I looked at "surprising" in the thesaurus. It says that "startling" is a synonym. This story just points out that they aren't. This news is certainly unsurprising, but it's still startling.
I think you might be able to make an argument about the warnings given by Apple before the update was even released. They released the update, knowing that it would destroy a large number of phones, and they have admitted knowing before the fact in public.
It's like if Microsoft released a security update to Windows that would corrupt the BIOS if Firefox was installed. If it just happened, it might be chalked up to a mistake, but if Microsoft released a statement saying "If you have Firefox installed, this update will corrupt your BIOS," before releasing the update, then it looks a lot shadier. And, being a security update, it's harder to say "If you don't want the new features just don't update."

Secondly, although I agree that poor grammar and spelling can make something unreadable, it is also possible to make a grammatically correct statement that is unreadable. (for instance, the Buffalo sentence.) I'm all for bitching people out that write so poorly they can't even be understood, but the constant criticism of minor errors that don't affect meaning or readability pisses me off.

If you knew what the correct word to use was, you were obviously able to understand the meaning of the comment, so just keep your fucking mouth shut.
IANAL. The illegal part might be intentionally destroying the property of people who installed the update. If it can be demonstrated that the damage was intentional, there might be a case. I suppose that would depend on lawyers and experts being able to convince a jury. From my perspective, I can't see how it couldn't be unintentional, or at the least, negligent.
Besides, technically, using Safari Web Apps might be considered using "third party applications".

And there might also have been greater engineering problems (heat dissipation?). Yeah, and it would also be worth buying. This thing is a total abortion. It seems like they rushed it to market based on minimum modifications to the iPhone. I'm expecting a HD based version next time around. I actually got excited when I first saw it, and then I completely lost interest when I heard it was 16GB. Hell, even if it came with some sort of cable that allowed mass storage on a 160GB ipod, I might consider it. Of course, our intellectual property overlords would probably never allow such a thing.
