I really wish we had a little more of this in this increasingly irrational country. Simple judgement calls are being replaced by reactionism, nationalistic hyperbole, simple ignorance, fear, and political opportunism. Making a reasonable point these days is as likely to get you branded a terrorist sympathizer as a good citizen.

I was with you until that last sentence. I find it ironic that you would make such an exagerrated claim after making such a sober point.

And you can be sure that this niche of number crunchers is going to have full access to the Darwin source code, should it matter. Obviously under an NDA, but that's fine as long as they get to crunch their numbers. The number crunchers are usually only interested in hacking commercial products as a means to an end: number crunching. For their point of view, the xnu kernel is pedestrian.

You need to re-evaluate your understanding of science. Science proves nothing. Science is the process of creating models of natural (or even unnatural) phenomena, and empirically testing these models via experimentation. But no amount of experimentation will prove that a model is right. Experimentation can only show that a model is flawed, at which point a new model is proposed.

Even if the manuals are trade secrets, somebody[1] leaked them. They are now in the wild, and SA redistributed them. The only legal question here is whether SA exercised their right to fair use or not.
