Correction. I read the Ars article, and the trouble you can get into is regarding copyright violations that occur on your connection.

So all of my examples in the parent post should be modified to talk about copyright infringement as the illegal activity.

  2. Secure? on France Passes Harsh Three-Strikes Legislation, Again · · Score: 4, Insightful

So saying that a connection must be secure immediately raises the question: how secure?

Are they responsible if a neighbor guesses a WEP password and downloads kiddie porn?

Are they responsible if they have a fully patched Windows box, with virus checking, but get compromised by a virus missed by those safeguards and become part of a botnet?

If a criminal breaks into the house while they're on vacation and makes a bunch of purchases with fraudulent credit card numbers, are they still responsible?

There's been dozens of Myspace and Facebook clones out there. None have particularly succeeded. The underlying tech isn't what drives their success. It's the ability of their Marketing Droids to convince people that the emperor is really not, in fact, stark naked.

I think what really drives Facebook is that it reached the critical mass to get a strong network effect.

As you pointed out with the source code, there are numerous sites that could have served the role Facebook presently serves. I suspect this is a system that was destined to converge on one particular website, but was chaotic with respect to which site would get the crown.

I don't think we know whether or not to do much rejoicing until we see it.

Contrast The Matrix vs. the 3rd Matrix movie, or Star Wars Episode IV vs. Episode I, or early vs. later Aliens movies. Or, more optimistically, Peter Jackson's 2nd and 3rd LOTR movies vs. his first one.

I'm just saying that some sequels/prequels can be bad enough that we wish they'd never gotten legal approval to exist.
