Totally, it's much easier said than done IMOH. I can't imagine how you'd change things that would be better. In the end someone is going to be typing in some text to go someplace and more than someone is going to want to be the destination. Heck we've already seen lawsuits over search engine results (granted most of them have been stupid). When someone types in Car people are going to want to be the destination for that rather than SuperDuperCar, and yet someone else might have Car Trademarked (well they won't have exactly "car" trademarked but it's hypothetical).

I hear ya on IPv6. I've actually spoken with a few places using it in production environments, but even they're treated somewhat experimental, but that's OT.

This might be a stupid couple questions (moderate accordingly:-)):
Lets say that any TLDs would have to protect trademarks as proposed. So is there a great big Trademark database out there to be consulted (and can I find it on the web)?
I'm reminded of an old article in an MS TechNet CD (not sure if it's still on there) that actually had a list of all the computer related Trademarks and who owned them. It was always fun to browse through and see what people trademarked.
If there is then is it just a national dB or does it cover international Trademarks?
What if some international Trademarks conflict?
Would the rules protecting Trademarks protect "current" Trademarks, or could domains with those new TLDs get kicked out by someone claiming the domain after Trademarking something?

  7. More bad than good? on Care to Register Your Own TLD? · · Score: 2

The article seems to indicate that the creation of such TLDs would "facilitate free speech and criticism and enable consumers, workers and others to organize." First of all I'm not taking this very seriously, secondly even if it were to be done I'd have some concerns.
They don't seem to be planning to enforce that legitimate orgs are the ones buying domains with these TLDs, nor do I feel that they should. However I'm reminded of a news story I read a few years ago about how some large industrial companies had created funded small non profit organizations with names like "The Green Planet Alliance." Now this organization was actually chartered to work to reduce pollution and such noble ideas, however, since they were controlled by these other companies they mostly did lobbying for laws that favored the companies that had created them. These laws in most people's views either did not assist in reducing pollution or in fact left massive loopholes for the companies to pollute more. Sadly a few consumers got burned by this when the non profit organization actually started fund raising and they thought they were giving money to a legitimate organization.
I worry that such TLDs make it more likely that people wishing to participate in such organizations may simply go to techworker.union join up and pay their dues. Then only later that the company they work for is actually running that organization.

I remember studying previous beliefs in history about physics or any science for that matter, and I always wonder if our current theories won't be pointed out as just as lame as past ones are now. Some companies actually have deals similar to that with their providers (both telco and isp). It however isn't usually so much a question of getting money back for not using it, it's more of a "pay for what you use" type of deal. So if a company doesn't use much at night (for example), they don't get charged for it. ATM *cringe* is a popular back bone where such policies can be adapted.

I agree. It depends on the schools.

Personally I've got no problems with students setting up a very popular (non commercial) website and such, I could see that as constructive and I wouldn't mind my $ going toward that and all. Regarding web browsing and some apps I don't mind either (a little porn here or there never hurt anyone).

However I'm sure there are groups students who's systems running Napster or any such software that their bandwidth usage is starts costing the University either in direct bandwidth usage costs or upgrades to accommodate such usage. In such cases I think the students should have an option at the very least where they can purchase their own connection. I know of one school (private in this case) that has the option for the students to purchase DSL service (from telco, not the U).

That would be interesting if it could be put up for a vote and be done (the first I've heard of such a move by a company). I remember some companies have taken similar action in the past due to another companies poor environmental practices, or involvement with countries with human rights violations (i.e. South Africa).
It is a pretty tough sell to shareholders when it comes to the one click patent. Sadly, unlike the one click patent the companies had some risk of boycott themselves due to their dealings with other companies with other violations. Also explaining why environmental damage and human rights violations are bad is a pretty simple task to explain to shareholders compared to the one click patent.
Most of them I'm sure are not aware of the patent issue (and I'm sure some who are wish they would have thought of it). Saying "Lets not ship to a big name (granted money losing) company so we can gain respect" is a hard sell to make. Granted you wouldn't say it that way but I think that's how your large share holders may hear it. It would be nice if they would go for it, but it could backfire and get ugly. Even just the attempt might rattle shareholders enough to lose their confidence in whomever proposes the idea or the entire company.

We have sent a copy of the Apple Cease and Desist letter on to the theme authors, and told Apple to resolve its allegations with those individuals directly. In the meantime, VA felt that the presence of Apple's logo in the theme justified pulling the themes, pending a resolution."

I would have to agree that the rivalry actually comes from their similarities (like all good rivalries it would seem). It's weird how I would think that such OSS tools while being OSS in nature would promote diversity, and mostly I believe they really have. OSS has always seemed something that is intended to (among other things) bring us new options and choices where there really were none before. However without fail being similar causes some infighting between fans of either side that resembles a fight for dominance over the other (thus eliminating an option). I wonder if that says something about humanity and it's relationship with OSS.
