so that right there would send spammers into chaos as return on investment plummets to numbers aproaching Zero.
Getting rid of spam simply makes sence... You provide a better service to your customers.. Reduces overhead of offering email service.. Reduces Support costs as well.. you don't have so many customers having problems involved in people changing email addresses cause they are getting spammed to much (Try working for a ISP in the support depart ment talking to people complaining they can't mail people in thier contact list anymore cause they changed thier email address... or people having problems because they have changed thier email address because it was getting flooded.)
They could even build into the Licencing agreement factors that prohibit underhanded tactics used to Send UCE and suspend licencing to those that do not follow the terms and be prevented from sending email at all..
Otp-out doesn't work.. Its plain and simple.. optin is a way better aproach.. People will learn to make sure they don't opt-in.. and if they do by accedent or under handed hidden agreements they you click past to just get what you want. to easily and quickly get back off thier list... Poting out could consume many hours a day of new spammers that found your address any way they could... which is simply wrong... Once its in writing in licencing spammers can easily be charged under the DMCA wide spread umbrella.. (whoo! Imagine that! something good comming from the DMCA!)...
The solution isn't that hard to see at all... All it needs is some of the big players to step up to the plate and start the ball rolling and reap its long term benefits... Wel spammers don't get any benefits from this but they are internet Parasites that need to be exterminated as they are today.

You waiting for that important Email from a friend telling you that he needs a ride from the Air port and his email is lost amist Spam or gets filtered and they are completely unaware.. Funny thing is you can submit a change of address form as all that Snail Spam will follow you with a Change of address...

Well Thats the thing... DSL/Cable isn't there to replace T1's.. They are lower cost because they are Shared out to offset cost... What do you think they hook DSL/Cable up to?!?! The same stuff T1's do!! Bandwidth has to be paid for... You think just because it gets run through DSL/Cable service the Magic Bandwidth Farie comes by and makes it cheap?! Bandwidth is pretty much a fixed cost(Depending on who is selling it to you and how much they have aswell).. the more you get the cheaper it is... The shorter the local loop the cheaper it gets... Once the data pops out of the DSL/Cable ect equipment do you think it magically appears on the internet?!?! If you can sluff what you are using for Bandwidth off on a shared access medium then do it... But don't put on a big surprize face when they come to shut you down or toss a huge bandwidth bill at you for mis-use of the service.
You Think Regular Grade ft4 grade cvat5 will last long out doors? You can get outdoor rated cat5 but its slightly more.. ~.60-90$ a foot.. do the math and it gets really expencive.. Also getting Pole Space isn't that easy as usually the Power/telephone companies own them and its usually 3-5$ a pole for rental. These costs add up quickly not to mention the time and equipment to properly do pole contacts. Not to mention Where do you stick all of the equipment that is needed from point A to B. Building secure sheds with power can get pricey.
Well what happends when you have 2 Challenge responce systems on each end... Any mechanism that is put in place can be abused by spammers. This will also Fail. White listing Challenge responce servers wont work due to SMTP being broken and the list can easily be spoofed. only buy digital signing by white listed challenge responce servers will work or some thing similar to verify server source. This will drastically reduce spam if it actually works.
I'll live with Banners.. But not pop ups... Annoying to shut downa zillion windows after/during surfing. Like Pop-unders... Whats the deal with those! They are put out of plain site... Effective Advertising? Hard to imagine that. I dislike any form of advertising that generates work for me.. even just simply closing windows... I will click on a banner when asked to support the site I frequent becuase as you said.. Bills needs to be paid some how.
Best way is to use Maintence logs of the current MS setup... How much downtime... time to resolve issues.. frequency of problems.. type of problems.. ect.. once you have compiled all that you have your baseline of what is curently acceptable level of support... Then you can do research on the OS software you will be running and gather stats to compare to... Then play with your stats to prove your point....
Should be fairly easy as MS security is very poor when it comes to alot of thier apps and time to resolve is not allways speedy where OS software beats MS for time to resolution hands down 9 times out of 10.
After all MS's secuirty though obscurity model just doesn't cut the mustard. So there should be loads of data available of MS flaws on secuirty. Then show stats on OpenBSD to show how good security can be with OS software. Secure systems tend to have a drastically better Uptime than insecure ones:)
As for product support.. again demonstrate What kind of support is currently needed and how often its mission critical/effects the way business is done...
Once you have the setup up and running with a testbed to try out patches before they go live its pretty much smooth sailing from there... as Patching is the only headache you will ever have.. so having a near production testbed is essential.. Not to mention make damn sure you have a way to quickly restore any changes made so impact of a "OOPS" is kept to a absolute minimum.
But comparing level of service that you currently get is gonna wind up being your strongest case and point. Upper management is rarely aware of what it takes to keep systems up and running so it will be a real eyeopener for them and will make them more forgiving if you still have a few weak spots in your case or they come up with angles that your arn't 100% prepaird for.. But Have all your stats with you on how the current system runs and equivilant stats on OS systems so you will be able to rebute unforseen lines of questions.
Seems like a no brainer to me. Everything is consumer driven... If you have no customers then you have no business... Its that simple... If a business annoys you don't be a consumer of theirs... After all in the mean time... There is allways the power to pull to stop it from playing:)
Its pretty simple... Don't go to sites that annoy you... Decreased traffic will show them that this is not acceptable behavior and they will stop doing stuff like that. I still use the old host file method for Killin popups and it works great.. mind ya over the years my hosts file has grown rather large and I guess I should check the names in it to see if they are still valid.. wouldn't be shocked if 30% of the hostnames in it are now dead... But thats off topic... People just have to Stop going to sites that utilize sneaky pop-up tactics... Its just like Spam... Well that is a poor statement... The only way the software industry will die is if the hardware market stagnates and innvovation is completely crushed... Of couse I can't say anything like that would out makin a jab at MS so here it is... M$ would love this... That would mean a end to lawsuits and no-more company buy outs would be needed.. and then they could actually force everyone into Renting thier software for Huge $$. But once again if they started to do that... I have yet to see any software that can not be stopped :) This I can see will promote the use of OS web broswers that have been patched to reconize these ads as Malicious and prevent them from actually play the audio and sned back the confirmation That it was played :) In the software world there are allways options for counter measures available. After all in the mean time... There is allways the power to pull to stop it from playing :)
Its pretty simple... Don't go to sites that annoy you... Decreased traffic will show them that this is not acceptable behavior and they will stop doing stuff like that. I still use the old host file method for Killin popups and it works great.. mind ya over the years my hosts file has grown rather large and I guess I should check the names in it to see if they are still valid.. wouldn't be shocked if 30% of the hostnames in it are now dead... But thats off topic... People just have to Stop going to sites that utilize sneaky pop-up tactics... Its just like Spam... Untill people Stop opening and buy products that send spam emails there will be spam.. for Pop-ups... kinda the same thing if people stop going to sites that force pop-ups on you then it wont be profitable for them to do so and they will stop.

Well that is a poor statement... The only way the software industry will die is if the hardware market stagnates and innvovation is completely crushed... Of couse I can't say anything like that would out makin a jab at MS so here it is... M$ would love this... That would mean a end to lawsuits and no-more company buy outs would be needed.. and then they could actually force everyone into Renting thier software for Huge $$. But once again if they started to do that... It would lead to a company trying to get around all software copyrights and patents that MS has and build a Compatible OS that would run all the win32 software and sell it for cheaper.. and once again spark some light into the software industry. This is a very poor statement... Hard to belive it comes from a ICON of the software industry.. unless he just wants public opinion to be that it is dead so there is less compitetion :)
