FBI Anti-Piracy Seal
Supp0rtLinux writes "Looks like the FBI is giving a new anti-piracy seal for entertainment and software products. Looks like now the RIAA and MPAA pursuits will add a new federal level to future prosecutions." I'm pretty sure that our forms of media already contain warnings against unauthorized duplication, rebroadcasting, and public performance, but now it's in logo form! -
RIAA Extends Legal Action
shystershep writes "An article at InfoWorld tells how the RIAA 'is filing 41 new lawsuits and sending 90 lawsuit-notification letters this week, adding to the 341 lawsuits filed and 308 notification letters sent since September. The RIAA has settled with 220 file-sharers as a result of lawsuits, lawsuit-notification letters and subpoenas. In addition, 1,054 users have submitted affidavits as part of the RIAA's amnesty program.' The RIAA also claims that its tactics are actually working -- to increase awareness and reduce online piracy." -
Can RIAA Lawsuits be Blocked by Routers?

With no logging of who is moving what who can the RIAA prosecute when it tracks a shared file back to that specific shared internet account? I would imagine that many Slashdot readers are behind routers that hold all of their internal IPs private to the outside world. Is the bill payer responsible for all of the users of that router? How can a person be held accountable for the actions of others, especially when there is no proof of who did what?" -

Hilary Rosen Will Step Down As RIAA Head

The article reports 'Rosen's departure comes as the organization sought to soften its image among Internet consumers, many of whom viewed the RIAA -- and Rosen personally -- with antipathy over incessant pressure for crackdowns on sharing digital music over the Internet.'" A press release on the RIAA site says that Rosen will leave at the end of this year. -

The discussion ended up revolving around whether the author had a valid claim or not, but I'd still like to know -- are there inexpensive alternatives?"

Like obsidian, and coal, and dirt ... salimfadhley writes "Today BBC Radio 4 began serialising Phillip Pullman's popular "Dark Materials" trilogy. The beeb will be broadcasting one episode per week, with a RA stream of the latest episode that can be found on the promotional site. You can find "The Golden Compass" (called "Northern Lights" in Europe) on the website now. This stream will be replaced with episode 2 next Saturday.
The Dark Materials series was originally intended as children's fiction, however owing to excellent storytelling and a significantly darker theme than Harry Potter, has done rather well in U.S. and UK adult market.
The central premise of the series is that God is evil, a celestial impostor who pretends to have created the universe and who so intensely hates flesh and blood that he wants people to live a repressed, joyless existence. Unsurprisingly this theme has upset fundamentalist Christians."

Would a Boycott of the MPAA/RIAA Help Matters?

Heck, most of the film companies own, are owned by, or share a corporate parent with a record company, and many of us get our internet access from part of the MPAA/RIAA conglomerate. So why is it? Why do we continue to buy their product? Why are we giving them money so that they can harass us? Why hasn't there been a call for a boycott of the record and film industries?" This is in the FAQ, but this is certainly a discussion worth having. With the pervasiveness of media in our society, for some it is not as easy as "boycott" or "no boycott", and it may be unfair to the artists we like for us to do so, and as Big Media diversifies, a boycott on movies and music may still not be enough. Fast CD-R Drives Make For Twice the Piracy
Bowie J. Poag notes this Register story about an RIAA copyright infringement bust in New York. The RIAA claims the operation had the equivalent of 421 CD-burners, which, translated from RIAA-speak, means "156 CD-burners but some of them were fast". How they expect anyone to take their statistics seriously is beyond me. -

Internal MP3 Server? 1 Million Dollars Please
nkruse pointed out that our pals as the RIAA are breaking new ground. According to this Reuters Article, the RIAA has succeeded in collecting 1 million US dollars from Arizona based Integrated Information Systems. IIS apparently had a corporate MP3 repository on it's network. This is the first time I've heard about the RIAA doing this kind of thing. Looks like they're taking a page from the BSA handbook. -

Felten Won't Appeal DMCA Case

Musicians Get Together For Anti-RIAA Concerts

Slashback tonight with a look at Microsoft's OEM practices, the true nature and size of the Apple iPod, IBM drives (and hard drives in general), and the RIAA's alleged lobbying efforts for a license to invade machines looking for copyright infringement. All below, all now.Drive-n to strong drink and harsh words. Apropos that, jriskin writes: "Storagereview.com has its new reliability database up and running. I have no affiliation with the site, but it only benifits the community to have as many people contribute as possible. The database is a listing of hard drives and whether or not they have failed, when they were purchased, etc. So get over there and put in all your HD data!" Things like this could help eliminate the anecdotal-only nature of many of hardware complaints, especially if people who are happy with their hardware bother to report it.
Falling far from a tree has nothing to do with it. Majik writes "A quick correction - the iPod has *10* gigs of storage, not 5 (or 6 like the Nomad). And with the Firewire interface you can move an entire CD in under a minute. Although I admit I was hoping for more out of the product announcement, it's still pretty darn cool ... "
On the other hand, jchristopher writes: "Love it or hate it, Apple's new iPod digital music player is here. Yesterday, many people commented that "at least it has no copy protection" and praised Apple's attitude toward digital music. Unfortunately, this may not be the case - according to this New York Times article, the iPod does indeed have copy protection - MP3 files copied to the iPod from one Mac to the iPod CAN'T be offloaded onto a different computer. Ouch!" That means (at least without further hacking) it can't be used as a transfer medium between the G3 and work and the iMac kept hidden in your darkest closet, which is sort of a shame considering that it has all the right things built in to be even better than the several portable firewire drives on the market.
Unorginal Equipment Makers. An Anonymous Coward writes: "This is a follow-up on a previous story posted to Slashdot about Microsoft's anti-competitive OEM contracts." It's a report by German journalist Erik Möller (hi, Erik!), who too an extremely thorough look at the details of OEM bundling deals, and what they mean to customers. Möller's conclusion: "No operating system will ever be able to compete with Microsoft Windows on the desktop market as long as OEMs cannot legally install it besides Windows without losing their license."
'Technical meaures' covers a pretty broad swath. Robotech_Master writes "The RIAA has responded to the 'license to virus' story, calling it a false Internet rumor and explaining their side of the story." So the RIAA officially does not want a license to hack, at least on paper.

RIAA To Target CD-R

Hilary Rosen, president and CEO of the RIAA, said: "Many in the music community are concerned about the continued use of CD-Rs . . . and we believe this issue deserves further analysis. A preliminary survey of tech savvy online music enthusiasts recently conducted for the RIAA showed that nearly one out of two consumers surveyed downloaded in the past month and nearly 70 percent burned the music they downloaded. All of this activity continues to show the passion of the consumer for music and the need for both legal protection and legitimate alternatives.'" I enjoy Rosen's claim that "consumer loyalty to the physical product still dominates and we are committed to providing the quality product listeners desire." I wonder if they'll eventually push through a Canadian-style tax on anything that can carry data. -
Rent A Downloadable Movie
Syn Ack writes: "The New York Times is reporting (free account, blah blah blah) that five (5) major Hollywood studios (MGM, Paramount Pictures, Sony Pictures, Warner Brothers and Universal Pictures) are going to begin offering downloadable time restricted movies. The video will remain watchable for 30 days but will become unplayable 24 hours after it has been viewed at all. Sounds like if you start the movie at all, the clock starts ticking so no peaking until you're ready to watch it ALL. Downloads are expected to be in the 500MB range. However downloads will only be available well after the DVD release of the same movie so as to not cut into DVD sales. Expect to see something late this year or early next. Perhaps the Music People can get some tips from the movie people?" What a bargain. -
EFF Files First Anti-DMCA Lawsuit
The first direct legal challenge to the DMCA was filed at 9 a.m. EDT today by EFF-sponsored attorneys at the United States District Court in Trenton, New Jersey on behalf of Princeton Professor Edward W. Felten and others who helped crack a series of digital watermarking schemes as part of an SDMI Challenge sponsored by the RIAA. Named defendents include the RIAA, SDMI, Verance Corporation (producer of one of the cracked watermarked schemes) and U.S. Attorney General John Ashcroft.If this were a movie, it might be called "Saving Professor Felten" and would open with thunder and bombast. In real life, filing a civil suit in a federal court is one of the most boring activities imaginable, even though it's a necessary first step in the process of overturning the DMCA.
Gino J. Scarselli, Outside Lead Counsel for EFF on the case, says, "We got to the courthouse at 8:30, filed around 9, and made motions to seal exhibits to the complaints." As explained in the Complaint itself, EFF filed several of their Exhibits with requests for them to be sealed, because they believe publication of them may invite a lawsuit. The Exhibits to be sealed are Professor Felten's completed paper for the upcoming USENIX conference, and two documents written by Princeton post-grad Min Wu about the investigation performed by Felten's team against the SDMI watermarks.
It was an overcast day in Trenton. Scarselli, along with local (New Jersey) attorneys Grayson Barber and Frank Corrado, and two of the plaintiffs, Princeton residents Bede Liu and Min Wu, went through a metal detector just like anyone else (aside from staff) who enters a courthouse these days.
Scarselli says, "the only person we talked to was a law clerk." Neither the defendants nor any lawyers representing them were present. There will be plenty of conflict later, but the opening round of this drama was so low-key that it was a total yawner for all involved parties. The whole thing was over by 9:45 a.m.
The Complaint Itself, Very Briefly
Prof. Felten and others, mostly professors and graduate students from Princeton and Rice Universities, accepted the SDMI challenge to crack a specific set of digital watermarks, but instead of turning their results over to SDMI in hopes of winning the $10,000 prize offered for a successful crack, they chose instead to publish their findings in the form of an academic paper, and to present that paper at the Fourth International Information Hiding Workshop [IHW], held in Pittsburgh on April 25-27, 2001. Felten and crew believed they had every right to present their research in this public, peer-reviewed scientific forum even though they had accepted a "click through" agreement before taking on the SDMI challenge, in large part because the license to which they agreed with their click contained these words:
"You may, of course, elect not to receive compensation, in which event you will not be required to sign a separate document or assign any of your intellectual property rights, although you are still encouraged to submit details of your attack."
Despite this, SDMI threatened Felten and the other involved parties, including IHW organizers, with legal action under the DMCA. After a long series of emails between Felten, his fellow researchers, IHW people, a representative of Verance Corp., and an attorney who works for both SDMI and RIAA, the original paper, "Reading Between the Lines: Lessons from the SDMI Challenge," was first modified, then finally withdrawn.
Now Felten and friends plan to present the same paper at a USENIX Security Symposium in Washington, D.C. on August 13-17, and are asking the court to tell the defendants not to sue or threaten legal action over this new publication or any other publication, and to tell the U.S. Department of Justice, run by Attorney General John Ashcroft, not to file criminal charges against USENIX or anyone else over this matter under the DMCA. As it says in the complaint:
68. In chilling publication, the DMCA wreaks havoc in the marketplace of ideas, not only the right to speak, but the right to receive information -- the right to learn. The main mission of USENIX is to organize forums where scientists and researchers learn from each other. By intimidating the individual plaintiffs into withdrawing their paper from the IHW, however, the private Defendants prevented people from learning. If the source of Defendants' power to threaten, the DMCA, is not dispelled, Plaintiffs will not be the only victims. Without full and open access to research in areas potentially covered by the DMCA, scientists and programmers working in those areas cannot exchange ideas and fully develop their own research. As a consequence, the DMCA will harm science.

The Press Conference
It was held at noon Eastern time, in person simultaneously at EFF headquarters in San Francisco and at a room borrowed from Princeton University. A few reporters were at EFF headquarters in person, but most of us dialed in and participated by phone. The media turnout was impressive; reporters from the Boston Globe, Wall Street Journal, New York Times, AP, NPR, Reuters, Wired, and other major news outlets showed up, which was nice to see; Slashdot has been rather lonely in covering many DMCA matters and complaints. It was nice to see so many "mainstream" pressies finally paying attention.
Felten was in San Francisco. So was most of the legal crowd. USENIX Board member Avi Rubin was on the conference call telephone. The Princeton contingent was tiny, composed only of the people who had been at the court house earlier. EFF legal director Cindy Cohn opened the show from San Francisco with a rehash of the events leading up to the suit, most of which I recapped above. (You can find more information here.)
Felten spoke briefly. The basic thrust of his prepared speech can be summed up thusly: "We are asking the government to let us do what scientists have always done -- share the results of our research."
The USENIX people noted that they hold many conferences and may be subject to both civil suits and criminal prosecution if they publish papers DMCA legal threateners (like SDMI and RIAA) don't like, and view this suit as an attempt to maintain their First Amendment rights to freely distribute technical and scientific information to USENIX members and other interested parties.
Then the press questions began. The first dozen covered ground that is familiar to most regular Slashdot readers. There is no point in rehashing these questions when a Slashdot search for "SDMI + DMCA" or just "DMCA" will give answers to every one of them.
Then Hiawatha Bray, a tech columnist for the Boston Globe, wanted to know if the case would be dropped if the SDMI and/or RIAA decide to stop hassling Felten and USENIX. The attorneys said "No." Their point here is to prevent both private companies and the DoJ from bringing DMCA threats not only against the SDMI crack researchers but against anyone who might go through the same sort of ordeal in the future, so a settlement that affected only this case would not cause the EFF to drop it. Other questions and answers followed, but again, long-time Slashdot readers already know most of them, so we won't repeat them here.
Follow the Money
Ms. Cohn says the cost of this suit, "if fully litigated," could easily reach $2 million. She estimates that the EFF-sponsored 2600 DeCSS defense has already cost nearly $1.5 million, and that suit is still cranking up the appeals chain. She also says -- yes, this is a plug -- that Slashdot readers who want to donate money to help fund all this expensive legal action can check out the EFF Web site.

This is Just the Beginning
Now, basically, we sit and wait. The lawyers do lawyer-dances involving lots of paperwork. Discovery motions pass back and forth. Amicus briefs get filed. A hearing date gets set, then there's a hearing, and another hearing, and so on.
The 2600/DeCSS case has been going on for a year and a half and still isn't over. This one is likely to drag out even more. Even if Prof. Felten, his associates, and USENIX win all the relief they seek, chances are high that the RIAA, SDMI or at least one of the other defendants will appeal -- and keep appealing all the way to the U.S. Supreme Court.

The AP wire story's second paragraph says "Sales of music compact discs fell by 39% last year," which they would have quickly seen was a blatant lie if they'd bothered to look at the numbers. And the news media is reporting it as a 39% loss.
The facts are that their "CD sales" are up this year, even over last year's stunning performance. The RIAA increased the average price of a full-length CD from $13.65 to $14.02, and still managed to sell 3,600,000 more of them.
Total profit increase on this, the core of their business, was 3.1%, or just shy of an extra $400,000,000.
But full-length CDs only account for 92% of the RIAA's revenue. They did have weak performance in the other 8%. CD singles, as already noted, dropped revenue by 36%. But the real casualty percentage-wise was cassingles, which lost over 90% of its revenue from last year.
Gee, why could that be? Maybe because nobody wants them?
In fact, the RIAA's only real money-losing format of any significance was cassettes, which, along with music videos, were the only format actually cut in price. Cassette revenue dropped $436 million.
Wait a minute, what am I saying? "Money-losing"? They aren't losing money on cassettes -- they're just not raking it in this year as fast as last year. And gee, why might that be? Again, because nobody wants them?
And it's not like the RIAA is struggling to get by on slim profits. The big picture is that, in the last nine years, they have tripled their annual income.
But they are desperate to spin this as a loss. The actual fact is that their total revenue is down 1.8% from 1999. Last year, they made $14,584,500,000. This year, they made $14,323,000,000.
But how could they blame Napster if they told the truth? What would they say? "Napster is killing us! Our income is down almost two whole percent! We are only pulling in $14,323,000,000 this year!"
That probably wouldn't fly.
Especially because in the three categories which Napster has precisely zero effect on -- cassettes, vinyl, and music videos -- their combined year-to-year loss was $579.5 million.
That's right. In the digital formats which Napster can trade, they are making more money: $318,500,000 more revenue. In the analog and video formats where Napster is irrelevant, they are making less money: $579,500,000 less revenue.
That's the real story here.
But don't trust the press to report this one fairly. Don't trust the RIAA's press release. Go read the RIAA's numbers yourself.
(Hell, don't even trust those numbers -- they don't add up. I was silly enough to type them into a spreadsheet, and someone over there has some problems doing simple arithmetic. Their 1998 total revenue includes the DVDs twice.)
The RIAA is desperately trying to spin this so that they won't look like greedy bastards for turning down Napster's offer of a billion dollars over the next five years.
If they just took that generous offer, then -- in a year that the AP wire suggests might be an "industry-wide slump, due to economic factors and a weak year musically," and in a year for which Bertlesmann admits "we didn't put that much good stuff out" -- their revenue would only be down $111,000,000 from last year. And that would have been $750,000,000 more than they made in 1998.
But that isn't enough for them.
Why would anyone think the RIAA is greedy? They just want what's coming to them.

The Software Police vs. The CD Lawyers

RIAA Reversal On 'Work For Hire' Legislation

JHancock17 reminds anyone who hasn't to read Courtney Love's speech as reprinted by Salon a while back, and res0 points to this ABC News interview with Chuck D. in which the P.E. frontman continues his eloquent tirade against the music industry as a whole. But Mr. D and Ms. Love have been famous outspoken in favor of Napster and electronic music exchange for a while: Now those stalwarts are joined by another big name. srcosmo writes "Radiohead have become the first British band to condemn the injunction against Napster. Their bassist, Colin Greenwood, showed enthusiasm for the availability of Napsterized live recordings, saying "We have just finished a tour, we played in Barcelona, the next day the entire performance was up on Napster and three weeks later when we got to play in Israel the audience knew the words to all the new songs and it was wonderful." An interesting change from the Metallica look at things- hopefully more artists will follow their lead."

What Else You Can Do: Alert The Media (Mavens) battery841 writes "In light of Napster getting an injunction against it by the courts, someone decided to register riaaboycott.org and setup a petition. You sign the petition, and once it's gotten enough signatures, it's going to be sent to numerous sources, including Napster and the RIAA." And as CmdrTaco posted the other day, there are boycotts in the air.
Another Angle On The Big Picture: Danse writes "Salon is running an article with reactions from all sorts of people connected to the music industry, Napster, Napster alternatives, etc. It's pretty interesting reading. Everything from the arrogance of Jack Valenti to the apparent cluelessness of Erwin Drake to the insightfulness of Glenn Reynolds to the amazingly short (obviously not written by Lars) comment by Metallica. To sum things up, the industry thinks this is a big win and that they now have a chance to offer consumers music downloads on their own terms. This displays their current lack of understanding of the real problems that users are seeking to remedy with Napster and the other music/file trading options. What Does the Audio Home Recording Act Really Allow?

While I was on riaa.org I came across this: What You Can't Copy They cite the Audio Home Recording Act. Basically what I came away with was that I am not allowed to make any recordings of copyrighted music onto my computer. I can't make mix CDs, or sound clips, or even MP3s for my own use. Can this really be?? Is this what the Home Recording Act is all about? If this is the case, then MP3.com seems to have no ground to stand on when it comes to the Beam-It software."
