I agree with the premise of your argument that businesses need to negotiate with their suppliers, but the problem is that these rates are being set by the US Copyright Commission, a federal organization. The question is whether the RIAA will negotiate a separate agreement or stay with this one.
I think it will be interesting how ClearChannel is affected. Many of their stations stream their play list/drivel. I bet they do not even know how much this will cost them yet.

Consumer Reports is an invaluable resource and the purchasing agent should always do due diligence on the product or service. But, businesses and consumers must be made aware of the options that should be researched. That awareness is done through marketing whether it is done actively through a newsletter or passively through a web site.
Marketing makes capitalism better. Marketing educates consumers and businesses about their options. The more options that businesses and consumers are aware of, the better decisions that they can make. This can only be done when businesses are allowed to market their products and services.
When the spinach in California was found to have e.coli. People stopped buying it, restaurants stopped buying it, and supermarkets eventually stopped putting it on their shelves. The market took care of it. If spinach starts getting people sick, people adjust and stop buying it. Those are the incentives to improve using the example that you gave.
If they do this, I'm not going to buy Office 2007. I don't want my office "productivity" suite cluttered up with a lot of extra options on how to do things. I want Microsoft to tell me! Long live.doc, the one true format.
