    please dont post anymore news from the NYT (not hard to find another source if it is really newsworthy). when i click the link i get a huge registration page asking for date of birth, income, detailed employment info. on top of that there is a lot of opt in crap for yummy spam.

    the reason i read webbased news sites and groups in the first place is to get away from biased, orverpriced, overrated, and generally slow newspapers.

    kazaa is ad/spyware anyway. not like they are the champion of consumer rights. there are tons of other progs like shareaza, winmx, ares, not to mention newsgroups, ftps etc etc.

    record industry is screwed. what are they going to do? tell the government to turn the internet off so they can continue their price fixing on cds'? they are already convicted monopolists (in civil court) and probably felons to boot.

    and the idea of going after individual users is laughable. how can they prove the music was downloaded illegally? what if i bought the cassette, cd years ago, but lost it. or i sold the physical cassette/cd as a coaster, but retained the rights to the content. just because i cant produce an official copy of the media does not mean i dont have rights to use it.

    even if this type of habeas discus argument does fly, and someone is found to have (gasp) downloaded a file without paying revenue, this is not a criminal action. only civil damages would apply, and how are those assessed? full retail value of the cd? i think not, the record industry is there to distribute, in this case they havent done a lick of work. the cost to them was nothing. they may claim that ppl would otherwise have bought the cd. but that only goes so far. ppl will only spend disposable income on music (fanatics&afficionados aside). therefore damages cant be set at how much music was downloaded. lets say someone downloads 1000 cd's in a year, but has an annual income of 30k. there is no way the record industry will convince any judge this person would have in their right mind spent half their salary on cd's.
    just because someone downloaded a file does not meant they still have it. then what? are they still required to pay for a cd?

    kazaa will prolly go down because they are making money bootlegging cd's. although they do not charge for the cd itself they make money from the advertising it generates. even their "legit" service thrives on the publicity of their bootlegging operation. If kazaa cant be sued because they have hidden their assets in tax havents, etc, then those who profit from their bootlegging can be instead (read: anyone who advertises with them)

    in the end kazaa is not as secure as winmx or shareaza, two very good, FREE, p2p apps. they are decentralized, no spyware, no ads, and no revenue to target. only way to get rid of them is to turn of the internet.

    if i remember correctly, greedy sony refused to license the technology to anyone else, wanting all the profit for themselves. instead they got nothing.
    also didnt know beta could not record a whole movie (never owned 8 trach either). what were they thinking? they must have known tv shows were 1/2 and 1 hours long, and that movies were longer. im sure they were not afraid of copyright violations, as they took the movie industry to court for 'consumer' rights an won. dont think they are so generous now that they own a record label.
    these days sony is a grimy, sleazy company with very little to offer besides hype. i cant think of one product they have that someone else doesnt make better.

    i dont like where this is going. most if not all software based copy protection/anti-piracy trash is hacked quickly and easily.
    all software based drm (what a broad euphemism) is inherently flawed and can be circumvented by anyone with minimal skills; if it is observable it is copyable. some may argue that quality may suffer, but with the right equipment it wont be noticable. with < .001% THD for audio the new digital copy will be near perfect. and that new digital copy can then be copied infinitely with zero loss.
    what scares me are several possibilities:
    1 built in loss. all rips, burns etc will have distortion or loss intentionally added. this distortion does not add up, but multiplies each time a new copy is made.
    2 hardware is rigged to only play approved,or registered media. this could be incorporated w some kind of checksum to detect what mp3/movie the user wants to play
    3 there may be no way to disable hardware based drm, besides getting new hardware

    hopefully pc makers wont fold on this one. i like apples slogan, rip. mix. burn. lets hope that the only ones who continue to get burned are the fatcat record/movie executives.--lean times ahead, either for mpaa as file sharing +, or for pc makers as the only ppl who will want to buy drm crap are the record execs themselves.
    the argument that piracy will lower the amount of good media is out there doesn't work. if mr valenti an ms rosen dont like the entertainment industry, they can leave. nobody is forcing them to stay in that market. if making millions for running a racket is to hard, there are plenty of other jobs out there. they can pump gas, cobble shoes, deliver pizza, collect cigarette butts and make whole smokes out of them etc, etc.

    who are they kidding? 1 million to produce a cd, mebbe if they suckered the band out of their cut and are piling up costs to get them in debt so they can get more contracts out of em.
    the "professional" sounding cd is a myth. most if not all of the stuff coming out on cd is crap. it may sound ok on regular stereo's pc speakers etc, but those things are designed to cover up the mistakes in shitty recordings.
    just listen to one on a very high end stereo (like 25g's worth) and you will hear where that million dollars production cost didnt go.

    lol no chip sector here in canada. we are a primitive country. things are released here months, sometimes years after the rest of the world. only new things u can buy here are socks and underwarez. however we do have a pos ati hq located in markham, which has been geographically found to be the sphincter (ie shithole) of the world.     only thing i dont like is havin to wait 2007 for 600mb a second, thats like 3-4 seconds per movie. sounds fast now, but wait till multi TB drives come out. and as far as digital rights management goes, M$ can lick my balls as always. look to the internet and the angry white hacker community to patch any of that crap within hours of implementation. there are some ppl who will NEVER pay for warez. you can spend billions on trying to prevent them, or you can spend millions to keep the other 99% in line

    there goes a very useful device in movies, where the hero loses his gun an has one passed to him by a supporting character. tons of liability here. scene 1. robber breaks in, atacks owner of gun. spouse cant use gun to defend family beacause of law. massive lawsuit for damages. hope you brought your checkbook nj govt. useless technology. about the only good that will come of this is preventing kids fom playing w their parents guns, but kids are very good at getting around this sort of thing so it wont do much good. new jersey is a festering cesspool. this is a desperate attempt to reduce crime there,it wont work. and since when do criminals using guns bother to register them? people will stockpile guns, buy illegal weaps etc. b4 this has any impact, we will be using lasers and disintegrators. another poster said ppl will start making guns. you have no idea how easy this is. all you need is a machine shop. that is how many ppl get silencers when the cant buy them. plans are easy enuff to get too. this will only create a bigger black market for old guns. within weeks (probably more like hours) someone will figure out how to disable the system and start sellin mod chips. right to bear arms is bogus these days. the us govt and military is so advanced that no amount of handguns will protect the citizen. it should be amended to right to bear nukes if you want any protection. like any other govt in the world the us will not hesitate one second to kill any of its citizens to protect its own interest. USA is very close to being a dictatorship. i agree with the poster who said this, in fact closer than many think. california is leading the way in fascist policies. their 3 strikes law sets criminal justice back thousands of years, and predates the code of hamurabi. it is a law to protect the rich from the poor. just read les miserables and you will get the idea. california routinely violates freedom of speech by attaching an electrocution device to defendants in their court system. if the defendant says something the judge doesnt like he presses a button and electorcutes the defendant. personally i feel the makers of this legislation should be in prison themselves. but the worst thing about the usa is the death penalty. not only does this supposedly free counrty routinely execute ppl, but it is only one of 3 countries in the free world that routinely executes children. info on this can be found on the amnesty international website. so the next time someone decides to spout crap about america the free and good, open your eyes, and tighten the leash on your politicians. guns dont scare me; i would rather die in a free country than live in a police state.

    what a previous poster said makes sense, how do you get a flag to wave in space, when there is no air? also look at the computing power these guys had. less than my palm pilot, and my palm is a pos that cant even read a flash card out of the box. then there is nasa's billionaire roller coaster policy: if you want a ride on a shuttle, not only must u pay lots, but you have to be drug free (lol first thing i would do is spark a fattie; there are no laws in space. hmm id also have some bitches on the shuttle gettin it on). and you are also not allowed to have ever said anything bad about nasa. but there are more serious clues. Just look at the shadow of that huge patio umbrella in the picture on the cnn site. i bet it was taken somewhere tropical. that guy in the suit must have real sweaty balls. if nasa wants to refute these arguments completely then all they need to do is borrow a few lawyers from M$, and put the word quality in everything they say. and as for fox airing the lunatic fringe, our question is not, what it was on tv so it must be true, but what? tv still exists?

    regulating what frequencies can be used for what purpose makes sense, and should be observed. yet there is also a very good argument for public domain use of this resource, since it belongs to everyone. anyone can build an use a transmitter. there are various permits to allow for these things, and are perfectly legal if you stay within the proper bandwidth and power guidlines. the limit on wireless network cards is a different story. i see several possibilities here, one of which realy scares the fcc and the govt. there is probably a limit on the product that states transmission can only be done on premisis. this is not really there to protect the available radio spectrum. whatever bandwidth given to these devices is not terribly important, or it wouldnt have been available in the first place. what i think really scares the govt is a giant, wireless network, on the scale of the internet. if it reached that point it would be almost impossible to regulate in any way. there would be no ip address to track, no physical doors to knock on anymore, just one huge mass of information floating in the air. and forget triangulating an offenders position, with that many transmitters out there it would not be easy. the idea of truly private communication for the masses has terrified the US government for decades. they have spent billions monitoring faxes, emails, telephones, and even encryption over the the years, searching for "keywords". it is hard to say if this is done for crime prevention and peacekeeping, or to preserve power. i dont share that sense of paranioa. i think it is time for another internet experiment. there should be a new band given up to the public domain just for wireless networking. but instead of licensing it to companies who pay them money, the fcc should give it to the individual. anyone would be able to brodcast anything they wanted from their pc. the only constraints would be that it is digital, conforms to existing regulations about slander, hate, porn etc..., and that transmitting power would be limited depending on population density. would something like this break the hold large companies have on high speed internet atm? would it evolve in a civilized manner? or would the lack of regulations bring out the worst in ppl and create anarchy, like the citizens band, which is the internet equivalent for hill billies. i think these are moot questions because the government would never allow this to happen. they seem to be of the opinion that if they lose control, they will be automatically overthrown. the government must have a very guilty conscience to fear its own citizens so much.

    i hope kaz goes the way of napster. they have some of the most virus like spyware out there. to say p2p cuts in on profits may be true, but try and figure out an accurate amount. to say that the son of a single mother (presumably not rich) cost some fatcat record execs 5 grand is not true. people will only spend a percentage of their income on music, and that for the most part being disposable income. even with children emerging as a recocgnized source of revenue in the past few decades, very few of them have 5 thousand to blow on music, or anything for that matter. the most you could ration this kid is about 1000 per year, and that includes bdays, xmas, noday resents, bribes for doing well in school, allowance, etc. only a fraction of this would ever be spent on music. so the wrecka stow could not claim lost income or damages, because they would have never got that income in the first place. the most they could have lost would be a few hundred dollars, and thats if the kid was a real music afficionado. bet he bought an ipod w the money he saved ;)

    it's amusing to watch these dogs fight over a piece of tainted meat. isn't there enough secure crap that doesn't really work out there already? like realize posted, anything that is observable is copyable. and anything that is made can be unmade. usually the hacker community trashes any new copy protection in a fraction of the time it took to develop it. my bet is intertrust will take the money and run. look at it this way, they can spend 450 mil in court, or they can pocket it and retire. that's over 10 million per employee. personally, i would like to see a big, frivolous, and outrageously expensive lawsuit unfold. don't think it will be godzilla vs rodan tho, more like the three stooges. (btw i think those guys in the godzilla suits were boxcar hobbos who would do the movie for a case of beer and some food). ideal situation would be sony buyin intertrust, and keeping up the fight. sony may have a huge war chest (revenue: 57 bil a year in sales) but they have a 1% profit margin. M$ will win out in any case. If they can whip the US govt in their own courts what chance does a lying two faced company like sony have? anyone remember sony goin to court to protect vcr's? though a part of me wants to see the little company win big. it would be a nice irony if m$ an $ony were found to be protecting digital rights with pirated warez.
