  1. Note to EMI on MP3Tunes 'Safe Harbor' Court Challenge Approaching · · Score: 1

If we accept EMI's argument, then all of the online data backup services are also facilitating copyright infringement and should be shut down. Microsoft's latest buzzword is "the cloud", why haven't they filed an amicus brief?

And by the way, how the fuck can anyone object to an amicus brief? Wouldn't doing so just result in dozens of similar organization filing essentially the same brief? I assure you, EMI, we can file 'em faster than you can object to 'em!

Simply put, you should be able to write prescriptions for yourself, based on the principle that you have a right to put poisons into your own body. However, you should still have to pick them up at a pharmacy with proof of ID, so the pharmacy computer can check for adverse drug interactions and make sure you're not buying more than is suitable for a single person's consumption. However, they should probably also alert the DMV to put an automatic hold on your driver's license if you are receiving any sort of substance that impairs your driving. This is one of my biggest problems with the medical marijuana system in California... if your going to issue medical marijuana identification, have the DMV do it -- they are already set up to issue ID, and they really should suspend the driving privileges of anyone they know is going to be using marijuana on a daily basis. Want to drive? Turn in your medical marijuana card.

Don't let your sales people write your contracts. I've seen it happen when I used to work for Oracle -- a sales person would write a contract with custom features that would cost more to develop than the total revenue for the contract. The sales person would meet their numbers and take home a hefty commission and bonus, and the developers would then have to clean up the mess (and lose money in the process). Sounds like exactly what happened here -- somebody made promises they couldn't deliver on. I say fire the bastards and make sure they never work in the industry again.
