The best word in the whole article is "settled" ... Microsoft settled with the government. You can't settle with the enforcement -- or at least shouldnt be able to. Your punishment is your punishment.

    To whom it may concern,
I just wanted to express my extreme disappointment regarding your recent actions to disable Blue Security's account in an attempt to stop the attacks of a notorious spammer. I fully understand that the attacks were a technical nightmare for your team, however, it is unbelievable that you would rather give in to a criminal and follow their demands and step on an organization that aims to protect innocent citizens from around the globe. Regardless of what your motive was, this action clearly states that you are more interested in profit than you are about ethics. As a result, I am recommending that all contacts I have that use Tucow's services remove their accounts and utilize a service which supports consumer protection. It is my sincere hope that should a similar situation arise, you will think of the company that is trying to protect the Internet.

I have to agree that this is a serious concern and as a tech, I often want to blame the stupid user since I deal with them frequently but on the other hand, can you really blame them? In any given day, an end user sees an unmeasurable amount of dialog boxes and our minds are designed to filter out things that are annoying. Instead of "Hey your email wasnt sent" you get 3 dialog boxes first that have no meaning. Of course, there is the next-next-finish epidemic as well. Does anyone really ready any options anymore? We all just go for the next button until it turns into a finish button. There are 2 huge problems with this. The first is that mixed in with all these stupid notices, there are important messages that go unnoticed. The second issue is that this is something that spyware companies thrive on for legalities.... in the middle of those next-next-finish games is the little line that signs your computer over to the dark side.

Yes, we certainly do have to think of the children but there truly are enough ways that we can prosecute offenders under current laws. It's human nature to make excuses to give when we want to do something (or have done something) that is not going to be a popular thing. This is what the government is doing. Child porn is disgusting but the government is using child porn to accomplish their own disgusting goals. Something to think about is this.... Would you allow the government to put cameras in your computer room so that they could verify that you were not interested in child pronography? Any other legal activity that you did would be monitored.... even looking at what is legal pornography. The question is where do we draw the line and, more importantly, at what point do we hit the "point of no return" in which the government has too much power and we are powerless?

The article also says that Gonzalez is looking at ways to force webhosts to track user activity, but this could easily mean just tracking user activity to the illegal child-porn websites, which also seems reasonable.
How do you log only child pornography? Sure, you could filter out keywords but if that is what they are trying to accomplish, then Google already provides this so why do we need to log anything in the first place?
I hate to say it, but the comment you made is the exact reason why we are losing our privacy.
