  1. My questions on What Questions Would You Ask An RIAA 'Expert'? · · Score: 1

    What is your IP address and can I have your computer now?
    Okay, okay, getting serious now.

    If the evidence he says he has (log files, screenshots and what-naught) are real (meaning he has them) how can you prove that those logs/evidence are real?

    If the Computer was behind a router (as he mentioned) how did you obtain a screenshot of the person's harddrive as the computer involved is said piracy, would have had no direct IP address for you to refernce it. No reference, no access to computer. No access to computer, no screen shot.

    No matter how good the logs, unless you have a copy of the TCP/IP packets that were involved in the piracy and am able to put them together on a computer to form the pirated song, you can't tell that that data that was transferred was the actual said MP3 and not the regular tcp/ip communication data that happens regularly on an Windows OS. So... Do you have a copy of said packets?

    just because verizion replied to the subpeona, doesn't mean a crime has been done. Why was this submitted as evidence that the defendant has done something?

    If I know of an IP address, even I can do a tracert command on it. And the trace command only stops reports as the IP of the internet (ip addres of the router), how can you prove that said trace logs are accurate and can connect the action (if any existed) are linked to his computer?

    And lastly, and seriously, what is your IP address and can I have your computer now? Because if I have just that, I can provide all the same evidence you provided, assuming, of course, you actually have them and have gotten them through legal means. (because there's no way via the TCP/IP protocol you could have accessed someone's computer directly and have gotten an image of the defendant's computer unless you have done one or all of the following: a) gotten physical access before b) somehow gotten the user to open a connection in which you had full, unrestrian access to the hard drive, usually done by tricking the defendant or installing rootkits/malware c)Some how gotten his username and password into his computer, aka more hacking.)

    All the evidence he's given so far, and even his statements, says he has no evidence to prove that his computer was the one that done the crime. If we can subpeona anyone because we think, grab what little we know about the person, and throw wild allegations around, then we can subpeona *anyone* (yes, that includes your son/daughter/spouse/friends. And hence we can subpeona you because you have a connection to them.) Hey, I think it's great that someone is asking for a broad opinion as well as asking for input from a tech community. Keep up the good work guys.

    Among all of us geeks here, there's got to be one or two physicists. Can someone do a measurement of how much force/energy it takes to break those straps? And then calculate how much energy/force/speed has be to be in the remote before the remote has enough energy break said strap. Now, here's the fun part. Assuming it "slipped" out of the user's hand, how fast would that arm have to move before there is enough energy (remember to take into account friction of a person's fingers and hands) invested into the remote to: A) break free from the static friction of a normal human hand and B) Break free of the remote's strap and C) Still be traveling fast enough to break windows and TV screens (assume CRT). I haven't done any measurements, but when you do a numerical measurement... it doesn't seem likely unless this didn't even really happen and someone did this on purpose for a lawsuit. Yes, I like the WII and plan to get one... but the physics... I mean... it just doesn't add up unless you purposely cut the rope and swung it real hard with an open fist.

    But that's like saying your car still runs off a internal combustion engine, therefore, it was made in the 1960's. My computer now is capable of running vista, but it's running 2k. I think the person before this was half joking and half making a point about MS's assumptions. Because, we all know how to spell 'assume'.

    I've been offered free windows XP licenses. I've thought about getting a free windows vista license (it's nice to have friends), but you know what? I just don't feel it's worth it. Right now, I have two computers sitting side by side. One needs to be turned off every couple of days or so or the performance suffers. That said machine also can do a total of 1 thing better (to my knowledge) than the other that machine also makes my life harder when I need to go change the security settings on. It also insists that everything .jpg or .bmp file I view should be in thumbnail mode rather than the lovely detail mode that actually tells me something useful about the file.

    What it really comes down to is that I like Windows 2000 and still prefer it to XP and Vista. I don't feel MS is in the wrong to not support and I understand the business decision not to support 2k, but it's not like they ever supported it much so I won't be missing it much. They'll still support xp because it's newer and (sarcasm) so much different from 2k os-wise(/sarcasm) than xp. And I'm looking into Linux as my next os because I don't feel that your OS should require 2 gigs of ram minimum just to run. Oh yeah, there's also the drm root-kit--erhm I mean, drm system put on vista for our protection (wink-wink, nudge-nudge). Because, after all, we only own something if some large media organization say we do.

    Yeah, I know this will be flamed at by someone using 1 or more of the 3 following points:
    1) You should just shut up!
    2) MS is right in what they're doing and they're always right. (insert ritualistic bowing to a bill gates statue here)
    3) You're a stupid windows user and you're stuck there because you're stupid.

    To which I'll reply with, by that argument so should you, yeah, they're right in not supporting it, I've already stated that and if FFXI can run on Linux, I'd have be there a long time ago.

    I'm sure someone's said this already and what-naught but. HAH! I knew it! And making personal copies for distribution still results in lose of potiential profits! After all, if why would someone want to buy their work if they can just steal it, right? Ha! Someone send these guys that RIAA lawsuit letter!!!

    You know, the fact is, if you've actually worked in the industry before, what they claim as pirating is done all the time at work because... there's no other way to work without so of this much dreaded "pirating".

    You're missing the point. The point that both belitting and critiquing can be taken as offensive, and therefore "justified reason for punishment". If you call the creators of a program assholes, he'll probably get upset and might seek action. If you said a creator of a program made the program badly and has thus introduced a serious flaw to his/her customers, he'll still get upset and might seek action. Look at Adobe... What's belittling and critiquing sometimes can be clearly defined. But there are those that will use that sometimes blurred definition to make sure no one can say anything criticial, whether it's belittling or now. Which is what we're seeing here. I once criticized a teacher for not teaching correctly the subject matter and feeding bad ideas into their heads. That was seen by faculty as belittling. You know what he was preaching to us? That all old things should be thrown out to be replaced by new things. (ideas, objects... people...) And the sad part is, I'm not paraphrasing.

    Not to belittle another member of the profession in public? That's never been a rule, nor will it ever be. If that were the case, people that work in the tech industry can't tell you what programs are good and what are dangerous. If this was the president, everyone here that's said to someone in public that gator was a bad product that did nothing but trick people and steal data from unwilling people, would be sued and/or punished. Freedom of speech means, in a way, freedom to say things and be punished for saying them. If that wasnt' the case, anyone can be punished for saying anything, even if what you were saying was the truth. Remember, anything you say can and will be offensive to someone.
    Well, as a final note, I'll take a crack at saying something offensive to prove my point. Those that support censorship are usually the ones that have something to be gained from being able to punish someone for tell the truth. Is that a fact? Is that an opinion? Is that a wild spectulation? Is that directed at anyone? You decide.

    What are you guys worried about? This is our big chance. Everyone! Start making webservers and start capturing personal info! With this, we can even get the info on sites visited, transactions done online and even how many hours they played solitare on their computer rather than working. We can even find out what the head of the RIAA is doing at online at any given time and steal his info like bank account numbers and personal password, not to mention knows where he and his family lives!!! The anti-christ is here, it is DRM and us geeks (the meek) shall rule the world!!!!

    Oh, if anyone didn't catch it. Yes, I was joking. This is a bad idea. If it was forced on us somehow (by some horrible freak of fate), it's nothing a router with a filter can't fix. Hi!     You're right, I was trying to be facetious I do realize that groups and coropoations have right, but not constitutional rights like an individual. I'm glad you brought up about the glided age. I haven't thought of that in ages and I think it's time I read up on it again and try to learn from it... Like other CEO's should...

    Call me crazy but could it be that they're not buying songs because they don't need to buy the same songs 3~4 times like they did before? Could it be they're just buying the new players but they don't *want* to buy new songs because there's nothing *to* buy? Is it just me or does the RIAA think that it's their constitiutional right to have people hand them money?

    Like many people pointed out, men in video games are rarely the balding, beer-gut guys as well. But I also want to point out that there probably more strong and intelligent female characters than strong intelligent male in video games. Let's compare two similar games.

    I do agree there needs to be more main/strong female characters like Orta (Panzer Dragon) or Lara Croft, but more male characters need to have brains too. ^^;
    With that being said, I say we make more characters with no gender in games . No dispute about gender if we have more games like this. :p

    AnimEigo did the *best* and I mean the *best* translation on Ah! Megamisama! (Ah! My Goddess!, for you english speakers) I've ever seen. I've read the japanese manga and gone back to rewatch their version of AMG and I can't find a thing wrong with it. Oh, when I mentioned a studio asked the japanese animation to give them the cells and negatives to remaster/redo macross? You guess it, it was AnimEigo. I've got a chance to talk with some of them at AX. The care less about profit (I don't even think they're an official company. Just a group of people that want to spread the anime love.) and more about quality stuff. That's not to say other companies did a bad job. Pioneer (now Genon) did a good job with MiniGoddess and the rerelease of AMG OAV, but AnimeEigo had a simplicity and a purity of the translations.
    K1: I can swim... about 10 meters... Megu: While sinking... Sorry, couldn't help myself. ^^; I'm a Fujishima Kousuke fan.

    Tokyopop isn't bad... I can't say they're the best, but they're better than Viz. And they're the first ones to do Right to Left books. They have managment issues, but they're trying. I can appreciate that.

    If that was the best they can do at the time, it would explain why the pirate copy that was floating around china *before* the ADV release has better quality.

    High profiled people? Well, I suppose maybe afterwards. But look at the the people they started with, hell, the reason why I make this complaint is because many of my friends where scouted by ADV to do voices despite the fact that they had *no background in voice acting what-so-ever*. Needless to say, they turned it down.

    Every company licnese new seires and releases it down the line... right... that's like saying that automobile companies sits on the electric and hybrid technology to build a back catalog and insure against something happening. New anime series comes out every season, not to mention the OAV's. Many of them would *want* to be released here. There isn't a need to create a back catalogue other than for the reason of waiting for a higher price on it if you're in good relations with that studio that releases it in Japan. (Which some companies are in better relations than others.) For those that sick of the politics, they do it themselves *points to FLCL releases, also by gainax, if I might add (the studio that did Neon Genesis Evangelion)* They made a special deal with a distrubtor who's base is in japan and does their own series. (Digi-charat among others)

    ADV doesn't have monopoly, but they very much have and anticompetitives practices. Namely sitting on series. I mean, come on. Why are they sitting on Rockman *japanese* holiday education oavs for? There's no chance that they'll make it here. Not only that, they're boring to watch unless you're showing it to elementary school kids who's learning about Japanese culture. They do massive hoarding (and ask around the fansubbers, they all know abotu this) on what's getting fansubbed, just to make sure there's nothing left for anyone else. Which, usually results in sitting on series and picking up a lot of bad, and I mean BAD series. They also mistranslating series (I'm trilingual. English, Chinese and Japanese, for heaven's sake, anybody that knows japanese knows that "sora mimi" doesn't mean fancy. It means imaginary. *reference to Azumanga Daiou* ) and ...well... not listening to the audience. They say they do, but at the panels that ADV's held at AX, all the questions, requests that were asked where heard, then promptly ignored. Pioneer/Genon panels, Broccli panel and some of the others actually listened and within half a year, our requests were fulfilled. Namely Yoko Ishida's single Sweets, were published, as per audience request, in romanji and english translation. (Although that was not my personal reference, that was what the crowd wanted).

    If you're reading some personal resentment, you bet there's some. I bought many of their DVD's and regretted it. And I've collect quite an amount of anime, which a good portion of are ADV stuff. *keep in mind, I'm asian, so I've been an anime fan since I was about 4 or so. That's back in the 80's.* But comparing ADV DVD's to all my other ones... ADV clearly has the worse quality. A good comparison would be to check the quality of Orphen (ADV) and Ranma OAV's (Viz) (Ranma was released before Orphen, mind you) and you'll CLEARLY see the quality was much better in Ranma (translation, voice acting and picture quality. I have another beef with Viz, but I can actually admit that they do some good stuff.).

    Just want to put my two cents in. Neon Genesis Evangelion DVD was nothign more than a bad VHS capture. Macross was done so badly, the another company asked the Japanese animation studio for the negatives... and they agreed. Voice actors are amateurs they pick off the street with no talent, pay nothing, then throw away. They do the same with anime. Pick every anime under the sun, if it makes no immediate profit via fad, they sit on it until someone wants it. Okay... I take it back, they're not like MS. They're like MS and the RIAA combined. They do charge an arm and a leg *still* for their products. I still hate them with a passion... with good reason.
    Of course, all the fanboys that have confronted me face to face that defend ADV are usually people that worked for ADV or people that have only seen 8 anime titles.

    You brought up a good point. Are all these blogs blogs that the chinese government moniter? Because I doubt a lot of those chinese offical will have a vast aptitude in english, nor will they *forum* tread (and this is a forum, not a blog) a techie news site that's beyond their control and most common people don't know about.

    I assume from your aptitude of the language, that you know something about the western culture. But freedom because the ruling party is *letting* you do something isn't real freedom, it's just turning a blind eye until they decide they don't like you. Which is why I posted that article. I listen to the BBC almost nightly here in the US and just about every other night there some report about the new things that are going on in China (almost to a point to where I'm sick of it). From the water cut off due to a polluting plant explosion, to the newest fads in china, and their views of video games, and their views about western cultures, and their cultural change from the 1970's, elder people's view on things like credit cards, social changes and attitudes about jobs. Maybe people china doesn't hear about these cultural and social reports because *gasp* they were censored/filtered in China?
    It's hard for a blind person to blame the sun for not being bright enough. ^^;

    I have to admit, I do find some of the interviewers at the BBC a bit too pushy for my taste. But they're just trying to get to the trust beyond the euphenism, beyond the denotations and I can appreciate that. If those bloggers can "really" post what they want. Have them post an entry on 1 of three things. 1) arguing for liberty and personal freedoms for citizens. 2) arguing for Taiwan independence. 3) arguing for uncensored internet in China. Then we'll really see how "free" he is to say whatever he wants... assuming he doesn't disappear before we get to see the posting.

    Oh yeah, BBC reports on censorship because a) it's everyday just like the weather b) it effects everyone in China c) because they're being censored from doing other news in China. :p

But don't worry, it's not spyware because we're out to change how you look at software." Then again, they might not. But the more I write stuff like this, and the more people read stuff like, the less likely they'll do something like this.

    Just wondering... does canada have that anti-reverse engineering law? I know it doesn't apply to government officials but... Doesn't SSH solve everything here? (let that be a lesson to all you kids. If you want to be a hacker or pirate DVD's for a living, be a law enforcement officier. You'll get away with it because you suspect they're breaking the law by encrypting the content. I mean... if you're not doing anything, you have nothing to hide, right?)

    Let's say Geothermic plants becomes very popular and start springing up around the world like pimples on a teenager (sorry to all you teenagers). Can a syphon of the earth's geothermic heat calm things like say volcanic activity in a region?

    I would agree if the each-to-his/her-own applies here. The point is (and I think it's evident by some of the passionate voices we've read here) us anime fans *do* give a damn when some company tries to bait and switch us (because us older anime fans remember when Anime was a taboo thing and how much effort we had to go through just to bring a little quality anime to our part of the US. We're not ones that'll let that go to easily.). I think what most people are slight to majorly upset about this is that this is another stab from the major media (in the US) to sell us something that really isn't. Let's pretend that you were given free tickets to a rolling stones rock concert (and thus, we pretend for a moment that you like the rolling stones.), and when you got there, you found out that when they said rock concert, they mean polka concert, and when they said rolling stones, meant an crappy indie band (as you put it) called passing stones. Now, if you were a rolling stones fan, you'd be pretty pissed. Just like some people here are anime fans, and someone is trying to sell them on this as real, authentic, japanese made manga instead of something calling it as it is, manga-style-like.

    But you know what? I suppose we can just let this slide. I mean, after all, the music industry does well by labeling something that it's not and/or putting out shotty content in place of quality ones. And the TV industry has done so well by putting on these survivor-type shows instead of shows with quality writing. I mean, one more can't hurt, right? Right?

    Well, it's hard to say where do you draw the line at what is manga what isn't. Manga is really just the japanese (and chinese) word for comics and isn't really confined to one style or another. But there are a certain type of styles that american artists, (including these two mentioned in this article) to a certain degree, haven't adopted/understand. I know a lot of those deviant art people will like to call themselves manga artists and will argue to the end of time that they are, but whether their comic is good or not is another matter altogether. To put things into perspective. I was reading ranma 1/2 while I was reading Batman:Knight's End and in my eyes, they're both just comics. The difference is really in the story line and how the artists perceives the world (i.e. how the shots are set up and the panels). But what a lot of younger readers have found is that the story lines of mangas (comics from japan) are, a lot of times, a lot more intriquiging, engaging and more emotional than say your x-men or spiderman where you find out, yet again, that the spiderman you thought was spiderman was yet another clone. And because, at that time, there was no comics outside japan that had that style (ragnarok comes to mind. Yes, the manga that Ragnarok Online was based on was korean. *gasp*), they've come to associate the manga style with the more engaging and better stories. Of course, this being America, a lot of people have tried to encroach on that space by putting out shotty story lines with manga-like art, hoping that people will read their stuff and associate their comic to the style that associates with good story lines. (Kevin Bacon, anyone?) So, in the end, it's all about the storyline, not the style. That's why I've stayed away from the American authors. Usually the authors that try to associate themselves with the style... that's all they have going for them. And for those artists that say Japanese artist can't draw... you should see the ground work and side work that a lot of these artists do. The infamous Hojo Tsukasa (surname, first name) who did Cat's Eye, City Hunter, F. Compo and Angel Heart, has a really great book out filled with his life drawings. I only wish I could draw that well. Oh yeah, my title. If they wanted a 4 panel manga, they should have just licensed azumanga daiou.
