Evolution of theories
I think that none should trash any theory, unless there are some clear evidences and, much better, when there is one theory able to provide answers when the other ones cannot.
Evolution theory seems to be quite reasonable because it seems to rely on very few postulates when compared to other theories.
If other theories need fewer postulates and provide more answers, then chances there are that they will succeed.
I'd suggest a quick read of "The Fabric of reality" by David Deutsch for deeper details about this philosophy.
In any case theories about evolution are themselves subject to evolution whenever the objective is to provide answers. -

This is intentional (reverse) squattingThis is theretically very cut and dried. The purpose of trademark is customer protection, so that the customer isn't deceived into doing business with the wrong person. Trademarks don't need to be registered. All you need to do is use it first to do business in a particular market. Since katie.com contains no geographical information, and due to the nature of the internet, the whole internet is effectivelly one market Penguin has clearly violated the purpose of trademark law since it is supposed to be primarily for the customers benefit. They are deceiving people into thinking that the two katies are the same, clearly a violation of copyright law.
Penguin knows this.
The practical problem is that copyright law is enforced by the victim taking the violator to court. They are using harassment, itself probably a crime, to intimidate a person without deep pockets. It's like trespassing or squatting, if someone uses your property long enough, it becomes their property. They have done the equivalent of publishing a map misidentifying her property as a publicly accessable racetrack. When people get there, they might notice that it isn't, but not until they have driven all over her pansies ruined her lawn.
I propose we do our due diligance and visit their websites, see what they have to say about it. Visit all their sites as many times as necessary to make sure they know we've done our homework. Here's a few:

Katie is in Europe, so is Penguin. It is in other places, too, but this is probably of interest. Notice in particular that in Europe, Big Guys aren't allowed to use trademark law to intimidate Little Guys. Other forms of harassment are probably illegal, too. and 3 lefts never make a right.

No, I was stating that it is more recognizable. Anyone that has seen and realized what Tux is forever links it with Linux. It is a unique logo that can spread the brand name around all over the place.
Hardly. Unfortunately, the idea "let's promote our brand by adopting a cute penguin as our logo" was too obvious NOT to be already taken. In Great Britain, penguin is associated rather with a popular paperback publisher. In Poland, it is associated with a popular pre-paid cell phone operator. People can see Tux on screen and think it's just some cross-promotion of a computer manufacturer, paperpack publisher and phone operator. -

Heck, England is where Professor Branestawm (sorry, Amazon doesn't list any of the original books) invented the pancake making machine. As I recall, it went awry and tossed 24-inch pancakes about 30 feet away.

I've read it last week...It's an excellent book: extensive, very precise - it reports many funny anecdots about projects (Linux, GNOME, KDE, Apache... ) and actors (Linus, Richard...). It also covers stories that are generally hidden by big Open-Source medias, such as the Mandrakesoft's beginning (very interesting). I can recommend it! All people interested in Linux and Open-Source should read this book in order to understand what Free-Software/Open-Source is.
