    It depends what is meant by first computer. First computer I actually used was an IBM 1130 - with REAL core memory :) First computer that was mine, was a Kaypro, a metal luggable, ala Osborne, but imho better.

    Actually, while not a precedent I can certainly see Canadian Courts looking at this decision, and not only because the decision is in French, one of our official languages. The fact that they considered copying the files into a shared folder as private copying has repercussions as the Canadian Copyright Act has provisions for private copying. In the only case where this was looked at, a Federal Court Judge found that the act of sharing was not "distribution" which is specifically not allowed under the private copying sections of the Act. While the Federal Court of Appeal overturned portions ofthis ruling, they did not address the issue. So this may have a very nice Canadian outcome - particularly if we fight against the changes that were proposed in Bill C-60 under the previous government, to amend the Copyright Act.

    I'm wondering if ReactOS couldn't send a letter to Microsoft and simply say:

    "There is the possibility that our code in the following areas *list areas* contains fragments of MS code. We would kindly request that MS advise us as to any issues with respect to this code. If we haven't heard otherwise within 6 months, we will presume that there is no MS code that has been used."

    IANAL, but perhaps the law of estoppel would then apply?

    Okay, now my initial knee jerk reaction is that Google shouldn't be censoring. But then I read that Google WILL NOTIFY USERS THAT THE DOCUMENT IS CENSORED.

    Its one thing where censorship is hidden, but its quite another when millions of Chinese will begin to realize how much information is being hidden from them.

    This is a good thing, and certainly not evil.

    Actually .. I based it off of the Spy-bot website, not just Slashdot. We've used Spybot for a while on our computers, I happen to like it, and it happens to work well. So why wouldn't I believe the Spy-bot website, who I highly doubt have any reason to unnecessarily pick a fight with Symantec?!

    (I'd do this myself, but this doesn't work nearly as effectively in Canada, I'm afraid)

    Uhmm ... I can't resist ....

    Maybe because many of us feel the present US government is a dictator or despot, when it comes to its relationships with the rest of the world?

    I realize that as a US citizen, you don't see your relationship with the government that way, but the US hasn't hesitated to alieniate, use force, coerce and violate international law in the last 4 years.

    So, you see, our choices boil down to:

    1) a single US despot; or

    2) innumerable despots with some democracies thrown in, all of who have different agendas.

    Its no surprise that those outside the US are inclined to choose #2.

    Great - I guess I'd say that executives are more likely to be convicted monopolists.

    Lets get real - the younger the generation, the more likely they are to be downloading music. The younger the generation, the more likely they are to experiment with shoplifting, drugs, or many other foolish things. The two factors are not causal.

    The CRIA are the same asses who lost in the Federal Court and the Federal Court of Appeals - and their case was less than pathetic.

    For the record - it is absolutely legal to download music in Canada. (There only dispute as to whether leaving music available for downloading by others consititues distribution - which could be in violation of the Copyright Act, but this has yet to be litigated, and the obiter dicta comments of the Federal Court judge would indicate that even this is legal)

    To all my US friends (and enemies if I have any) - RTFA!!!

    This isn't about patents, so much as it is about how the executive branch of the US government (nope - not just Bush) can and does abuse its powers. Its used to allow kidnappings, extortion, and yes, the rip off of legitimate patent holders.

    There is no oversight that conforms to the principles of natural justice - and to think that the US dares to want to train foreign judges on patent/copyright. The US executive branch is unfortunately comprised of a bunch of unaccountable hypocrites, speaking about freedom and democracy publicly, but doing exactly the opposite behind closed doors.

    Each of you, if you truly believe in freedom and justice, should be writing to your members of the Senate and Congress. If you want a fair and just government - the type of government you thought the founding fathers had set out in the consitution, you should be reading the article, sitting down and making your thoughts known to those who can change this.

    Its not criminal - therefore there is no extradition.

    Its not a judgement by a Canadian court - so judgement isn't enforceable in Canada.

    If its not illegal in Canada - no judgement is issued.

    Your example isn't quite correct. Kazaa did have an office in Australia http://www.theregister.co.uk/2004/02/06/music_indu stry_raids_kazaas_australia/. As far as I know WinMS didn't have a personel or permanent establishment or assets in the US.

    Without any nexus to the US, a good lot a USjudgement would do. It won't be enforced by Canadian courts, and there are no US assets to collect on.

    Its strange that the RIAA would bother sending a letter to a Canadian company.

    Music is quite legal (until the government changes the law) to download in Canada. It is most likely legal to have it available for download too, provided that you are not "distributing", which seems to require active promotion.

    I would think software developers would be one step further removed from that. Good luck to the RIAA pressing their case in Canada under the current law. CRIA was already stupid enough to take it to the Federal Court http://www.cippic.ca/en/projects-cases/file-sharin g-lawsuits/ and lose.

    I don't know Line50, but I agree that SQL, the. For what its worth I had one hell of a hard time selling this into the organisation (Its free? It must not be any good? Why don't we just pay $25-50K and get a real solution?).

    Fortunately an accounting degree trumps open source ignorance - but there is a big gap to be overcome in accounting solutions from the open source world. Most seem geared to ISPs.

    While SQL Ledger worked for our particular needs, I acknoledge it has a long way to go for many parties - but its getting much better.

    I think I've tried every viable *nix accounting system out there, and the only one that cut it was SQL Ledger.

    That being said, we paid for some add-ons (realtively inexpensive) and we had to use the Beta version. The currently available version didn't cut it

    If you take a look at the http://www.sql-ledger.org/ website's "What's Ahead" list, you'll see a lot of 100% items that are in the beta and work well.

    We just updated our accounting system. While it may not fit all, I decided to go with SQL Ledger http://www.sql-ledger.org/.

    One of the primary reasons we went to SQL was the fact that it was open, and we could hook into our other corporate systems

    The added bonus is that we were able to have "reasonable" features added sooner, with a minimal amount of cash, and the developer is actually available.
