    Disclaimer: I said "order of magnitude".

    Rebuttal: Ok so not all cd's have seen the inside of a PC, but equally some cd's have seen the inside of more than one PC. Plus there is a good chance some of these infected CDs may have been pirated at least on a small scale. So its absolutely impossible to reliably determine the true number of infections, and whether the true number is greater than or less than the number of CDs that Sony mentioned. Hence original get out clause.

    I think this is a larger problem - that Sony can do what is clearly an unauthorised incursion into the core of someone's computer without being sued.
    2.1 million cds have been sold. So something of the order of magnitude of 2.1 million computers have been infected by this rogue code. Many viruses don't achieve this level of penetration!!!! I doubt the combined force of slashdot readers has achieved this level of penetration either! hehe

    If an individual had perpetrated this, whether or not he had the best intentions he would be arrested immediately. But Sony because it has such a strong brand, has only been sued in a few US states by a few Attourney Generals. Despite this being without any doubt prosecutable at the highest level.

    I hate to whinge on about this but why on earth are coporations less obliged to follow the law of the land than individuals!! Its a joke.

    The originality is in the performance - for example at what tempo is the piece conducted? how does the conductor play with the dynamics? etc.

    One performers wrong note could constitute originality!!

    Companies advertise on TV to sell more products. The more products they sell, the less they have to make per product due to economies of scale. I could argue that products being advertised on TV actually effectively lower prices overall.

    I take issue with this - if products are advertised on T.V. and that influences a purchase, as the consumer only has a limited wage this purchase is displacing other purchases that the consumer would have made that perhaps haven't been promoted as effectively.

    If some people conduct a conversation by shouting in a busy room, everybody else must shout louder in order to be heard.

    I would argue that paying to shout louder ultimately INCREASES the price of goods for the consumer as there is (theoretically at least) no upper bound on how loud one can shout. If every competitor is shouting at roughly the same volume to ensure that they are heard, the louder any one person shouts then the louder everybody else must shout; similarly the more any one individual spends on promotion, then the higher the cost of promotion for all competitors that wish to stay in the game.

    Simply, I will not accept that the costs of advertising are not passed onto the consumer. My beliefs reduce to the statement that money spent on advertising can only increase your standing relative to your competitors but will not generate new sales in any way.

    IMHO, the goodness of open source code comes more from people trying to port the code to other platorms than from the "millions of eyeballs" looking over the code.

    That's actually quite insightful. Its certainly going to be true for the Linux Kernel, if not for every app out there

    This makes no sense to me. Do you think the author was thinking of high vs low ports?

    they have not detected any form of frozen sea, they have merely found some peculiar formations that they hyopthesise may be blocks of ice covered in volcanic ash (which has prevented it subliming into the atmosphere). Another hypothesis is that these formations may have been caused by lava flows.

    but if you are saying the date to someone they are most interested in which day it is, perhaps which month it is and you almost certainly know what year it is. So it makes no sense to put the most important information at the end of the sentence. If we did that all the time we'd be German...

    An openoffice document does not record an instance of time, yet it is media. There is no specificity in time of an OO document and neither does it change over time.

    Yes there is the instant the document was saved/created but this applies to all media, even video clips but has nothing to do with the media itself ("How longs the DVD? 24th April 2004 10:56:13" makes no sense).

    And yes you are a pedant!
