You know the sad part about all this is what is written tends to define the lawsuit. That is, the EULA specifically states the "rules" of their game. I have watched enough Judge shows at lunch (Judge Alex, Texas Justice, Judge Joe Brown...yeah yeah I don't get extended cable) to know that if you do have something written, you end up with the proof. If you don't, you are screwed.
Unfortunately for anti-spyware companies in this case, there was a specific clause that said essentially "you can't analyze our shit".
I'm no lawyer, but it sounds like the good guys are gonna get the short end of the deal in this situation because of a "technicality".
Perhaps bartenders should go this route and have their patrons sign a legal disclaimer everytime they get a drink. That way, just incase he/she get drunk, they are unable to sue the bar(tender) for damages when they drive their car into a field full of cows. Hey technically that would cover the farmer for suing for the cows too right?

I'm not going to go on because I do this rant mentally everyday and it gets me nowhere but frustrated. But like you said...If you aren't happy with the conditions and you know that's how it is, keep your eyes open for opportunties elsewhere. After all, you gotta look out for #1 (YOU).
And to these companies in Jersey that keep contacting me about jobs from Monster....I will not accept $37,000 to commute into NYC daily!!!!!!! Leave me alone. You are rediculous!
Do you all remember the story about the EA Sports programmer who was working the 70,80, and 90 hour weeks with endless promises? I don't remember the details exactly but he said he was getting paid really well but basically had to blow off the rest of his life and then they ended up screwing him in the long run. His wife filed a lawsuit and I think perhaps a class action was being spoken of by other employees that were scared to speak out.

This is sooooo true though in the IT field. I have tried to "fix" things at work and then had to actually fix them for the rest of the day. Nothing like making server changes and then spending 8 hours just to get it back to how it was before I ever even touched it.:)
And we are talking about countries here...not just a 50 some person manufacturing plant that makes a few people mad because they can't check the weather or get their CAD files from a file server.
Do NOT mess with a working routing/naming system. I saw the consequences of this with the Level 3/Cogent childlike fight a week or so ago. Our single homed connection + our bank's single homed connection = no wire transfers online...that's just a mild version of other country's problems to come if the EU is genious enough to cripple themselves.
Coincidentally this "Internet Fall Apart" time frame is the same as when Level 3 and Cogent are supposedly going to break up again.

Everybody wants to point the finger somewhere. The fact of the matter is, the link between Cogent and Level 3 was a major one. Many people took it for granted and didn't need an alternate route. Now they do.

This has got stuff screwed up pretty bad though. The mesh topology I thought that existed apparently does not. I'm assuming DNS is all whacked out too. My company belongs on the Cogent side of this and our bank happens to be on Level 3's side (in networking terms). So, we are unable to do any banking (hourly and daily wire transfers, etc). I assume if the bank was multihomed this wouldn't be a problem but it looks like there is only one way in for now.
The oddest part...I did a WHOIS at networksolutions.com for our banks website and it says they are 1.1.1.1??? Anybody seen that kind of behavior before?
