Companies have come up with solutions that I use quite often. Ask your phone company about Selective Call Acceptance/Rejection. During family dinners or game nights I turn on Selective Call Acceptance and the only people that can reach me are the 4 that I've programmed into my phone system. I use it mostly for annoyance reasons because I just do not get crank called very often I think that happens to pizza delivery places more than residential phones. I think the main difference here is you also have to take into account that the person calling the other person a joke is doing it in a public forum and not just in a private phone call. This is one of those laws that just makes you check yourself before you say or post (in this case) something ignorant. I do not know of anyone serving actual jail time for crank calling a pepperoni pizza to their catholic neighbors on Lent so I can only assume it would be something you could use in court to add fuel to the fire or possibly get someone's wrist slapped.
Exactly it's JUST A GAME BOX and should not be something you can sue a company over. Admittedly Microsoft needs to step up and replace the defective units but as you said "It's JUST a GAME BOX!!!" and the guy should not get his panties in such a bunch over the game box. Is he going to claim dire stress and fits of anxiety over the box freezing up on him?
So instead of trying to exchange a defective unit or just never buy from that manufacturer again we should sue them? That's your solution to the age old issue of bottom line superceding quality?
By viewing this text you agree to break and no longer be bound by an EULA that you have clicked through just to test software to see if it was worth buying. You are freed from any EULA that you might accept in the future as you can "lie" and claim you read and accept the EULA. I also recommend in the future that you use your dog or cats paw to click accept on any and all EULAs so they are the only ones bound by such an agreement.
Yeah and then the ISPs could explain to the customer why they can't get online yet again. I'm tired of explaining to customers that the software pre-installed on their computer has expired and they need to contact for removal or purchase of the software. Not to mention the wonderful world of post-SP2 firewalls. Let's add more to my plate and have me be the one to have to accuse the customer of piracy.
The job of a judge and jury is to interpret the law as it's written and enforce the law if it is not irrational or cruel or unusual punishment. If it is considered by a judge cruel or unusual the law is overturned. This is why we have 3 branches of our government in the US.
Yeah and I'm going to blame standardized testing for this.
During the 3 conferences I've had with my oldest son's teachers this year their main focus of conversation was the testing they do and where he resides on some scale.
My issue with the present system is how much class time is spent entirely on passing a test instead of learning and retaining information. Look at all the paper MCSE's, A+'s, Network+ certified techs walking around. Yeah they know the information long enough to take the test but put them behind a computer or a router 2 weeks later and they can't figure out how to login!
We are fostering a generation that has the ability to pass a test. Not to mention that the test itself seems built to make the schools look good by judging them on material that should've been covered imho well before. If I had any doubts that my 3rd grade son would fail a test asking him to what 45 + 32 was or 7 * 3 I would be ashamed of myself and feel a failure as a parent for not ensuring my child a proper education. I constantly have to supplement what he learns in school because they do not have time to cover anything but what's going to be in the standardized testing.
This is a nice case of feed the monkey watch him sh!t. Outsourcing for cheaper rates _is_ training those we outsource to better themselves and eventually compete with us in international markets. Did anyone not see this coming?
Those blaming the open source community for all or any evils of the world are fools. A knife has multiple purposes just as computer software has many uses. You can shave your beard or kill a man. You can store a database on your cd collection or the number of people you've killed. It's the use of the product not the product itself that makes it evil.
Do you honestly think some corporate schmuck can sit behind a computer and stop windows from working?! If such a mechanism exists why hasn't some hacker found out how to do it and shut us all down?!
"Hey Bill, This is G.W. I need you to shut down every version of windows within the geographic location of China."
"Sure G.W. hold on a tick. Ok, you may commence in your search for WoMD."
Well let's see.. let's overcharge someone who's laziness exceeds their intellect and then require them to understand a security system?!
Their reasoning is quite sound. This is targetted at those who would rather plug and play than "set-up".. if you have to ask them for a password it will confuse them.
Ask a neighbor with high speed internet if their email account uses a password.. at least 3 in 10 do not think it does.
I'm sure this was also pushed back because the manufacturers of devices with cablecard technology still do not have all their ducks in a row. My local cableco supports and provides cablecards to customer's that would rather have them but the lack of 2-way communication certain niceties are ousted like the digital guide and pay per view(which is why I _enjoy_ the box in the first place). Our local cable company allowed customers to purchase their own HD converter boxes at local retailers and it was toppled because customers deemed the $350 price tag on the HD boxes outrageous so the cable company picked up the tab, ordered a slew of boxes and now leases them. Complaints about the use of set-top boxes need to be directed at the manufacturers of Televisions/VCRs and DVRs. They are the ones having most of the issues with compatibilty. Ask anyone with a Sony WEGA or a Mitsubishi TV how well their cableCARD works.. well it worked for a few days but now it's acting odd.
You are asking the people actually profitting from Linux to use their funds to step up in a court system that allows SCO to flourish on unbridled claims!?
Probably everyone has played a version of the lemonade stand game that teaches simple economic sense or for those more into other things the drug game w/ the same basis.
I'm not an economist or even a leader in the corporation I work for but that game taught me that people are willing to pay what they feel is a decent price for the product they receive and will not purchase any lemonade that is $5.00 a cup even on a 99degree farenheit day with no clouds in the sky. /em sends a copy of the lemonade stand game to MPAA, RIAA and now BPI.
I think this is a push to annoy the piss out windows customers so M$ can say.. oh well if you buy hardware with Paladium in it (or whatever incarnation it will go under later) you won't have to bother calling us.
For everyone that beleives ala carte pricing is a good ideas how we do this instead:
Any reality show - $5 per episode.. $2.50 for repeats
History Channel - $7 for hour long episodes.. $4.50 for 30 minutes
Espn - $3.00 per sports center/$25.00 per live sporting event.
Any freedom a customer is given will be a freedom that is exploited by the providers of the service.
Perhaps at some point TiVo could've decided to partner up with cable companies to provide TiVo's for their customers. I know TiVO did it w/ one of the satellite companies that's ditching them to run their own DVR's. Even if cable DVRs suck my present cable company can barely keep them in stock to meet the demand of new customers.
For new technology customer's trust their entertainment providers more than they do some unknown to them company. It would not matter to the majority of cable customers if they received a TiVO DVR or a Motorola DVR from their cable company.
Working against the companies that the customers have an inherent trust for is not how you are going to get your product out the door.
I think you have already made your choice but really it's play ball with the companies with a "lock" on their customers or stay independent and hope for a wave to come in.
