At least it is clearly bullshit. The "open source" tag was not important decades ago. "Open source" is a decade old (as it was introduced to replace "free software" by OSI), and in the 80s and 90s nobody (in business) paid any notice to open source.
And oddly enough, it seems like the guy is pro-open source from his blog. I guess it is the FP "journalist" misquoted him to satisify his own prejudices.

This decentralized version will be almost impossible to take out both legally and technically, and according to the ideology behind TPB it will be more democratic.

AFAIK you can replace "thepiratebay.com" with "openbittorrent.com" in all torrents currently available on thepiratebay.

I recommended people interested in an open source phone to ask Nokia when they will have one ready. Linux isn't made for mobile phones, Symbian is, and Symbian will be released as open source soon. If(when) I can hack the Symbian software on my E65 I'll have a top notch smartphone. Without camera, EDGE and 3G, the Neo Freerunner will never be a top notch smartphone.

But, it's naive to blindly believe them. A bit of common sense is all it takes. You're wrong, simple and easy. TBP is run as a pro-piracy project, nothing else. They are not in it for the money. They are students or IT workers and run TPB in their spare time. Noone in the project has a salary (from TBP). Research beats common sense any time, so you're welcome to go on and do your own. But you're right about having a bad ad partner. Check the ads on the page on you get a sense of what kind of ad partner they have. The reasoning from TBP is that most companies shy away from doing business with them, so they have to stick with the lousy partner they got.

I'm sure the creationists could counter the argument with some theological hand waving, but any reasonable person would understand that you aren't supposed to take these stories literally. They are myths, and myths are meant to be interpreted.

Political action (lobbying and trying to get some attention in the media), legal action (IPjustice, EFF, etc) and outright civil disobiedence (in this case file-sharing and disregarding patents when publishing software) works way better. Though, it only works if you manage to "sell" your alternative as an viable alternative (look at the peace movement, they usually don't succeed despite beeing good at all of the above).
If we all do this we still have things to discuss on Slashdot in 6 months, but we might have stopped software patents in Europe, and possibly created a momentum for abolishing them in the US too.
