    First of all, there are so many overlapping idea patents that it almost certainly has contemporaries. The adaptation of the patent system to cover "processes" has lead us to a quagmire that a corrupt government (such as ours) is paralyzed to strike down. The only way we will see an end to the idea of idea ownership is when it hurts the big dogs. Then.... things will change. I see it starting to crumble now, let's hope this oppressive, startup crushing culture of "more IP better" comes to an abrupt halt soon.

    Pffffft, The bill is so watered down it does nothing good and a some bad. Reform was going to include patent validity in trial, this would have helped flush the crud out of the system... but our overlords couldn't decide if that was good for them or not, so it fall away.

    Ellison is out of his fu*king mind if he thinks the community wont build a better JVM. Obviously, Ellison is in control of his faculties, he's quite shrewd and I suspect, he intends to use the idea patents acquired with SUNW to sue anyone that makes the Open JVM competitive with their premium offering.

    I just bought a Dell, specifily because I could customize it. I needed a high end video card on a 15' platform and suspect most computer professionals have specific hardware requirements. Without the option to build the system ( which all ready has pretty limited customization options and 80% is up sell pitching anyway ) they would be removing something that gives them an advantage in a crowded commodity market. On the other hand, it creates opportunity for new manufacturers

    yeah , whats interesting about this though is how Canada really strives to maintain its individuality. Yet, we say enforce our ridiculous Idea Patents (IP) , they say no problem . We ask for their sons as a part of the "coalition of the willing" they send them to a war that has nothing to do with them. We say enforce our ridiculous drug policy's, they say how high :)

    well, its not like they are pushing for a review of their patents :) but in general, a patent troll with poorly defined broad based or obvious IP will lye in wait till a larger corporation infringes, then drop some a million trillion dollar law suit and hope for a settlement. They don't generally sue the little guy as he generally cant pay up, and the lawyers work on collected winnings (usually in the small IP holding cases).

    Your right and wrong, Publishing the Idea is only effective if it were say accompanied by some media, such as OSS or even specific drawings (still considered publishing) not just some random collection of words yada yada . If you publish source, any methodology's you use in that source, become protected by Prior art. consider the following case "In analyzing an existing patent or in deciding whether to file a patent application for an invention, it is almost always necessary to consider the "prior art." Prior art may be defined very broadly as the entire body of knowledge from the beginning of time to the present. For example, in a U.S. Supreme Court case more than 50 years ago, the work of Benvenuto Cellini, the noted Italian artist who died in 1571, was cited in the judicial opinion as part of the prior art, invalidating a patent for the lost-wax casting of jewelry. That case was an extreme one, however, and does not give a fair indication of how prior art is considered." there are countless examples of a prior art defense being used in vague patent infringement cases without anything other than highly detailed specifications, drowings and in some cases abstract source code, illustrating proof of concept having been published.

    I Spend a lot of time studying IP patents and overturn. Most of these Idea patents are literally obvious or old. But that being said; if my company were to be sued by a holder, there is not a chance in hell we could ever settle, or afford a defense. Whats more is that 90% could be overturned but that too takes millions and just about every owner of any website is infringing on countless IP patents. a Prior art example is a common way to halt litigation almost instantly in a scenario where you find yourself being attacked by some outrageous broad or obvious patent. The patents they presently hold are crapola. and they know, you cant patent "email on a wireless device" without halting the entire world... ultimately it will do nothing more than to slow innovation and disable innovation and make lawyers a lot of money.

    Publish every Idea you get on the internet. if everyone did that. the foundation for Idea patents would erode even further.

    yeah its Google employees that read this ... if you made 12 mill in stock for coding a a page scraper you would be in on the cover up also :) wait till the men in black show up at my door :) I already have the Pentium disco guys after me and I'm pretty sure I saw the blue man group in my drive way last week...so this is about par for the course..
