The ability to script most of photoshop using javascript is a great step up from the limited Actions for doing serious automation. Almost every time I use the javascript api though, I find myself writing python code to generate some of the javascript -- to build arrays from parsed text or xml, etc. -- and every time I find myself wishing that photoshop itself supported python.

The cnet article, though, is actually titled "Unexpected twists in Internet law," so though the poster misrepresented the focus of the article, maybe he should be credited for trying to put the Internet back in IP.
You're right, the lack of sophistication in this solution makes the designer seem incompetent (or deceitful, but that's a different argument). It also makes the client look incompetent. I mean, if you were a record company looking to deploy such a thing, wouldn't you get some reasonably competent people to put it to something like a real world test? Perhaps they did, and decided our fallback is the DMCA...

Indeed, heavy weaponry takes longer to wheel into position, so you do so when it's impact is worth it.
