No, the problem is the *NO* system is the be-all-end-all economic system that's going to solve all our problems. Too many conservatives have spent the last few decades treating free market capitalism as some kind of Holy Grail that can turn everything it touches into a well-oiled perpetual machine. But free market capitalism is flawed just like any other system. And, like every other system, it has its strengths and weaknesses (and things it should and shouldn't be applied to).
Poor Republicans are having to face up to the brutal reality that their beloved "free market" doesn't always work so fucking well. They've been selling it for so long as the solution to every problem that they're way out of their element when it fails miserably.
The "loser has to pay your attorney's fees" only applies to civil rights lawsuits in the U.S. It might be a bit of a stretch to hope for this--and that's assuming you can withstand years of litigation to even get there.
Beta is just a cheap excuse for some companies to indemnify themselves against legal problems and customer complaints caused by glitches and lazy coding. It's a cop-out.
It doesn't have to hold up in court. Merely the threat of a lawsuit from the wealthy and powerful Apple will silence most small developers. Sure, you would probably win the case in the end, but only after paying lawyers a small fortune to defend you against Apple. And where are you going to get that kind of money if you're just some programmer or tiny company?
