    Is it just me, or does that seem wrong?

    Maybe not always.

    I think it's the coupling with frivolous lawsuits that creates the problem, plus maybe include the US system of Punitive Damages for good measure.

    Take the InterGraph case as an example. They probably has a legitimate case against Intel.

    If the only way they could win that dispute was by issuing shares to a lawfirm would this be unreasonable?

    If Yes, How do you propose smaller companies defend themsleves?

    Not really they had a small profit from operations and substantial positive cash-flow.

    The took a charge for loss on holdings like Cobalt and HighGround.

    This is akin to you still keeping your salary (maybe a little reduced) but your house is worth less than you bought it for. That is a bummer alright but will not kill you.

    I recently saw a movie where the head surgeon made all the operation on little children with brain tumors. He was almost let go as this clearly disallowed anyone else to aquire the needed skill set.

    Nobody disputed that fact that he was the best.

    They were taken serious in the beginning, then we laughed and judging from the comments on /. most people have started to ignore them.

    Look at the Latest review listing there is no N-Cage games. Maybe it's because there has not been any reviews for a N-Cage game within the relevant period. If so My Bad

    Game Ranking has ever removed the N-Gage from the frontpage listing of platforms, that they had a few week ago.

    Sony is making their own chips. Nintendo uses NEC.

    The PS3 will use Cell technology jointly designed by Sony, Toshiba and IBM, the Gamecube is using PowerPC derivative Gecko and Next generation will use IBM as well.

    Your point about porting an ASIC design is not relevant we are talking huge design not a little piddely GA/ ASIC point solution.

    Come on give me a break on mentioning LSI and NEC, a TSMC has the manufacturing capacity needed but not piss ants like LSI. But you need the designs skill and the manufacturing capabilities. This narrows the field a lot.

    IBM, Intel, TI is all I can think of. Spend 15 years in the industry by the way.

    It is interesting, actually, that IBM is potentially involved in all of the major game console platforms..

    That was precisely the point I was making in the original post.

    There is a lot of SC design houses and a lot of SC makers but only a select few major players. that has the needed process technology and the manufacturing capacity.

    Someone mentioned LSI and NEC, Not even close.

    This is not a problem for IBM, the reason being that there is no other manufacturing player in town.

    Once the process is decided that it it. You can't just switch to someone else.

    This means that for once in their life MS is at the mercy of someone else.

    Screw IBM and you just free up resources for Nintendo and Sony (Assume you know that they have chosen IBM as well), and delay your own product by 1-2 years, meaning the project is pretty much dead.

    IBM is the Ring that Rules them All.

    I think you are right that this will never happen in the general public, but maybe a better understanding could be reached inside the walls of CIA / NSA / MI5 or whatever.

    I have made a suggestion to Charlie Rose the excellent PBS talk host to maybe invite Scott Atran to discuss his findings.

    Well who knows. I think it is important to try and shape the debate in a different direction, however little the impact.

    This might be a little OT but I think it is important to understand how our View of certain wrongdoers and stereotypes in general stands in the way of finding a solution to the problem.

    Read about Scott Atran's Paper on the psychology of suicide bombers.

    Unless we take the time to understand and remove preconceived moral notions we put ourselves at a disadvantage vis a vis solving the problem by fixing the underlaying issues

    Unfortunately this might not be as idiotic as it seems on it 's surface. I addition to the Stock issue that will be mentioned here ad nauseam SCO needs to extablish some sort of loss if they are to collect anything.

    They have sued for $3B but this is just a number. It could just as easily be a gazillion.

    To collect anything in the unlikely event that IBM is found to be at fault, SCO needs to establish a Loss.

    They way to do this is to stated a value times the Units used. This is most likely why they have introduced this silly $699 scheme.

    For the value to be "deemed" acceptable they need to sell at least some licenses at that price . It is not enought to point to MS and say they bought licensing for $8M.

    Now if they can swing somethng with a Film maker this would go a long way to establish "credibility", so I guess this is at least one more reason for this apparent Suicide mission.

    You can't tell me that IBM plans to give the savings back to the employees.

    What the employees does not get falls throught to the shareholders or into added investments.

    These might have different Multiplier effects so the impact on the economy can be up / down or sideways. , but the blanket statement you made is not correct.

    At least not correct in principel.

    There may be a caveat to your assessment. That is if IBM manages to pierce the corporate shiled of SCO and hit Canopy. This is why the are requesting documents from Canaopy, Deutche Bank etc during discovery.
