Tristan O'Tierney, Square Co-Founder, Dies at Age 35 (sfchronicle.com)
An anonymous reader quotes the San Francisco Chronicle: Tristan O'Tierney, a co-founder of San Francisco payments company Square, died Feb. 23 in Ocala, Fla., of causes related to addiction, his family said. He was 35...
His family is awaiting an official cause of death from officials. "I do know that it was in relation to his addiction," [his mother] Pamela Tierney said. "I know he got to the hospital, he couldn't breathe and they couldn't revive him." O'Tierney was in a three-month rehabilitation program in Ocala and had been battling addiction for three years, Tierney said. O'Tierney openly discussed his struggles with addiction on social media. "As some of you may know, I've been battling with addiction for these past few years," he wrote in September in a now-deleted Instagram post that he also shared on Twitter. "With some success. A lot of failure too though."
Bloomberg remembers him as a former engineer at Yahoo and Apple who was hired to develop Square's original mobile payment app in 2009, then stayed on until 2013.
"In addition to his parents, O'Tierney is survived by his three-old-year daughter, according to an obituary on the website for the funeral home." -
H-1B Visa Lottery Will Now Favor Masters, Doctorate Degree Holders (sfchronicle.com)
McGruber shares a report from The San Francisco Chronicle: The Department of Homeland Security announced a rule change Wednesday that will transform the lottery that decides who gets the 85,000 H-1B visas granted to for-profit companies every year. Previously, an initial lottery granted 20,000 visas only to those holding advanced degrees granted by U.S. institutions -- master's degrees or doctorates -- and then a general lottery granted 65,000 visas to all qualified applicants. The Department of Homeland Security switched the order of these lotteries, it said in a notice of the final rule change, which will bolster the odds for highly educated foreign nationals. The change reduces the likelihood that people with just a bachelor's degree will win in the general lottery, said Lisa Spiegel, an attorney at Duane Morris in San Francisco and head of the firm's immigration group. The program shift could hurt technology staffing companies, also known as outsourcers, who have a reputation for flooding the lottery with applications. Three Indian firms -- Tata Consultancy Services, Infosys and Wipro -- often account for a majority of the H-1B applications, an analysis of government data shows. -
A Sleeping Driver's Tesla Led Police On A 7-Minute Chase (sfchronicle.com)
"When a pair of California Highway Patrol officers pulled alongside a car cruising down Highway 101 in Redwood City before dawn Friday, they reported a shocking sight: a man fast asleep behind the wheel," reports the San Francisco Chronicle: The car was a Tesla, the man was a Los Altos planning commissioner, and the ensuing freeway stop turned into a complex, seven-minute operation in which the officers had to outsmart the vehicle's autopilot system because the driver was unresponsive, according to the CHP...
Officers observed Samek's gray Tesla Model S around 3:30 a.m. as it sped south at 70 mph on Highway 101 near Whipple Avenue, said Art Montiel, a CHP spokesman. When officers pulled up next to the car, they allegedly saw Samek asleep, but the car was moving straight, leading them to believe it was in autopilot mode. The officers slowed the car down after running a traffic break, with an officer behind Samek turning on emergency lights before driving across all lanes of the highway, in an S-shaped path, to slow traffic down behind the Tesla, Montiel said. He said another officer drove a patrol car directly in front of Samek before gradually slowing down, prompting the Tesla to slow down as well and eventually come to a stop in the middle of the highway, north of the Embarcadero exit in Palo Alto -- about 7 miles from where the stop was initiated.
Tesla declined to comment on the incident, but John Simpson, privacy/technology project director for Consumer Watchdog, calls this proof that Tesla has wrongly convinced drivers their cars' "autopilot" function really could perform fully autonomous driving...
"They've really unconscionably led people to believe, I think, that the car is far more capable of self-driving than actually is the case. That's a huge problem." -
California Voters Embrace Year-Round Daylight-Saving Time (sfchronicle.com)
Californians warmed to the idea of year-round daylight-saving time, approving an initiative that would urge state lawmakers to junk the annual springing forward and falling back. From a report: With 43 percent of precincts reporting Tuesday night, Proposition 7 was leading 61 percent to 39 percent. It's a long way from here to year-round daylight-saving time. First, the Legislature would have to approve it by a two-thirds vote. Then Congress would have to allow California to deviate from standard time when most of the rest of the nation shifts to it. -

Southern California Sees Its Longest Streak of Bad Air In Decades (sfchronicle.com)
According to state monitoring data, Southern California violated federal smog standards for 87 consecutive days -- the longest stretch of bad air in at least 20 years. "The streak is the latest sign that Souther California's battle against smog is faltering after decades of dramatic improvement," reports San Francisco Chronicle. From the report: The ozone pollution spell began June 19 and continued through July and August, with every day exceeding the federal health standard of 70 parts per billion somewhere across Los Angeles, Orange, Riverside and San Bernardino counties. It didn't relent until Sept. 14, when air pollution dipped to "moderate" levels within federal limits for ozone, the lung-damaging gas in smog that triggers asthma and other respiratory illnesses. It's not unusual for Southern California summers to go weeks without a break in the smog, especially in inland communities that have long suffered the nation's worst ozone levels. But environmentalists and health experts say the persistence of dirty air this year is a troubling sign that demands action. Regulators blame the dip in air quality in recent years on hotter weather and stronger, more persistent inversion layers that trap smog near the ground. -
Apple Argued That Buildings at Its Headquarters Were Worth $200, Not $1B, To Reduce Its Tax Bill: Report (sfchronicle.com)
Apple argued that buildings it owned around Cupertino, where it is headquartered, were only worth $200 instead of the $1 billion tax assessors deemed in 2015, according to appeals reviewed by the San Francisco Chronicle. From a report: The report characterized the dispute as part of an aggressive strategy by Apple to lower its tax bills. According to the Chronicle, Apple has 489 open appeals in tax disputes over property assessed at $8.5 billion in Santa Clara County, Calif., dating back to 2004. Those appeals include the $1 billion building assessed by tax officials, as well as another $384 million property that Apple also claims is worth $200. Apple is now valued at $1 trillion. It is also the county's biggest taxpayer, paying $56 million in the 2017-2018 tax year. -
San Francisco Officials Are Planning To Ban Corporate Cafeterias, Force Tech Workers To Eat Out At Local Restaurants (nytimes.com)
"According to The New York Times, San Francisco officials are planning to ban corporate cafeterias to force tech workers to eat out at local eateries," writes Slashdot reader The Original CDR. Here's an excerpt from the report: Two San Francisco supervisors introduced an ordinance last week that would forbid employee cafeterias in new corporate construction. It is not clear whether the measure will pass, but it is a direct attack on one of the modern tech industry's most entrenched traditions. The ordinance, which seeks to force tech workers out of their subsidized cafeterias and into neighborhood restaurants, is the latest attempt by San Francisco leaders to make the tech companies that are migrating north from Silicon Valley adapt to life in the city.
"These tech companies have decided to leave their suburban campuses because their employees want to be in the city, and yet the irony is, they come to the city and are creating isolated, walled-off campuses," said Aaron Peskin, a city supervisor who is co-sponsoring the bill with Ahsha Safai. "This is not against these folks, it's for them. It's to integrate them into the community." Mr. Peskin's ordinance is also aimed at getting more out of a tax deal given to tech companies that would agree to move into a troubled area called Mid-Market. In 2011, the companies were given tax breaks on payroll and stock options with the hope that they would bring jobs and investment to the neighborhood, just a short walk from San Francisco's City Hall. Within a few years, a number of companies like Twitter, Square and Uber moved into Mid-Market. But despite initial excitement over the opening of a number of restaurants and shops, the neighborhood has not yet flourished the way many had hoped. California's Efforts To Restrict Elon Musk's Flamethrowers Go Down In Flames (arstechnica.com)
An anonymous reader quotes a report from Ars Technica: A California state bill that would have more heavily regulated the use of flamethrowers has now effectively fizzled out in a legislative committee. In light of this development, there's nothing to stop Boring Company customers in California from receiving the company's sold-out flamethrowers. On May 26, the day after the bill died in committee, CEO Elon Musk tweeted: "About to ship. @BoringCompany holding flamethrower pickup parties in a week or so, then deliveries begin. Check https://www.boringcompany.com/... for details." After Musk said he would be selling a flamethrower dubbed "Not a Flamethrower" to get around customs, Assemblyman Miguel Santiago (D-Los Angeles) authored a bill that would have imposed more restrictions on their acquisition and use.
"I honestly thought it was a joke when I saw the news about this," the assemblyman said in a statement at the time. "This product, in the wake of California's deadliest wildfire year in state history, is incredibly insensitive, dangerous, and most definitely not funny." He added: "There are many times in which technology and inventions benefit society but are not made available to the public. We don't allow people to walk in off the street and purchase military grade tanks or armor-piercing ammunition... I cannot even begin to imagine the problems a flamethrower would cause firefighters and police officers alike." -
Waymo Starts To Eclipse Uber in Race To Self-Driving Taxis (sfchronicle.com)
Uber barreled into autonomous driving out of fear that it could end up as the MySpace or Yahoo of ride-hailing, a company with early gargantuan success that stumbled as times changed. Waymo, the self-driving offshoot of Google parent Alphabet, has pursued its ambitions more cautiously, accumulating long years of research and testing before pursuing a plan to bring its technology to the public. From a report: Now, as Waymo scales up its self-driving taxi service, Uber's fear could be coming to pass. This week, as Uber continued to reel from a fatal self-driving accident in Arizona, Waymo confidently pushed forward -- landing a deal to build 20,000 self-driving luxury SUVs with Jaguar Land Rover on top of its plan for thousands of Chysler hybrid minivans. Within two years, it aims to have thousands of fully autonomous taxis -- with no backup drivers behind the wheel -- on the roads, starting in Phoenix where it is already giving test rides.
The company predicts it will give 1 million robot-taxi rides a day by 2020. Waymo, the industry pioneer, logged millions of autonomous miles as it perfected self-driving technology. But over the years, engineers defected out of frustration that it was not commercializing the technology. Now with former auto executive John Krafcik at the helm, Waymo appears poised to launch a self-driving taxi service that could conceivably dominate that field, at least early on, the way Uber does now with human-driven cars. -
Police Chief: Uber Self-Driving Car 'Likely' Not At Fault In Fatal Crash (arstechnica.com)
An anonymous reader quotes a report from Ars Technica: The chief of the Tempe Police has told the San Francisco Chronicle that Uber is likely not responsible for the Sunday evening crash that killed 49-year-old pedestrian Elaine Herzberg. "I suspect preliminarily it appears that the Uber would likely not be at fault in this accident," said Chief Sylvia Moir. Herzberg was "pushing a bicycle laden with plastic shopping bags," according to the Chronicle's Carolyn Said, when she "abruptly walked from a center median into a lane of traffic." After viewing video captured by the Uber vehicle, Moir concluded that "it's very clear it would have been difficult to avoid this collision in any kind of mode (autonomous or human-driven) based on how she came from the shadows right into the roadway." Moir added that "it is dangerous to cross roadways in the evening hour when well-illuminated, managed crosswalks are available." The police said that the vehicle was traveling 38 miles per hour in a 35 mile-per-hour zone, according to the Chronicle -- though a Google Street View shot of the roadway taken last July shows a speed limit of 45 miles per hour along that stretch of road. -
California Will Close Its Last Nuclear Power Plant (sfchronicle.com)
An anonymous reader quotes the San Francisco Chronicle: California's last nuclear power plant -- Diablo Canyon, whose contentious birth helped shape the modern environmental movement -- will close in 2025, state utility regulators decided Thursday. The unanimous vote by the California Public Utilities Commission will likely bring an end to nuclear energy's long history in the state. State law forbids building more nuclear plants in California until the federal government creates a long-term solution for dealing with their waste, a goal that remains elusive despite decades of effort.
The decision comes even as California expands its fight against global warming. Owned by Pacific Gas and Electric Co., Diablo Canyon is the state's largest power plant, supplying 9 percent of California's electricity while producing no greenhouse gases. "With this decision, we chart a new energy future by phasing out nuclear power here in California," said commission President Michael Picker. "We've looked hard at all the arguments, and we agree the time has come." -
Cryptocurrency Exchange Kraken Suddenly Goes Dark For Two Days (sfchronicle.com)
An anonymous reader quotes the San Francisco Chronicle: One of the biggest cryptocurrency exchanges was down more than 40 hours this week, causing clients to freak out... San Francisco's Kraken went offline at 9 p.m. on Wednesday for maintenance that was initially scheduled to last two hours, plus an additional two to three hours for withdrawals, according to an announcement on the company's website. "We are still working to resolve the issues that we have identified and our team is working around the clock to ensure a smooth upgrade," according to a status update on Kraken's website posted early Friday. "This means it may still take several hours before we can relaunch." Shortly after noon, the company said it was "still working to track down an elusive bug which is holding up launch." It promised customers "a substantial amount of free trading" after the problem was resolved. In previous updates, Kraken mentioned it is working on "unexpected and delicate issues" and assured clients their funds were secure, adding that "Yes, this is our new record for downtime since we launched in 2013. No, we're not proud of it."
It's 53 hours after the downtime began, and their web page is still showing the same announcement.
"Kraken is presently offline for maintenance." -
Massive Financial Aid Data Breach Proves Stanford Lied For Years To MBAs (poetsandquants.com)
14 terabytes of "highly confidential" data about 5,120 financial aid applications over seven years were exposed in a breach at Stanford's Graduate School of Business -- proving that the school "misled thousands of applicants and donors about the way it distributes fellowship aid and financial assistance to its MBA students," reports Poets&Quants. The information was unearthed by a current MBA student, Adam Allcock, in February of this year from a shared network directory accessible to any student, faculty member or staffer of the business school. In the same month, on Feb. 23, the student reported the breach to Jack Edwards, director of financial aid, and the records were removed within an hour of his meeting with Edwards. Allcock, however, says he spent 1,500 hours analyzing the data and compiling an 88-page report on it...
Allcock's discovery that more money is being used by Stanford to entice the best students with financial backgrounds suggests an admissions strategy that helps the school achieve the highest starting compensation packages of any MBA program in the world. That is largely because prior work experience in finance is generally required to land jobs in the most lucrative finance fields in private equity, venture capital and hedge funds.
Half the school's students are awarded financial aid, and though Stanford always insisted it was awarded based only on need, the report concluded the school had been "lying to their faces" for more than a decade, also identifying evidece of "systemic biases against international students."
Besides the embarrassing exposure of their financial aid policies, there's another obvious lesson, writes Slashdot reader twentysixV. "It's actually way too easy for users to improperly secure their files in a shared file system, especially if the users aren't particularly familiar with security settings." Especially since Friday the university also reported another university-wide file-sharing platform had exposed "a variety of information from several campus offices, including Clery Act reports of sexual violence and some confidential student disciplinary information from six to 10 years ago." -
Drone Pilot Arrested After Flying Over Two Stadiums, Dropping Leaflets (cbslocal.com)
"A man with an anti-media agenda was arrested in Oakland after he flew a drone over two different stadiums to drop leaflets" last Sunday, writes Slashdot reader execthis. A local CBS station reports: According to investigators, [55-year-old Tracy] Mapes piloted his drone over Levi's Stadium during the second quarter of the 49ers-Seattle game and released a load of pamphlets. He then quickly landed the drone, loaded it up and drove over to Oakland. He flew a similar mission over the Raiders-Broncos game. Santa Clara Police Lt. Dan Moreno said after Mapes was apprehended he defended the illegal action as a form of free speech.
USA Today reports there's now also an ongoing federal investigation "because the Federal Aviation Administration prohibits the flying of drones within five miles of an airport. Both Levi's Stadium and Oakland Coliseum are within that range."
"The San Francisco Chronicle added that the drone was a relatively ineffective messenger because 'most of the drone-dropped leaflets were carried away by the wind.'" -
Dark Side of Gig Economy: Some Instacart Workers Go On Strike Over Pay That Can Be as Low as $1 Per Hour (fastcompany.com)
From a report: Instacart shoppers and drivers -- the people who gather your groceries and deliver them to you after you order via the Instacart app -- are on strike. While independent contractors can't technically strike, via a Facebook group some of the company's thousands of employees have organized a "no delivery day" in the hopes of getting higher wages, the San Francisco Chronicle reports. The strike is only taking place in a few of the 154 cities nationwide that Instacart operates in. The action may be small, but the grievances are big. While Instacart, the 5-year-old San Francisco startup, is valued at $3.4 billion, it allegedly pays its workers as little as $1 per order. Ars Technica has a great breakdown of all the issues surrounding how Instacart employees get paid and it's complex, with three different income streams coming together Voltron-like to form a wage. The result, though, is that some shoppers are being paid less than the federal minimum wage, like a Jackson, Miss., worker who put in a 19-hour week in Jackson, Mississippi, that paid out $37.75 (roughly $2/hour). That's far below the $14/hour wage that Ars Technica says Instacart is targeting. -
Trump Administration Officially Delays 'Startup Visa' Rule (sfchronicle.com)
Trisha Thadani, reporting for SFChronicle: The Trump administration has officially delayed a rule that would allow some foreign entrepreneurs to stay in the U.S. and build their companies. During this delay, the administration will propose a plan to rescind the rule all together, according to a Federal Register notice that will be published Tuesday. This official notice, which will be published in the Federal Register Tuesday, comes exactly one week before the rule was slated to go into effect. It will be delayed until March 14. The International Entrepreneur Rule, is the closest the United States has come to the "startup visa" Silicon Valley has long sought, was approved by the Department of Homeland Security in January during President Barack Obama's waning hours in office. -
Former Yahoo CEO Marissa Mayer Defends Former Uber CEO Travis Kalanick (sfchronicle.com)
An anonymous reader writes: Former Uber CEO Travis Kalanick has absorbed blistering criticism for the way he handled allegations of sexual misconduct at the San Francisco riding-hailing service. But he can at least count on the support of one big name in Silicon Valley: former Yahoo CEO Marissa Mayer. Speaking at the annual Stanford Directors' College Tuesday, Mayer defended Kalanick, suggesting that he was unaware of the toxic culture brewing at Uber because of the company's rapid growth. Mayer's name has come up in reports as a possible replacement for Kalanick at Uber, though there's no indication the company has had talks with her. "Scale is incredibly tricky," Mayer said. "I count Travis as one of my friends. I think he's a phenomenal leader; Uber is ridiculously interesting. I just don't think he knew," she said. "When your company scales that quickly, it's hard." Mayer then compared Uber's situation to the early days of Google when it first brought in Eric Schmidt as CEO to help co-founders Sergey Brin and Larry Page manage the company. -
San Francisco Goes After Uber, Lyft For Data On City Trips, Driver Bonuses (sfchronicle.com)
Carolyn Said, reporting for San Francisco Chronicle: It's a San Francisco truism: Every other car on the streets these days seems to bear a logo for Uber or Lyft -- and many are double-parked as they pick up or drop off passengers. Now the city seeks to compel Uber and Lyft to share details on how many cars are roving the streets, so it can ensure that they comply with local laws; assess their impact on traffic congestion, safety, pollution and parking; and ascertain if they are accessible for disabled and low-income riders. City Attorney Dennis Herrera on Monday subpoenaed Uber and Lyft to disgorge records on four years of driving practices, disability access and service in San Francisco. "No one disputes the convenience of the ride-hailing industry, but that convenience evaporates when you're stuck in traffic behind a double-parked Uber or Lyft, or when you can't get a ride because the vehicle isn't accessible to someone with a disability or because the algorithm disfavors the neighborhood where you live," Herrera said in a statement. The subpoenas seek information on "miles and hours logged by drivers, incentives that encourage drivers to 'commute' from as far away as Fresno or Los Angeles, driver guidance and training, accessible vehicle information, and the services provided to residents of every San Francisco neighborhood," Herrera's office said. -
California Seeks To Tax Rocket Launches, Which Are Already Taxed (arstechnica.com)
The state of California is looking into taxing its thriving rocket industry. The Franchise Tax Board has issued a proposed regulation for public comment that would require companies that launch spacecraft to pay a tax based upon "mileage" traveled by that spacecraft from California. Ars Technica reports: The proposal says that California-based companies that launch spacecraft will have to pay a tax based upon "mileage" traveled by that spacecraft from California. (No, we're not exactly sure what this means, either). The proposed regulations were first reported by the San Francisco Chronicle, and Thomas Lo Grossman, a tax attorney at the Franchise Tax Board, told the newspaper that the rules are designed to mirror the ways taxes are levied on terrestrial transportation and logistics firms operating in California, like trucking or train companies. The tax board is seeking public input from now until June 16, when it is expected to vote on the proposed tax. The federal government already has its own taxes for commercial space companies, and until now no other state has proposed taxing commercial spaceflight. In fact most other states, including places like Florida, Texas, and Georgia, offer launch providers tax incentives to move business into their areas. -
Report Shows Another Diversity Challenge: Retaining Employees (sfchronicle.com)
An anonymous reader shares a report: Women, blacks and Latinos are far more likely to quit jobs in tech than white or Asian men, according to a new report by the Kapor Center for Social Impact. The Oakland nonprofit commissioned an online survey by the Harris Poll, which asked 2,006 people who voluntarily left tech jobs in the past three years about why they quit. It found women were twice as likely to leave as men (alternative link), while black and Latino tech workers were 3.5 times likelier to quit than white or Asian colleagues. The most common reason they gave for their departures was workplace mistreatment. -

Always adept with computers, Joseph Thomas worked his way up the ladder at tech jobs in his native Atlanta, then at LinkedIn in Mountain View, where he was a senior site reliability engineer. He turned down an offer from Apple to go to Uber, because he felt he could grow more with the younger company and was excited about the chance to profit from stock options when it went public. But at Uber, Thomas struggled in a way he'd never experienced in over a decade in technology. He worked long hours. He told his father and his wife that he felt immense pressure and stress at work, and was scared he'd lose his job. [...] One day in late August, Zecole (the wife) came home from dropping their boys off at school. Joseph was sitting in his car in the garage. She got into the passenger seat to talk to him. Then she saw the blood. Joseph had shot himself. [...] Uber declined to comment on the legal dispute and said Thomas never complained to the company of extreme stress or racial discrimination. -

The Internet Archive has survived through community donations and by working with about 1,000 libraries around the world that pay the group to help digitize books and other material. But the site itself remains free.

EFF Co-Founder Announces Benefit Concert to Pay His Medical Bills (twitter.com)
An anoymous Slashdot reader reports: "I was dead for about 8 mins. on Wed. eve," EFF co-founder John Perry Barlow posted last year on Facebook. "total cardiac arrest...sad to report, no Ascending Light." The cyber-rights activist told the San Francisco Chronicle that he had gone "down the tunnel of eternity and it turned out to be a cheap carnival ride." He paused for a moment. "Probably not cheap, though."
Yesterday Barlow posted a Twitter update announcing a big benefit concert in Mill Valley, California to help pay his mounting medical bills on Monday, October 24th. Performers will include Bob Weir (also of The Grateful Dead), Jerry Harrison (of The Talking Heads), Lukas Nelson, Members of The String Cheese Incident, Sean Lennon and Les Claypool, plus 85-year-old folk singer Ramblin' Jack Elliott, as well as "special guests."
Barlow's family describes the last 18 months as a "medical incarceration" with "a dizzying array of medical events and complications" that has depleted his savings and insurance benefits. They've also set up a site for donations from "his fellow innovators, artists, cowboys, and partners-in-crime, to help us provide the quality of care necessary for Barlow's recovery."
