And they seem to follow along the same mantra "Google falis to 'indemnify' its partners" "Google is stealing others 'Intellectual Property' and using it in Android" "Google stole Android from Apple because the original Android shown on a device with a keyboard." etc. Its a familiar pattern of noise regurgitated from the usual echo chamber of paid shills. You totally miss the point. Microsoft and Apple are not suing Google. They are suing everyone that produces an Android device except Google. And Microsoft itself is suing anyone that produces a successful device with ANY Linux operating system on it. See TomTom and Buffalo. If Google co-owed the patents with Microsoft and Apple it would not stop Microsoft and Apple from going after Android phone manufacturers only Google. Microsoft and Apple would then be able to use those patents co-owned by Google to continue their litigation campaign against manufacturers such as Samsung, HTC, and others. Google would have paid a lot of money for patents that they could not use to defend their partners. Parroting the statement from Microsoft without employing critical thinking skills is silly to say the least.

This argument that Google stole Android from Apple is getting ridiculous. The link you show was Android running on only ONE of the form factors it was designed to run on and you can still get that form factor today.
The patent system was designed to encourage innovation not stop others from entering the marketplace. Just because others abused the system in an attempt to stop Apple from entering the marketplace does not mean that it is OK for Apple to abuse the system in order to stop Google from entering the marketplace. Your insinuation that patents are to abused to keep competitors out of the market is anti-competitive. See. US antitrust laws
You have to install it from an untrusted source. If you go to an android phone Application->Settings and manually enable "Allow the installation of apps from untrusted sources" Then add the untrusted source that hosts malware then you will be able to install it. In other words you have to go out of your way to get infected. You know... leave the garden of Google Marketplace. Most people that choose to exercise that choice (Which Dear Leader Steve does not allow on your iPhone) will know to be careful when adding Chinese malware sources to their Android.

In the United States Of America you do not have to Jailbreak your phone in order for it to show up as an access point so that it can be tethered. I have a Dell streak and my phone is not rooted/jailbroken and I can tether with up to 8 devices at the same time.
I can install alternatives to the applications that the vendor has installed. I am not told by the phone vendor that apps that compete with them are "duplicate functionality" and therefore I don't need those apps.
All the things you want your phone to do is not all the things everyone wants their phone to do. Some people like to tether without having to pay a stupid fee for something that has been basic since feature phones.
