Its far more like 'research things that are as likely as possible to be thought of eventually by someone else then sue them into the ground for "damages" and royalties'

What you refer to is called a Q:Line, which prevents non opers or non U:Lined services from using specified nicknames. If the attacker had lilo's oper pass, then the attacker could easilly then change their nick to "NickServ", thus facilitating the compromise.
I think a better way to deal with flash is to use the FlashBlocker plugin for Firefox
All flash-based ads get replaced with a placeholder and a little play button, then you get to selectively enable the ones which you require - http://flashblock.mozdev.org/
B) We are supposed to trust MS that this thing is only asking MS if it needs to be shut off? What the hell kind of reason is that to phone home?
Don't forget however, there may be some 'innocent' buffer overflows in there that could facilitate a lot more than simple on/off functionality on Microsoft's part.
They don't need to do that, yet. Other people (motivated by money) do that job perfectly well for them already.
All they need to do is simply convince people that their product is a must for survival on the internet.
