So what the heck is wrong with going after this sort of stuff? Trademark infringement is seriously bad news. Ask anyone who has gotten fake merchandise thinking it was genuine.
How would you think it'd go down if China, Iran or Russia started seizing random domains claiming they broke THEIR laws, without due process?
Or even say, France, Germany, the EU maybe... or... Fiji?
As a kiwi, im pretty pissed off about all this... hes been accused of no crime in NZ, the search warrants were incorrect, and its a part of due process that you should know what your accuser is saying the proof of you doing crimes is... atm not only is Dotcom not allowed to see what his accusers have as 'proof', hes not allowed access as his own files which were confiscated
The MPAA/RIAA when sponsoring the creation of the copyright law change in New Zealand, managed to get it passed that the SUBSCRIBER is the person legally responsible for what happens on the account, no matter what...
and if that's not bad enough, if you're accused of downloading a file, a correctly filled in complaint form from the IP holder is deemed sufficient proof the offense occurred (3 strikes btw)... i.e, if someone accused YOU of downloading Justin Bieber - Baby.mp3 yesterday, could you prove you didn't? I certainly haven't found someone who has figured out a way
Here in NZ, the account holder is legally responsible for ALL activity on the account, whether it was hacked, or someone else used it and did something silly (kids/friends/family/paying clients, etc)
The form of an infringement notice is to be prescribed by regulation. However, the fact that the form is correctly completed is not relevant to the issue of whether or not there has been copyright infringement. So that does not explain why the mere filing of a notice should be conclusive evidence.
Merely CORRECTLY filling out a complaint notice, is deemed sufficient evidence that an offense occurred if it goes to a tribunal
To put it another way, if someone accused me of downloading X song on Y day, and i didn't, i still have yet to find anyone who can show me a way to prove i didn't
Example:"Sir, you are accused of downloading one mp3 titled 'Justin Bieber - Baby', please prove you didn't if you wish to defend yourself"
NZ law specifically written with sponsorship from the MPAA/RIAA (about $1m NZD) and is written so that the account holder is fully the responsible party, even at say a school, library, starbucks, etc
I doubt they'll be able to see Steam downloads secondhand, nor EA's games that use Origin, and nor Blizzard's games that use battlenet. Doesnt leave alot else, then they have to get the DRM issues sorted with publishers.... GL with that Gamestop
Just bought an HTC One X, having owned a HTC Trophy 7. Sure the hardware on the One X is significantly better, but hardware wise i was pretty happy with the Trophy 7.
The main gripe with Windows Phone was that i couldn't come close to customising the looks of it (oh yay i can change theme and the slider screen, big woop), Nor could i change the notification tone, except to one of the 10 jingles provided (how long has customisable text notifications been available to other phones, years and years i believe)
New Zealand is responsible for what they do in their own backyard with their own police forces.
If they want to surrender their sovereignty to a bunch of RIAA/MPAA hacks who have paid off the right people, that's their prerogative. It's obvious that they've realized the mistake and are trying to make things right, but in the end it's NZ that screwed up here.
I thought the whole idea of a free market, was it was legal to offer a can of coke for say, $200 USD, or more, if there was no fraud involved. There *may* be in this case, but my understanding is, it was a case of here's Facebook shares, here's what we're selling them for, you choose if you wish to buy them
Sure, ill rent it now n then... but they can go to hell if they think I will put up with this on something i OWN
And anyone who says 'oh but you down own it, you own a license' can go to hell...
Imagine the uproar if you got told AFTER you just bought a car, no you cant loan it to your friend/family, you cant use it on roads not approved by the manufacturer, and every time you got in, you had to watch a 20 second thing on why its important to use X brand parts (oh, and btw, no you cant change the colour/add in a new stereo/seat cushion) because 'its a license to use the car, not ownership)

Agreed... i love my HTC One X, and CM 10 works great on it... HTC were painfully slow at bringing out Jellybean for it, especially for my CID
