No, not in the computer/technology field. Mac has a very specific meaning and Aqua refers to a specific technology especially when it's being used to reference a user interface like it is in the names of the themes. That is why they are trademarked.
To put it in perspective for you: If I went out and made a new soft drink and named it "Aqua", Apple couldn't sue me but if I made a new UI shell for Windows and called it "Aqua ME" or something then they have an OBLIGATION to ask me to stop or risk their trademark becoming diluted.
c'mon, look at the name of the themes! apple's not complaining about the "look and feel" of the themes, they're complaining about the trademarked names of the themes. i'm sure if the authors renamed the themes to not include the words "Mac" or "Aqua" and made sure they didn't have ripped bitmaps or icons from the real aqua then there would be no contention and apple would quietly allow it.
I won't be impressed until we can start storing teraquads of low-res, blocky pictures. Goodness! It's the year 2000 and we still don't have isolinear optical chips! Geordi would be laughing at us if he were still alive.

No. Quite a few list members (normal ones, not just Be engineers) refuted your arguments and asked you to stop since you were essentially just rehashing the same old issues over and over again and accomplishing nothing but filling our mailboxes with spiteful remarks. You did not stop and so some of us asked the listmaster to intervene.
I'm sorry that you see it otherwise but don't go blaming other people (the listmaster in particular) for just doing what they need to do. You obviously weren't happy developing for the BeOS. If you were so unhappy, why continue? It just isn't healthy. Neither is screaming at a bunch of other people for not totally agreeing with your opinions.
It doesn't cost a thing and nobody's turned down. I've been a developer for over a year now and I write BeOS software in my free time.
I've heard of people in the past who registered to be a developer just to get free copies of the OS but since the dev programs have been restructured, that's no longer a problem. You should try re-applying again.
Actually, they used to give the entire OS away for free (or nearly so). I got the full PR1 CD in a magazine. As a developer, you get free updates and at the time, anyone could sign up to be a developer for free. Truly, such a thing isn't very economical in the long run but it did get them a bunch of customers, many of whom are still loyal customers.
Either way, you do have a point. Be wins this way in terms of publicity. You've got to be arrogant in today's computer industry to stay alive.
Be's target for the past couple of years has been the multimedia development market. It says so right on their web page. Last I heard, both music and graphics are multimedia. Therefore, I think they're very much right on track. ^_^ Expect some video editing software and a 3D modeler and renderer to come out in the near future as well.
Now, there are many BeOS users who'll tell you that it makes a great general purpose OS and, well, they'd be right. Hey, I've got pine, a browser that can read and post to/., my choice of editors (emacs, Pe, Eddie), and a compiler. What more do you need?
