Actually the AC has a fair point, unintentionally probably.
HP produces some hardware that can technically run OSX, unfortunately running OSX legally on HP hardware isn't really going to be an option till Apple say so.
Feel free to speculate as to if and when that might happen and if this would be a good thing for Apple and users of OSX.
I guess it might be possible if it was branded as Apple generic OSX a product clearly inferior to genuine OSX running on Apple hardware... It's the little differences that matter I guess.
It's an interesting case and the outcome may be significant in that it should clarify whats legal and whats not, unfortunately there are two connected incidents and the second one is likely to over shadow the first.
The guy wasn't arrested because of the first incident but because of the second. If the guy hadn't got his driving license then obviously he wouldnt be restricting the officers investigation.
As he said he called the police, it seems reasonable for the officer to ask for some form of id. Offering an alternative to a driving license would have been reasonable and wouldn't have been obstructing the officer. However it appears he didn't do that and thats what ruins the case.
Cooperating with the Police officers investigation of the incident was the way to go, if he had then it would be circuit city in trouble not him.
The local law varies greatly around the world, in ireland the stores actions are clearly illegal. In other parts of the world perfectly legal.
In Ireland your assumed to be a Law abiding character and bringing your reputation into disrepute is the issue and so a security guard detaining anyone without them having committed any crime, looking suspect isn't a crime, is in big trouble.
In Poland the normal course of action is for bags to be checked into a cloakroom and after going through the checkouts you then get your receipt checked against the items you bought, this isn't universal but common practice in large supermarkets.
Thinking about this it seems that it's not being asked to show your receipt that is an issue but being singled out to show your receipt. If the store treats all customers the same your not being singled out. However once the customer refuses to subject themselves to this treatment any further action by the store would appear to be beyond normal treatment and would be a potential false accusation.
Any reasonable person wouldn't see a line of people getting receipts checked as a line of shop lifters but would assume someone being stopped by a security guard as a thief that had just got caught.
A reasonable course of action might be when asked to see your receipt, reply I haven't stolen anything and I am not legally required to show you my receipt my time is valuable and I do not wish to waste it here in this store please excuse me and let me continue on my way. Preferably loud enough for witnesses to hear.
At which point the Security Guard should either stand aside or detain you and if he detains you and you haven't stolen anything then its big bucks for you and probably the sack for him.
Even if the store has a policy document on the entrance, you might not have read it or understood it, so if it is pointed out to you, you should then say i never agreed to buy goods under those conditions please refund my money at once since I do not agree to those terms and conditions.
Refund or not you have now been accused of being a liar, dishonest and a likely thief providing these are false accusations, you should have a reasonably smooth ride in court, however it would be prudent not to discover your legal rights until after the incident
If your intention was to provoke the situation for the purposes of a financial payout, rather than to continue on your way, the courts will not be sympathetic to your plight and hardly likely to compensate you for your discomfort and loss of reputation.
I am not a Lawyer in this country or yours, your rights may vary.
As far as the "all the rights" argument, it doesn't fly. Since you must make a choice between licenses, as soon as you choose the GPL, you give up the rights to BSD, so you have no BSD rights which must be passed on. I think your correct that there is no obligation to maintain BSD code rights, however there is a choice to be made.
The principle behind the GPL is no author gets locked out of their own code and changes made to it. By not maintaining BSD rights your doing that to the authors of the BSD Code. However by maintaining the BSD rights your allowing yourself to be locked out of changes to your code.
So which principle will you go for? Sharing the common code under both licenses seems to be the principled stance for the GPL using author, choosing to give up some of your own rights seems to be a lesser evil than taking away someone elses rights for modifications to BSD originating code. At the same time your not obligated to make the bulk of the code which has been GPL only dual licensed, it is most likely impossible anyway.
Finally it comes down to the choice of the GPL using author who extends BSD code who needs to examine the implications of dual licensing a piece of code, if it seems harmless then it is probably a good choice to dual license if it seems like its giving too much away then don't.
I remember something worse,
some guy set up not one but two auto replys on a college mail server, unfortunately he was on a mailing list his auto reply sent two emails to the listserve who faithfully mailed these replys to everyone on the list including him 2 4 8 16 32.. it didnt take long till 1000's of emails were flying back and forth. combined with it being a weekend there was no official way to stop it. The only method available was to fake an email request to majordomo from this idiot to unsubscribe from the list. luckily all it took was faking the from field. luckily it worked and the flood stopped after a couple of hours. Back then emails were individual text files making it easy to fake an email from bill.clinton@whitehouse.gov:)
Excellent I just followed your links and I found them very informative. Evans highlight and click both mouse buttons i didn't know that and bash likes it too, i always had to use right click and paste from the menu till now thank you for posting.
before you increase allofmp3's prices remember allofmp3's pricing isn't specifically set up for the American consumer.
There is a vast difference between what is a reasonable price for a typical American and what is a reasonable price for a typical Russian.
when you buy at allofmp3 your buying in a russian market place.
Normally Governments restrains international trade by applying import duties, perhaps that will happen eventually, sooner if this becomes a significant trade. Looking at the situation with the usa and off shore gambling, and the WTO not accepting it as being morally objectionable, I wouldn't be surprised if this option is being investigated right now.
Would the American voter stand for this or would it be political suicide?
being good enough to download doesn't mean good enough to use / listen too. music is a very subjective thing, even your favorite band has released some real stinkers, should you buy everything they put out even if you don't like it?
If an album has 10 tracks perhaps 1 or 2 you will hear on the radio, so when you buy an album there is a good chance the first time you hear the other 8 tracks is after you bought it. Not since stairway to heaven has there been a track on an album which was better than the single releases that came from it.
I imagine there are a fair number of programs you have downloaded and decided they were not good enough or there was some stupid restriction that made them unusable.
sure you downloaded them, but that doesn't mean you are using them or even still have them.
It is a very real problem that when it comes to buying anything, it is usually extremely difficult to return things that do not meet your requirements or expectations. There is an awful lot of try before you buy P2P going on.
Personally I'd rather use something that is free as in Linux rather than something which is obsessed with trying to restrict my use of whatever. Why suffer the bad Karma of ripping something off when you feel the glow of good karma using something which is free and perhaps even contributing something back (such as a howto).
Would you consider it immoral making someone buy the OS twice for the same computer, once when it was new and again a few months down the line when it is borked and not even a restore disk was supplied with the PC?
This might sound a little strange but the problem isn't HD or Blueray it's getting people into watching HD Content.
There are two methods free or near free broadcasts in HD still not common enough if at all.
or there is the pirated content method.
I am thinking a HD DivX file squashed to fit into a recordable DVD or Two playable on any PC with fairly standard hardware.
This would get hd content into the home on to the PC screen at first, on to the TV Screen (got to buy a HD TV to get the best picture) Then adding a HD-DVD or Blueray player becomes an easy next step.
In actual fact probably the PS3 is the best hardware to buy. It is capable of playing a DVD and Blueray. If it can read a DVD disc it can play files from a DVD Disk and if its running Linux then its just down to having the right codecs in place. (assuming the PS3 has the cpu power available)
The implementation of this I leave as an exercise for the reader:)
You've heard of X factor, where they sift through 1000's of hopefuls to find a handful of talent. buy at the bottom and your on that panel at the first round, if your jim the musics got better a lot of bad music has already been eliminated, and mary she's popping up on finals night.
Traditionally in music you would pay for people to do this. It is a brilliant concept for the company to out source the research like this. Get your customer working for you and save:)
The nice thing about this scheme is it is harmless your doing what you enjoy, nobody loses really (that wouldn't lose anyway), and it allows unknown bands to demonstrate their talent.
It is a pyramid because they expand the organisation by recruiting their customers.
One thing you said that if mary buys you get 45 cents what if mary jane mike and bob all buy at that price do you get $1.80 ? See thats a pyramid recommend a song to 5 people that buy who also sell it to 5 people who do the same you get 5 + 25 + 125 =155 sales of that track and you just made what $60 roughly.
Being at the start of that chain is rewarding.Of course for the site its even more rewarding sure they pay out a good proportion of what that chain brings in (say they net $40) but there can be 1000's of chains call it a 1000 and thats $40,000 and if they are generous they give $20,000 to the band.
A lousy track will generate very little revenue say $10 and a proportion of that goes to the promoters (you ect) say a $1 between them they give the band $4.50 and keep the other $4.50. Now it will have cost the band to produce that track so you can assume $4.50 doesn't pay for the recording costs. The other track covered costs for that track but probably there are a number of tracks that fail to recoup the recording costs. So even a $20,000 win may still be a net loss for the band.
You see the house wins every time the only thing that changes is how big they win.
Why are you focusing on bandwidth, this isn't streaming media which needs to be delivered in real time just hefty sized files. They do not need to be downloaded in realtime, or for that matter at a particular time. A smart user would schedule the download to run at off peak times.
Cable providers such as Virgin Media can easily cope with increased demand within their network just use an additional frequency in the cable. Outside of Virgins network is another matter entirely.
The sensible thing will be for ISP's to cache shows using a transparent proxy for their customers. The big question is if fred and joe download a show are they getting an identical copy? if not then they have a problem.
The real problem is smaller ISP's buy capacity from the larger isp's and if their customers download more they pay more.
One thing I don't understand is why the BBC isn't making use of it's own DVB-T network (or DVB-S for that matter) DVB-T looks pretty much the same as the stream provided by my cable modem. so couldn't the actual content be delivered via DVB-T pretty much bypassing an ISP's Pipes?
are you planning on becoming part of the little pyramid scheme ?
reading the article it seems that if jason tells jim and mary about trackA then jason gets rewarded by credits for future tracks. by jim and mary buying trackA if they buy track B what does jason get?
jason is now a salesman but jim and mary can be too, of course now jason and jim and mary have an incentive not to give away copies, They instead refer other people to the site gaining credit towards the other songs they would like. Of course the guys at the top of the pyramid will rake in the most money and the massive sales team at the bottom will beaver away for peanuts.
It is an interesting scheme at the bottom of the music pile is a collection of largely elevator music with a few gems. That means a lot of sifting at the bottom it shouldn't take long for the better stuff to filter up and cost money. Can music prices go down as well as up?
The scheme does have some appeal as a bystander, there is a good chance we will get some very talented artists breaking through - providing of course the guys working hard at the bottom don't give up when their ears start bleeding from yet another low quality music track.
thank you for sacrificing your ears to bad music so others don't have to:)
To be honest as pyramid schemes go, this is one of the nicer ones, provided your not going out of your way to promote tracks and this website you shouldn't feel too exploited. It beats schemes like e-lottery which takes around £245 from a pool of 49 people each week to buy £88 worth of lottery tickets. I know someone who has approached over 100 people trying to get them to sign up without success (in the hope that 5 will and thus he plays the lottery for free (if he gets more he then takes a commission)).
I wouldn't like a steel door for one good reason, fire.
in the event of a fire it will probably save your life if the fire service can break in quickly and rescue you and your family who are probably unconscious from the smoke and fumes.
Fit a Steel Door and your chances are greatly reduced. An alarm on the other hand is going to attract attention when it is triggered and minimise the available time for a thief to grab anything of value. If someone really wants to get past your steel door, then they just need to get you to open it. You probably would prefer in hindsight not to have bothered with the steel door.
Life is more valuable than property isn't it?
I have CCTV watching over my car (google Zoneminder) which is connected to an ubuntu box its motion activated and doesn't rely on tape. The PC does other things such as mythtv so isn't really expensive to run. I don't expect that the CCTV will make it easy to identify any thief, what I do hope is that a thief will choose to go else where to an easier target and that is as much as anyone can do.
So saying there are a limited number of thieves operating in any area and generally well known to the police cctv images are generally good enough to identify someone you (or the Police) know.
you inspired me:) heres some possible methods that might be cost effective and not annoying.
The nicest and most useful way of doing Ads would be location and profile based. Ads relating to something your interested in wouldn't be too bad.
Imagine being say 500 yards away from a store and receiving an sms message telling you about a promotion on sd cards that day (assuming that is something you might buy). That might not be too annoying. (You'd really want to opt in for that thou) a phone beeping at you everytime you got near a store might be too much).
Or a proactive system where you searched for cafe's and an ad for Starbucks or a local equivilent came up with a 2 for 1 or luch time deal. with payment being less and less by cash you can see a basic charge of a few cents for an ad to be sent to you (paid by starbucks) and a follow up charge if you respond by buying something if you use your credit or debit card or perhaps a promotion code to get the deal.
This could be very good on slow days if in a couple of clicks you can put a one day promotion on that could draw in consumers. good for joe public and for a local business.
if google can be assured of an end commission fee you might be able to get free advertising and only pay google if it results in a sale.
Or a Local daily roundup of promotions near you, would you be tempted to shop at a different supermarket say walmart if you were informed items you like to buy were on promotion there that day or within the next couple of days.
walmart might find paying google $1 so you buy $100 worth of shopping with them a good return.
when you think of localised and personalised advertising like this you can see there is an untapped market for google, that could be excellent for local commerce and the consumer.
A short message to get you interested with a link to a wap site or similar advertising in this manner could be a desired feature.
When you think of it like this would you want advertising on your phone? would you want to give google more details of your life to make the service better for you? Ads timed to arrive when you want them.
Google Ads on your phone sounds like something that could be desirable especially if you have the ability to say stop when your not interested. The delivery system is in place with sms and wap enabled phones everywhere. If your not paying directly to view the ads as a consumer are you interested?
Rolls Royce is a status symbol, not a particularly great car but it represents money, success. There are plenty of better value alternatives if what you want is transport.
What does having a Mac say about you creative, successful in life perhaps. Pretty much the same selling points of the iPhone and iPod. Apple sell Kudos and a well engineered product.
Linux - Technically able, individual.
Windows - Sheep yet another worker drone. There is no kudos in running windows and perhaps thats one of the reasons some windows users rise to its defense so readily. Do people still obsess about CPU speed and GPU power of their windows box, while getting hit on a regular basis by malware of one form or another.
On the other hand there is some very capable software on windows and if its whats needed then you would be a fool not to use it.
perhaps it is answer c The creation of a massive database containing the movements of every car where this system is in place with no plans to delete records.
Are you really comfortable that your movements should be recorded in this way?
it is a great way to filter possible suspects in lets say a series of rapes at locations a b and c there will be a limited number of cars that will have been in area's a b and c but its unlikely to just be the rapist as one of the other suspects questioned, your innocence will be questioned long after the police decide you were not involved, will your wife believe you?
I'm interested in the DD-WRT firmware, but I have one question can it cap the bandwidth being used for certain IP blocks. I only have a small network but from time time i find its getting bogged down by over enthusiastic use of bit torrent. I really would like some fine grained control being able to reserve 50% of my bandwidth to my systems would be ideal.
investigate that address and there are a number of registered companies at that address, ok if it was a solicitors office not that unusual, however I couldn't find 1 which had filed accounts.
mythtv (more specifically mythweb), zoneminder, slimserver spring to mind as possible reasons to run your own web server,
being able to set mythtv to record any tv program for you, check your cctv camera's at home and access your music collection from anywhere in the world seems reason enough to run a webserver.
obviously you don't make these services available to the general public, but if the pc is going to be on anyway why not.
I would agree that if you want to run a public website then paying for hosting or using your isp provided webspace is far easier.
Thanks for mentioning the Nokia 770 currently it seems cheap at £99 at some places, seems to be quite capable with some design flaws. Have you seen the Nokia N800? this appears to be a significant improvement over the 770 more ram more flash ram two sd card slots. I was almost prepared to buy the 770 when I saw the N800 It gave me pause for thought.
I for one print occasionally and got fed up with the print heads clogging and not being replaceable and junking the printe,so now I have a nice samsung laser (which was very easy to setup under linux).
incidentally your non-Arrest will be on record until you attain the age of 100.
I doubt it will be made clear there was no evidence at all, just the implication there was no evidence to make a charge stick.
apparently there was a time when the data the Police held on you might be erased, however that was up to the discretion of the Chief of Police.
thats a Police site you might not want to click from home.
I don't know if this is information a judge might see whilst sentencing you for something else, certainly they see prior convictions before sentencing. Incidentally there is a really long appendix listing crimes in the UK and how they are catagorised.

It is not a choice between using Linux or Windows or OSX.
The real question is do you want a bigger range of tools to do the things you want to do?
By running Linux as well as Windows and OSX and Windows Mobile. I get the choice of what software to use for a particular task.
For some tasks Linux is superior in terms of what features are available Other tasks it may be better to use another OS
The cost of running Linux as an additional OS is minimal.
For a simple analogy if you have a screw to fasten use an appropriate screwdriver if its a nail use an appropriate hammer.
you inspired me :) heres some possible methods that might be cost effective and not annoying.
On the other hand there is some very capable software on windows and if its whats needed then you would be a fool not to use it.
none of the above,
perhaps it is answer c
The creation of a massive database containing the movements of every car where this system is in place with no plans to delete records.
Are you really comfortable that your movements should be recorded in this way?
it is a great way to filter possible suspects in lets say a series of rapes at locations a b and c there will be a limited number of cars that will have been in area's a b and c but its unlikely to just be the rapist as one of the other suspects questioned, your innocence will be questioned long after the police decide you were not involved, will your wife believe you?
solving more crime is good but at your expense?
I'm interested in the DD-WRT firmware, but I have one question can it cap the bandwidth being used for certain IP blocks. I only have a small network but from time time i find its getting bogged down by over enthusiastic use of bit torrent. I really would like some fine grained control being able to reserve 50% of my bandwidth to my systems would be ideal.
investigate that address and there are a number of registered companies at that address, ok if it was a solicitors office not that unusual, however I couldn't find 1 which had filed accounts.
it has to be a con
mythtv (more specifically mythweb), zoneminder, slimserver spring to mind as possible reasons to run your own web server,
being able to set mythtv to record any tv program for you, check your cctv camera's at home and access your music collection from anywhere in the world seems reason enough to run a webserver.
obviously you don't make these services available to the general public, but if the pc is going to be on anyway why not.
I was almost prepared to buy the 770 when I saw the N800 It gave me pause for thought.

no actually you have no rights here, information about your arrest will remain on file till you reach 100
d =19009319 a previous post of mine has links and extracts from the relevant legislation.

I for one print occasionally and got fed up with the print heads clogging and not being replaceable and junking the printe,so now I have a nice samsung laser (which was very easy to setup under linux).
incidentally your non-Arrest will be on record until you attain the age of 100.

I doubt it will be made clear there was no evidence at all, just the implication there was no evidence to make a charge stick.
apparently there was a time when the data the Police held on you might be erased, however that was up to the discretion of the Chief of Police.
http://www.acpo.police.uk/asp/policies/Data/Reten
thats a Police site you might not want to click from home.
I don't know if this is information a judge might see whilst sentencing you for something else, certainly they see prior convictions before sentencing.
Incidentally there is a really long appendix listing crimes in the UK and how they are catagorised.
