Someone must pay for the 180Mb/s bandwidth, and the servers. There are clearly costs involved but I can't see how any of those costs get recovered.
I've often wondered the same thing with NZB indexes (the open ones), or other services that you can use freely without ad serving.
The post by 'Windowsisoldnews' quite clearly lists 'can download for free' in the 'pros' section right at the top of his review.
What makes you think they are sanitizing these?
If people cannot make money from their creative work, then they will find another job. Because if it's no longer possible to make a zillion bucks from their creative work, they are suddenly no longer keen to pursue their so called 'art'.
I know people who make very little money from their art but they continue creating it anyway. It sounds crazy but they claim to enjoy and be passionate about what they do in their spare time!

I still don't quite understand how 'illegal uses' is not considered 'criminal misconduct'. If something is not a criminal act then surely it is not an illegal use. Don't these logically go hand in hand?

I have no idea if patents are treated similar to copyright law but in my limited understanding, intellectual property owners have a responsibility to defend their rights when they know of infringing activity. If they neglect to defend their rights then they may end up forfeiting those rights.
For example this would prevent the scenario of someone deliberately holding off action so that the infringing activity increased before going to town with law suits.
In other words, you use them or lose them. And MS seems to be saying, we know patent infringment is occuring but they are not doing anything about it.

For backing up large amounts of data I agree. Now that 700GB SATA drives are available and 200-300GB drives are pretty inexpensive I'd recommend RAID-1 in your severs/desktops and USB attached drives for backing up.
The real benefit of optical storage is ease of transport and durability when you accidently drop it on the floor.
Now we've got "fair use" in Australia does that mean I can legally shift my Region locked DVDs to region free?
Sorry to nitpick but Australia does not have "fair use". The system being adopted is legally quite different from the US "Fair Use" in that there will only be very specific exceptions made for time shifting and format shifting etc.
