I dont get it. The article has appeared on The Inquirer, but/. says it appeared on The Register. I thought this was/.'s error, but the only post that points this out has been modded as funny. What am I missing here?
First of all the article's title is misleading. It makes you think that in a recent event a non-infringing use is actually being requested in the court. Second of all the article should be submitted to ask-/. not yro.

Who modded parent as funny? (No, this post is not off-topic. Mods need to get some fucking brains and until then SOMEONE has to make posts like this.)
Now this is how it is supposed to be done. Make them pay monetarily. If you send them to jail they'll just come out after a few years and enjoy their money. (They'll even enjoy getting ass-raped)
Many of us have been waiting for something like this, but its almost certain that no major record label will agree to this. This might be a good thing for indie artists and upcoming artists.
If you can access the audio 'unprotectedly' on a audio cd player, then you definitely can access the audio data 'unprotectedly' on a computer, unless there is some hardware 'protection'. If it does the hardware to enforce DRM (like differences between cd players and computer cd drives) then it will definitely give compatibility problems. Another thing to note is that, it can be easily circumvented through device drivers. You just need to create your own device drive for your pseudo-soundcard which will just feed the data to your encoder/storer/whatever and make that device default. In fact this can be used against any audio DRM, although it may result in a (unrecognisably small) loss in quality in lossy-compression based audio(like mp3).
I'm sick of people saying bundling the program would have been wrong too. You can't compare it to IE or Windows Media Player. A browser and a multimedia player are extra to an OS. But not getting fucked up every 5 seconds is definitely in the mandate of an OS. Regardless of whether they are doing it in the form of making the OS itself secure or providing security tools, it is, in fact, their duty to make sure that we don't get incredibly fucked up.
First of all parent is right. And no, it has nothing to do with cache. Second of all, if this is 'off-topic' here, then where the fuck is it on-topic? This is not a fucking forum, you know. He has to post it somewhere!
This is not the only post wrongfully modded off topic on this particular story. Take a look at these:

... hollywood thinks gamers are the frat-boy, rap loving, dew drinking jocks that play the following games: Tony Hawk, Madden, and GTA.
And they're right. That's what most people who play games are like. Of course, few people, like some gamers on slashdot, might like a game for its true qualities but they form a small minority. The majority are just idiots who buy into all the "XREME!!!" crap created by the media and buy the same game year after year. And the award show was targetted at them. And slashdotters: Please don't start saying how oscar is not like this game awards. You are no fucking expert on movies. I'm sure someone who has went to acting school or directed a film will be able to tell you how the oscar awards are full of shit. In fact, if you use your grey matter, you don't even need an expert on movies to tell you how the oscar awards are full of shit. Of course, I don't even need to say how the gaming industry is not as mature as the movie industry and how gaming and movies completely different - at least when it comes to awards.
The parent post has a valid point. Who modded it funny? Did the mods really think that the idea of games being not as serious as movies was so absurd that anyone saying that had to be sarcastic?
Slashdot is either modded by monkeys or media-stereotype-nerds who have no life, fantasise about games and speak klingon. I really hope it's the former.
Let's say I wrote a new program to copy files from one destination to another and someone used it to copy a bunch of MP3's and movies, I guess the RIAA/MPAA can knock down my door and come get me.
They can, but they won't. Because they have more important stuff to do. They'll only try to stop things that are actually 'hurting' them. *AA aren't mindless zombies sitting around all day with a badger waiting to make a programmer's life a living hell. Fighting a programmer/user/ordinary-person is only a means for an end - not an end in itself for them. And don't worry - they won't make your ipod illegal - unless there is some really piracy going on because of it. In fact, all the time I hear people crying foul because *AA are fighting against something that can be used for legitimate purposes but is used almost exclusively for piracy. People don't want to look like pirates but they want their free movies/porn/mp3/warez. Why doesn't anyone grow some balls and tell them the truth - that they dont want to pay. Before you start modding me down read my post again - its not trolling or a flamebait. If you think it is then get a fucking dictionary. Just because a post has something that you don't agree with or it uses strong words doesn't mean its trolling or a flamebait.
Hello World doesn't (usually) check for return values. That's technically a bug. (Just nit-picking here) As for the rest of your comment, I agree. They should compare a minimal Linux installation (with X) to Windows XP. I'm sure they'll find a LOT of bugs in 'Linux' (although not necessarily security holes or disastrous bugs) with many of them in X or X related apps. I always have many problems with X and X apps. Not big ones - small ones like not remembering some configuration it was supposed to remember or some messed up text and stuff like that. Also a few big bugs (still not security holes). When people talk about the merits of Linux they include everything from Apache to the GNU tools. But when it comes to things like this they just take the literal meaning of 'Linux'.
A part of the Linux kernel's small bug rate can be attributed to the fact that when a newbie geek/hacker starts using Linux and he wants to be a part of the OSS developer community it's highly likely that he will just become a kernel hacker because of the popularity of Linux and the word 'Linux'.
I mean the ISPs. The poster said that major ISPs like msn et al did it. But I'm not sure what it was he said. Maybe something completely umimportant. It just looked interesting.
Someone on/. once made comment that these spam actually oroginate from US but ISPs make them "look like the spam is coming from another country" and went on to give some 'ununderstandable' explanation. I asked for an explanation as to what he means exactly and how its done but got no answer. (I can't seem to find the link to that comment)
OMG! How is parent funny?!? Is this some bizzare experiment by slashdot mods?

No, the site is not slashdotted. The story is still the first one on the front page of /. . This is the lowest form of karma-whoring I have seen.

Mod parent insightful. I said the same thing when I read the summary. I was damn serious.

Every rule has an exception. So you're (one of) the exception. Big deal.

mod parent as interesting.
Actually, I find parent to be quite funny.
Use your fucking brain. The grandparent post was refering to "find / > index". And what kind of an idiot modded the parent post as interesting?
