What's the difference between this and a cop with a really good memory standing around?
Scalability. There are only so many cops. Police are a finite resource, cameras aren't. No matter how many bigwigs remind us that we're living in a "post 9/11 world" or "uncertain times," this will always be a truth. There aren't enough cops to post two in the office of every school, or one on every streetcorner, or one at every traffic light to make sure no one goes through on red. Why is that a problem? Why does it need a solution? Why does that solution always have to be cameras?
No, it's no big deal that two facial recognition cameras are being installed in the office of one school. What happens when the idea catches on, and suddenly it's two per classroom, one on each school bus, five in the cafeteria and five in the gym? We ought to install a few in the locker rooms, too, because after all, those dreaded perverts are going to be sneaking around in there trying to catch a glimpse after girls' volleyball practice.
It isn't the registered sex offenders the cops should be worrying about, anyway; they've already been identified. I tend to doubt there are a whole lot of known perverts prowling around school campuses - I can't imagine of a faster way for them to get caught, even without facial recognition cameras! At $3,000 - $5,000 a pop, the money being wasted on these cameras could be much better spent on school-sponsored after school programs. Or tracking down deadbeat dads. Or just given straight to this place.
I'm not going to hold my breath until the time one of these cameras catches a real, honest-to-god, not-false-positive registered sex offender or missing child. I advise that you don't, either. -

You should also note that you can take $2000 off your adjusted gross income on your 2003 taxes, and many states provide addtional incentives.
An interesting story here in Arizona. A few years ago, there was legislation to provide incentives to people for buying alternative fuel vehicles. The problem, as with most legislation is that there are loopholes. The big problem in this case was that the loopholes were ginormous. As noted here, a check was written for buying an alternative fuel vehicle, or retrofitting a gasoline-based vehicle with an alternative fuel engine. It turns out the value of this check was not capped by the amount a person paid in taxes, meaning you could make money, and then sell your car. Not a bad deal
In the first few months of this offer, the state of Arizona expected about 300 takers to the deal. Instead, there were 2,471, enough to royally screw the state budget. whoops...

States are required to provide educational support for all their students through high school (public anyway; private is a different matter).
Here's a link to the Arizona Dept. of Ed.. If you're really that good in math, you may want to be tested for "giftedness." (Note: being "gifted" has to do with smarts and the way you think; you may have lots of brainpower but not be gifted.) While I don't like that term (another matter entirely), public schools must provide "gifted" education, so this may be the loophole you're looking for (see page 18 of this pdf). (Caution: my school district counted the AP classes as gifted education.) Here's a link to the "gifted student" section.
In high school, I lived near the Twin Cities (Minnesota), and was pretty good at math. UMTYMP was a good experience for me. Once you test in (you need to know a little bit of algebra and be between 4th and 8th grades to start), you start with Algebra I & II the first year. The second year is Geometry and Trig, and then you do calculus until you're through high school. There may be something like this where you live.

Is it just me, or does it seem like the harder it is to catch someone doing a particular crime; the more extreme the punishment can be. Regardless of the seriousness of the offense
Take for instance harrasment. You harass someone in public; that's a misdemeanor in most cases. Now, if you use a computer to harass someone-- THATS A FELONY?? Read the LAW, in Arizona at least. Basically, if you use a computer to do pretty much anything; you're a Felon.
The only reason I can think of is because it is harder to catch people online. But is that a fair reason to increase punishment? Because most investigators don't know how to use computers? -

CD's will now be incompatible with Macs, tooThis decision still sucks. The poster who pointed out that this will lead to region encoding of CD's is only partially right. All they have to do is put a little label or warning on the CD, and they can exclude entire OS's, especially Macs. (Think : "Don't steal music.") Wait 'til MS figures this out.
There are already legal requirements about CD format, including a requirement that the "true name and address of the manufacturer" appear on the CD. This is in most states (here's Arizona's, look at Subsection A, 3 & 4) and in Federal law. This decision will just mean another line of fine print on the back of your CD. -

China will never be able to transition to a more democratic form of government without breaking up for the sole reason that most of those peoples and regions didn't have any democratic say in whether or not Beijing rules them to begin with (with Tibet being the most obvious, but not only, example).
There are few countries in the world with China's size or population. India is slightly smaller but has a similar population size. They're as big as they are because most of the country had already considered themselves "Indians" for several centuries, even before the British Raj. But even then remember that Pakistan and Bangladesh felt the need to break away.
The US has a much smaller population but is almost identical in size. However, we've grown to our current size through deocratic processes (why they worked is another story). Territories didn't become part of the US proper until they voted themselves into the union. Territories are also more or less free to leave the US entirely (and have done so several times in the 20th century... it is to the chagrin of the "anti-imperialists" in the UN that the remaining territories of the US and the UK have repeatedly and voluntarily chosen to remain with their parent country). And because the matter of secession has never really been resolved (especially not by the Civil War), even states may be free to leave the union if they really want to. Just ask Arizona.
The only way China could possibly transition away from totalitarianism and still stay one country is if Beijing succeeds in deteriorating or outright eliminating non-Cantonese cultures and peoples (through either persecution or dillution) so that everybody considers themselves "Chinese." -

Since when was Qwest worried about fairness?
The combination itself is pretty worrisome. Qwest aside from being a spammer's best friend, Qwest is being sued in Arizona by the state attorney general for "repeatedly defraud[ing] phone customers in Arizona by placing unauthorized charges on their phone accounts". In light of allegations like these, fairness seems to be the least of their concerns. Additionally, there is a huge uproar in Arizona about Qwest selling their customer's private information such as numbers called, etc. to marketing companies.
They are the perfect model for everything evil in corporations. -

Here in Arizona, that would be called 3rd Degree Burglary (assuming its a commercial business and you're there to commit another felony - defacement would be akin to Criminal Damage) - a felony punishable by up to 3 years in prison on a first offense.
Computer Tampering is the same penalty.

Federal definition of wiretapping
The federal laws regarding wiretapping involve recording conversations when neither party has given consent to being recorded. If you record a conversation you are having with another party, you have consented to record your conversation and you are not violating the federal wiretapping laws. Local jurisdictions occasionally expand on what constitutes wiretapping, such as the Massachussetts law being discussed here.
I used to work for a large national chain of retail electronics stores where we sold devices for recording phone conversations. In the state where I live, there are no supplemental laws. Thus, anyone buying a phone recording device to record his/her own conversations was perfectly within their rights. However, anyone who wanted to record a spouse's or child's conversations without their knowledge was plotting to violate federal wiretapping laws and we were forbidden from selling them the equipment for such purposes.
So the moral of the story is: If you're looking to break federal wiretapping laws, don't tell the kid behind the counter at Circuit Hut before he sells you the necessary gear.

I think that the general problem here is that there is a perception that you cannot own and use tools in a responsible manner. You cannot outlaw a screwdriver because someone in Timbuktu used one to commit murder, rape, or burglary, because screwdrivers have legitimate legal uses.
This is not true. There are some states (A laska and Arizona for example) which prohibit the posession of burglary tools. -

Unlawful Business PracticeAs of July 18, this is an unlawful business practice, according to Arizona Statute 13-2316. The newly enacted statute, available online as House Bill 2428 is quoted in relevant part below (new language in ALLCAPS).

13-2316. Computer tampering; venue; forfeiture; classification
A. A person WHO ACTS WITHOUT AUTHORITY OR WHO EXCEEDS AUTHORIZATION OF USE commits computer TAMPERING BY:
...6. PREVENTING A COMPUTER USER FROM EXITING A SITE, COMPUTER SYSTEM OR NETWORK-CONNECTED LOCATION IN ORDER TO COMPEL THE USER'S COMPUTER TO CONTINUE COMMUNICATING WITH, CONNECTING TO OR DISPLAYING THE CONTENT OF THE SERVICE, SITE OR SYSTEM.
...D. A VIOLATION OF SUBSECTION A, PARAGRAPH 6 OF THIS SECTION CONSTITUTES AN UNLAWFUL PRACTICE UNDER SECTION 44-1522 AND IS IN ADDITION TO ALL OTHER CAUSES OF ACTION, REMEDIES AND PENALTIES THAT ARE AVAILABLE TO THIS STATE. THE ATTORNEY GENERAL MAY INVESTIGATE AND TAKE APPROPRIATE ACTION PURSUANT TO TITLE 44, CHAPTER 10, ARTICLE 7.
Section 44-1522 is currently in effect, and reads in relevant part:
44-1522. Unlawful practices; intended interpretation of provisions
A. The act, use, or employment by any person of any deception, deceptive act or practice, fraud, false pretense, false promise, misrepresentation, or concealment, suppression or omission of any material fact with intent that others rely upon such concealment, suppression or omission, in connection with the sale or advertisement of any merchandise whether or not any person has in fact been misled, deceived, or damaged thereby, is declared to be an unlawful practice.

Gov't Services E-CommerceFirst of all, it all depends on your state government's reaction to the delivery of services via internet. Many elected officials I have spoken with want nothing to do with technology, and don't understand those who do. It's generational, like the people back at the turn of the last century who wanted nothing to do with that newfangled thing called electricity. The more people you elect who care about technology, the more you will see government trying to utilize it to deliver services.
Just as corporate websites have evolved from pretty ads that pushed out information into e-commerce sites that actually made sales and generated revenue, government websites are evolving into useful service deliverers. This has the potential to be much more than just a "line killer" as Katz terms it. Here in Arizona, the state's adopted a directive called "No Wrong Door" in response to people attempting to get various services from the government and being told to go to another agency. No Wrong Door is easy in an electronic sense- passing people across webpages or redirecting electronic inquiries is a breeze not only in terms of time, but in manpower and in the lessening of a demand for services at brick-and-mortar government offices.
It's not going to kill lines, it's on the warpath to killing bureaucracy!
Anyway, Arizona has passed a new law permitting all state agencies to accept credit cards, which may seem fundamental to you all, but remember Gov't is adverse to lining the pockets of other businesses on the basis of 2-3% "processing fees". The government is looking beyond that, and saying that 2-3% fee is better than the thousands lost in bad checks and the millions spent on bricks and mortar. This is very long term thinking, when you're talking about term limited elected officials who run every two years.
Arizona has been providing some services online for years. I can renew my car registration, even get replacement plates or a duplicate driver's license online. There are other services, like paying fines, etc., but I haven't used them.
;)BTW - Bricks and Mortar retailers, who pay sales taxes, are a little pissed at all this. They view themselves as funding the electronification of government, putting it on an even level with other e-businesses which don't pay taxes.

I'm not complainingPlease don't take for granted all the things the government DOES have online. I can follow the antitrust trial against Microsoft by reading court documents in PDF format on the DOJ's Web site. The President's State of the Union address is online. Wondering about a particular law? Look it up. Of course, numerous sites host copies of the Constitution and Declaration of Independance.

DoS (Ignoring Spam, etc.)Spammers who abuse systems for use as spam relays have been pursued for Denial of Serivce by AOL and others. That really where spam and DoS cross - opt out lists and other stuff don't address the DoS problem. That's what I think the initial question submission was about (ignoring the commentary).
We here in Arizona passed (and our Governor signed on April 7) the first state law specifically banning DoS attacks. House Bill 2428, in the relevant part (trimming some extra language - language in CAPS is new - formatting on the Ariz. website is much better), says:

I would highly recommend whenever your constitutional rights are threatened, confront the individual. What I find amazing is that Rep. McGrath probably didn't think that anyone would have any problem with her proposed legislations.

Possession of Burglary Tools - Class 6 FelonyIt would be more appropriate to compare DeCSS to a set of lockpicks. Lockpicks are legal to buy and to use in your own home. The only thing that's illegal is when you use them to break into someone else's house.
In most states, I think you'll find possession of lock pick tools is very illegal. Generally only licensed locksmiths can have them. For your own reading , check Arizona's lockpick tool law. I think the intent element is pretty easy to prove... if DeCSS is a lockpick tool as you say, of course you're using it to break in (or you're distributing it to others who are...)
BUT, go back to the original argument. The MPAA wants to corner the market on PLAYERS. Their security, weak and insecure as it was, was aimed at protecting the ability to play back the files. This is not COPY protection, because you could still copy the entire contents, and get a MPAA player to decode them.
You're not picking the lock on the home. You're taking the "protection" off something you lawfully purchased, to use it in its intended use, but in your own (slightly different) manner. I can't think of an analogy that works really well, but here's a try - it's like buying a foot pump designed to inflate car tires. You use a tool to put on a needle the nozzle, and use it to inflate a basketball.
The overbreadth argument works for me. The MPAA is controlling the viewer market, but like the theater owners did in the 30s and 40s. They are prohibiting independent filmmakers from using the technology to be seen, by forcing it into the hands of a few blessed resellers.
The trade secret is out of the bag, MPAA. You need to sue Xing for the damages as a result, not the holders of the once-secret formula. (Those damages will be hefty, too.)
