Initially, the big problem was they claimed Java could do absolutely anything. Remember the jokes about the Java-enabled toaster? Once Java failed to live up to its initial promises, they failed to market it to a more appropriate environment, like business applications. Businesses and software companies made this popular on their own. Then there was the laughable Java Desktop. Then the licensing issues: are they going to open source it or not? Is Java proprietary or not? Once Sun makes up their mind exactly how they are going to allow Java to be used, companies are going to be a lot more comfortable about it and I see it surpassing.net.
Would you want to be the one going to court with only a verbal contract. I guarantee you'll lose. Unless the other side has no case whatsoever you will not win with only a verbal contract. In this case, the whole deal is questionable, given some of the irregular circumstances involved.
Vonage will likely send out some legal letters to see who they can scare into paying, but if they actually try to take legal action to collect, they will find themselves on the other end of a lawsuit from all the pissed off customers. It sounds like they may have broken some securities laws here.
How embarrasing it would be if you had to put Sun Marketing Department on your resume. But yes, they must all go if the company is to survive. Java is probably the best example of great technology held back by completely incompetent marketing.
I would definitely start by offering far less than they're asking just to see how serious they are. $750 would be a good starting point, maybe even less. The longer they've had the name the more likely they are to sell, since its probably not in high demand. Profit margins in the domain market are even more obscene than high end jewelery stores, so they'll be making money no matter how much they sell it for.
What more information would you need? The squatters make it clear what they're offering and for what price. Its up to you to determine if its worth it. This being the internet, the potential buyer can research to see what people are paying for domains. They can also post an Ask Slashdot to get information from other peoples' experiences. Other than the fact that domain squatting is not an entirely ethical business, I fail to see how he's getting cheated here. He could always buy a different name for a much lower price.

However this lawyer first should not be making these idiotic statements to the media; most lawyers say nothing to the media beyond "we will aggressively defend this case" and advise their clients to do the same.
