Basicly you aren't allowed to spread a photo where someone can be identified without that persons permission. I guess that would have worked here if used, but in any case if they had asked Virgin to not use the photo wouldn't they have agreed on it?
Anyway it's still the copyright of the photographer so it's up to that person to decide how to license it.

Sure I would prefer a chiped Wii and sell the cube, but it's still expensive and I doubt the few existing games are worth it in experience compared to all the games I already have.
