    Why do programmers put up with this now? Their relationship with EA is voluntary. There is a shortage of programming talent today in Silicon Valley. If things were that bad at EA then people would just bail out.

    Mr. Chaotica,

    Let's say my neighbor Tim wants some special chess software written but he does not have the time or skill to write it himself. Let's say that I do have the available time and skill. I tell Tim that I'll write the software and let him have non-exclusive use of the software executable for $10. Then, I discover 9 other people who want to use the same software so I've sold it 10 times for $10 per copy and I've retained the source code for my use only.

    In your perfect world, am I free to seek these voluntary $10 use agreements or not?

    I'm all for letting people decide to live within a Communist system so long as each individual has the freedom of choice to opt out if that system. Implement Communism without coercion and if it really is more moral and just then you'll have no problem growing your society.

    Tivo is no where close to being the Apple of the set top industry. They are in danger of ceasing to exist because their annual revenue is still short of $200 million per year and they continue to burn their available cash on hand. They just do not have the capital needed to create the next great leap of innovation.

    As long as their is ISP choice for consumers then nobody is going to lose access to anything. At my house I can choose from DSL from phone companies or a tv cable modem. Soon there will be metro wi fi and IP from power lines. Competition and consumers protecting themselves through choice is a much better guarantee of choice than ham handed regulation from Washington.
