    This is a very serious issue, not because there's any validity to what is being claimed here, but precisely because likely there isn't. BSD-style licenses are incredibly useful and provide a good, solid, simple alternative to the GPL. The common interpretation clearly matches the intended spirit of the license.

    FUD like this, and this is the first time I'm even using that acronym, is dangerous and puts the work of thousands of people at risk. This should be shouted down immediately, even if there is any shred of validity to it, which I doubt there is.

    Okay, I can maybe believe that they've got OS X running on there, but there's no way in hell you're getting emacs into that little box. Besides, does the multitouch even allow five simultaneous presses for the necessary modifier keys?

    How did the old "version 2 or later" cause a problem then? All this does is restrict people from applying GPLv3 terms if they want to. It doesn't help anyone.

    So, Time Magazine should stop putting its magazines on the shelf because otherwise they can't stop you from taking out your digital camera, making a copy of the cover, and using it on your web site as if the artwork were your own material?

    You're not getting it. Linking to a site is like pointing someone to a copy of Time Magazine, not committing copyright infringement.

    I fail to see the problem.

    While this is obvious, you don't need to be a jerk about it. People are not allowed to walk on your property because walking on someone's private property without their permission is illegal -- It isn't as if it is legal only until you say it isn't, which is the analogy you're making with regards to deep links. Besides, it is more like someone pointing at your yard than anything else.

    Simpler solution: Click the "use secure virtual memory" button in OS X. You can set up similar schemes for other operating systems as well with a bit of effort.

    Oh please, you paid what you thought was a fair price. Now you're upset because someone else gets a better one than you did, completely by chance? There's no reason to begrudge anyone because they got lucky or because the developers found a way to pick up some extra cash -- You got exactly what you paid for.

    Exactly.

    1. MacHeist makes a lot of money. They obviously win.
    2. The developers agreed to participate because they thought it was a good deal. They win too.
    3. Customers are buying this package like crazy. They also win.

    What's the problem exactly? Yes, it could be "more fair", but as it stands now, all participants are voluntary (in a true sense) which certainly makes it fair in my book.

    You'll need at least 35GB of free disk space, and preferably a very fast internet connection (you'll be pulling 27GB of data). You'll also need about 28GB of space on your mirror (which can be the same system). If you're smart with hardlinks you should be able to avoid some of the duplication. This should be run on a Ubuntu Dapper system without any updates (security or otherwise). Source repositories will need to be enabled.

    Is the FSF seriously backing a "distro" that's just Ubuntu with the logos and useful software taken out and calling it gNewSense (which sounds a /lot/ like gNuisance)? One that requires 35GB of HD space to create and install? Yes, this is a great way to get people to avoid Vista!

    I'm not trolling... It is seriously unfortunate that they do not make more realistic recommendations that people might actually consider.

    so it's the apps, stupid. how many buffer overflows do we find every day in C/C++ applications? lots. yet I dont hear many people slamming the language.

    Well, maybe you should be. C is a horrible language to use for writing an entire application with. Plenty of safe, higher-level languages with simple to use FFIs exist that are much better suited to such things.

    one Linux distro may boot to a full-blown KDE interface that some industrial designers pored over for months, adjusting this and that, getting all the twirly things working right and the desktop gems placed here and there where people can easily use them... Then theres another Linux distro that boots up and looks just like Windows XP.

    You have that a bit backwards with regards to KDE. :-)

    You're not a moron if you release code under a BSD license and complain about how it is being used by some entity. It is both logical and reasonable to release under a BSD license for certain reasons while also hoping for contributions back. You may not want to restrict everyone with the GPL, but at the same time, you might hope Company Foo that said they'd contribute back actually does it.
