Why is that? They could go into a crouch-high pitch black corridor and record the FPS there, but that wouldn't be interesting. The worst situation that the user can expect on each card IS very interesting to the consumer. Even if the worst spot for each card is different, its still very interesting.
For example, if one card consistently runs at 30fps at the highest detail setting no matter what, and another runs at 50 most of the time, but drops to below 10 during every bossfight, which is the better buy? I dont know, thats up to the consumer. But this information is very relevent.

I wouldn't misunderestimate the Sony/EA relationship. That relationship had a HUGE hand in killing the Dreamcast and the Dreamcast beat the PS2 out the door by a wide margin. Business relationships have a way of crossing from one device to the next. If this is the kind of thing Nintendo fan boys are grasping on, I think you are right to be nervous. The Gameboy Advance has good support now, but it has no competition. The video gaming elephant just walked into the middle of the room and its presence cannot be overstated.
If the whole industry is forced to change how positions are defined, due to the alleged actions of only one member, the consequences to the industry cannot be predicted. My company does not treat me like the EA employees allege that they are treated. However, I am covered under the artistic/self-managed/studio side and am considered an exempt employee. They pay me a certain amount of money to get a certain job done, not by how many hours I work. I happen to like this situation. If my position, and those of many of my friends who I have worked with for many years, is redefined under the law by this ruling, some of our jobs will certainly be eliminated.
