Presumptive sentencing.

A class 2 felony (rape, arson, and other terrible non-murder activities) has a scary "Maximum Sentence" of 10 years, and an aggravated sentence of 12.5 years. The presumptive sentence is half that. Fraud here is a Class-3 felony, so it has a presumptive sentence of 3.5 years.

I believe the argument that says being a public official (legislature, law enforcement, etc.) should count as an aggravating factor (not a mitigating one!), but you're right, the news never comes on and says:

Important person was arrested for drunk driving today, they could face up to 8 hours in a holding cell and a trip to a private rehab facility where they will receive daily spa treatments, but will be denied bloody marys at breakfast.

In Chicago, they'll drag it out forever, and someone else that they hold leverage over will accept a plea to a much, much lower crime, which will result in, at best, probation and public (and pointless) firing. Redflex will then keep them employed as a "consultant."

That appears to be a problem with your driving. You don't drive at a speed that's safe for the automobile traffic around you, you drive at a speed that's safe for the road you're on, and apparently you're on a road that's frequented by cyclists. If you were on a limited access highway, maybe you could get away with your style of driving, but anywhere else you need to drive at a safe and prudent speed and expect obstacles in the road - bikes, pedestrians, stalled cars, dogs, cows, etc. I once narrowly avoided a refrigerator that was left in the middle of the road after it fell off a truck.

So basically, you expect drivers to do 15mph in a 35 just because you're too much of a dick to get the fuck out of the way.

Wow, don't they teach Driver's Ed in schools any more? Here's a legal definition of prudent speed:

A. A person shall not drive a vehicle on a highway at a speed greater than is reasonable and prudent under the circumstances, conditions and actual and potential hazards then existing. A person shall control the speed of a vehicle as necessary to avoid colliding with any object, person, vehicle or other conveyance on, entering or adjacent to the highway in compliance with legal requirements and the duty of all persons to exercise reasonable care for the protection of others.

Do you think that a speed necessary to avoid colliding with a stationary object on the road means driving at zero mph?

All drivers have trouble avoiding something unexpected in the road when it's hard to see.

So your problem isn't in avoiding cyclists, it's that it's hard to see them? How could you see a pedestrian in the road if you can't see a cyclist, since they are about the same size?

Oh, I understand my mortality when I'm on my bike, and since I know i'm not going to change the laws of physics, I've continued to encourage my legislators to write laws that hold cars more responsible when they are at-fault in collisions with cyclists. If car drivers thought they might face jail time for side swiping a cyclist, or hitting a cyclist "because I didn't see him" or "I was going too fast to stop", then perhaps they'll drive a little more carefully.

And if cyclists thought they might face jail time for not obeying the laws of the road as the majority constantly do, then perhaps they'd bike a little more intelligently. (Actually, that's obviously not true because cyclists already face serious injury and death for being stupid on the road, and they do it all the time anyway.) But no, let's make legislature with outrageous penalties to punish people for using the roads as they were intended.

I think the good people of Chicago-land should look at what happened with Arizona's attempt to boost revenue with photo enforcement zones, and take steps now to keep their pols from wasting more of their tax dollars than they already have. Various municipalities in Az have contracted since 2008 with Redflex for a photo enforcement system consisting of 40 mobile and 38 fixed position cameras that are deployed mostly in the Phoenix and Tucson metro areas, where 80% of Arizona's population live and work. The states auditor general's sunset study produced in 2010 when the Az Department of Public Safety declined to renew their contract with Redflex revealed some interesting things about the revenue generating abilities of photo enforcement zones. Drivers learned to route around both the fixed cameras and mobile cameras, the latters' locations being routinely broadcast during commute time radio shows, and drivers who received citations but failed to respond soon discovered there were no legal repercussions for failing to respond, largely because Redflex's cameras are not the same as a county mounty with a badge and ticket book, when it comes to legal jurisdiction.

Some cities in Az continue to use photo enforcement zones, but last year in June, SB 1398 was signed into law by governor Jan Brewer, which explicitly affirmed that recipients of a mailed photo enforcement citation are not obligated in any way to respond to it. More importantly, SB 1398 required that language to that effect be prominently printed on the mailed citation. According to the sunset study, only about a third of the mailed citations ever got a response; I imagine SB 1398 is going to effectively kill even that low rate, and the state is eventually going to have to go back to the old-fashioned way of having cops write tickets, if they actually want to generate a revenue stream from traffic citations.

Anecdotally, I've been popped half a dozen times since the system went operational in 2008 and have yet to pay a single dime in fines. I received the citations in the mail the first three times; they went directly from mail box to recycle bin because my attorney told me after I received the first one that they had no legal standing. I've been popped three times since SB 1398 went into effect; I'm still waiting for either a mailed citation or a knock on the door for any of these three, though I know that two of the three are beyond the 90 day statute of limitations (also reaffirmed in SB 1398, btw) so I doubt I'll see anything.

All in all, it looks like (at least here in Az) that photo-enforcement zones are not the revenue producers that Redflex would like to think they are. Indeed -- Chandler and Mesa are actually operating in the red, with Mesa reporting almost $1M in red ink over the last three years for their Redflex photo enforcement system.

I'd be very surprised if "slower yields to faster" is actually written ANYWHERE in the US Highway Code.

Umm in many states it does say something similar.

Most states follow the Uniform Vehicle Code and require drivers to keep right if they are going slower than the normal speed of traffic (regardless of the speed limit; see below)

At the start of the summer, the Washington State Patrol began pulling people over for violating the state's left-lane law, which prohibits "impeding the flow of other traffic."

These three states all imply that you must move over if they are driving at less then the "normal speed of traffic". Of course other states have different laws, but a large number of them have laws with wording similar to these. The mit page says this at the bottom of it.

Note that this law refers to the "normal" speed of traffic, not the "legal" speed of traffic. The 60 MPH driver in a 55 MPH zone where everybody else is going 65 MPH must move right. Contrast Alaska's rule, 13 AAC 002.50, allowing vehicles driving at the speed limit to use the left lane, and Colorado rev. stat. 42-4-1103, prohibiting blocking the "normal and reasonable" movement of traffic.

I don't doubt it exists. Who'd make that up? I just doubt your interpretation. I don't think it's a statement about truckers in general, more like a way to trick people into buying from that truck stop.

It's pretty sleazy to post the tax-exempt price instead of the total, since anyone who's tax-exempt would know they get a different price and the majority of people want to know the normal price. Especially since fuel taxes aren't the same as sales taxes, so there isn't any built-in presumption about how much vig will be paid.

I wonder if they aren't really getting significantly more than other truck stops are, when the taxes are added back.

Seriously, the framers of the Constitution of The United States of America had just finished a bloody and desperate war against their former lawful government, The British Empire. They did so with the most cutting edge technology of the time, the rifled gun bore. The range and accuracy of a rifle compared to the standard issue musket is just sick and was considered "unfair" by old line solders. Now days the average citizen has no need for weapons that match or exceed the technology of their lawful government. I know this because there are laws in place against all but the most basic of weapons, and my law makers would not lie to me, right? Come to Phoenix some time and get a taste of rush-hour traffic. Almost as bad as the 128, and I can drive the 128 with the best of them.

Then the minimum speed limits law is no less vague about 'reasonable'.

Airzona 'racing' law states "2. "Racing" means the use of one or more vehicles in an attempt to outgain or outdistance another vehicle or prevent another vehicle from passing." I'm not sure about this, but by that definition MOST other drivers are guilty of this at some point every damned day. No, I'm not *trying* to prevent another vehicle from passing me. If I don't change lanes, they have other lanes to use, unless the lanes are full, in which case there is just no safe way to pass at that time. This happens when there is someone driving in the left-hand lane doing 75 in a 65 also. It is not so simple as you think.

The question is, is the speed limit the 'normal speed of traffic'? In my experience, I am in fact traveling faster than 85% of the traffic on the road. I doubt the speeders actually constitute 5% of the traffic. I'll be counting the next few days to see how many vehicles I pass vs how many pass me. I might have to try the center lane to see if it makes a diffence. Mind you, the center lane exposes me to passers on *both* sides. If I die in an accident, you are to blame, right?

Which leads to even higher taxes as less energy is consumed, like cigarette taxes have jumped wildly as less people smoke. Taxes go up, less is consumed, leading to lower taxes and a tax increase to make up the difference, leading to less consumption and less tax revenues leading to more tax hikes. And what they use those taxes on varies as well. For instance, a couple years ago, Arizona boosted cigarette taxes a buck a pack to pay for, and I shit you not, day care for migrant workers' kids .

So tell me, exactly which one of them applies to this case? Yeah, I *could* Google it, but I'm not making the claim. Also, it has to be applicable to that venue. And I want a proper legal reference, like ARS 13-2921, which won't help you any because this case is in California, NOT Arizona.

Because I don't think the police department was able to find one. Nor was the prosecutor. And I'm pretty sure they know what "assault" and "harassment" are.

But they instead decided to rely on some BS about making breaking a website's Terms of Service into a felony, because even here, harassment is a misdemeanor, not a federal crime (unless you "with intent to harass, files a nonconsensual lien against any public officer or employee that is not accompanied by an order or a judgment from a court"--but that's the only way you can get a felony out of it here).

Henson never served the year he was sentenced to by the scientology-controlled kangaroo court in Riverside County, California. Scientology learned that Henson was now in Arizona, and it instructed the Riverside County county to seek extradition.

Extradition requires two extradition warrants, one signed by the governor of the extraditing state, and the other signed by the governor of the state where the fugitive is located. Both warrants have been signed, so Henson is being held without bail until he exhausts the very limited appeals available to him. Then, in all likelihood, he will be transfered to a jail in California, where scientology is eagerly waiting for the opportunity to spread false rumors that Henson is a child molester.

Perhaps I could prevent the person from driving by disabling their vehicle or physically taking possession of their car keys? Either of these two suggestions could and most likely would result in CRIMINAL (not civil) prosecution.

Actually, that's not true. According to Arizona law you can use physical force to prevent someone from inflicting serious injury on himself or others. Drunk driving definitely counts. That means you could tie the guy up if that's what was necessary, although the legal obligation is unfortunately less than that. Of course, we are one of those "cowboy" states who actually still believe in the 2nd amendment, so your laws may vary.

Your belief is incorrect. There is no federal law that unequivocally forbids requiring identifcation to vote, although many people (including, the ACLU ) insist an ID requirement should be considered a poll tax, just as you do. Many states forbid requiring ID.

But in fact, one federal law requires identification for some voters. The Help America Vote Act (passed in 2002) requires first-time voters to show identification if they registered by mail and didn't include a driver's license number (or the last 4 digits of their SSN -- at least SSNs are free) on the registration form.

(This weird rule was added at the behest of Congressional Republicans, who apparently think the Democrats make up voters. That's silly. Democracts don't use imaginary voters, they used dead voters.)

Two big problems with the HAVA identification requirement:

"First time voter" actually means "first time voter in a given state", so if you move to another state, you'll need to be carded again. If that's not inconvienent enough, Oregon thinks people need to show ID every time they change counties.

The whole carding scheme requires states to have a state-wide voter registration database. Not all states have this. (In fact, most don't.) If a state doesn't have the database ready for 2006, it will have to card people more often. Santa Cruz county thinks they'll have to card everyone. Won't that be fun for them?

Oh, and technically, Arizona requires ID for every voter. New Mexico is thinking about it. Some states require ID before they'll give someone a provisional ballot. And I don't even want to think about what happens when Republicans go around contesting people's voter registrations....

In order to submit IRS returns electronically, the software developer and/or the agency submitting the returns has to be an authorized E-File provider. (Read that, it's chock full of insightful information on this subject, as is this one.) When you use TurboTax, you don't end up submitting directly to the IRS, but via TurboTax's systems as a middleman, which passes your return along to the IRS via "e-file transmitters".

Furthermore, you also have to get approval from every state you want to be able to support state returns for. 1, 2, 3

Which is, no doubt, why there aren't a lot more tax software options.

In the unlikely scenario that an open source project received this approval, the trusted endpoint problem would wreak havoc with its success.

Such a project would have to function like a foundation, with its own online middleman service to process the returns through. (Or, perhaps more ambitiously, operate its own e-file Transmitter.)

Anyway, I'm a big fan of TurboTax for the Web. I don't need to download anything, or worry about upgrading each year, and the cost is somewhat dependent on the complexity of my return and the added features I want, so I don't end up buying a shrink-wrapped flat-rate option that I end up underusing.

In Palm Beach County (home of Terry's Butterfly Ballot) there were 32000 errors out of 450000 votes. That's over 7% error rate. Note that typical error rate for non-butterfly punch cards is 4%, whereas optical-scan (aka pencil & bubbles) is well under 2%.

Except when it's artificially low just to get "free money". e.g. speed traps. When that happens, the limits aren't set by engineering recommendations but by the research that shows what limit generates the most tickets. There are local roads in many cities whose speed limit is set 30 (!) mph lower than what is determined safe by analyzing the road and conditions.

Anyway, "driving at what feels like safe conditions" doesn't necessarily mean that drivers are moving at 90mph or above, which seems to be the misconception here. Driving at the speed for which a road was designed isn't irresponsible. Driving significantly below it is. And no road is perfectly flat, and even if there's an effort to minimize blind spots that cause accidents, some are still there. That's where the crashes are going to happen.

Common situations like the ones I described in earlier posts are ones in which cars were moving at a prevailing speed of 70mph on a road perfectly safe for this speed to the AVERAGE driver (which by definition includes those with inflated self-opinions), except for a pack doing 50-55. Exactly. In the right, left and center lanes. (The speed limit on the road when I encountered the pack I'm thinking of? 65.)

The minimum was 45, so the slowpokes technically weren't doing anything wrong (they aren't likely to get a ticket) -- unless there's a "slower traffic must stay in the slow lane unless passing" rule. Which there was in this case.

They were driving slowly why? Because an old man in a white Crown Vic was driving slowly. No one was passing him even though other drivers, traveling at 65-70mph, were bunching up in legitimate passing lanes attempting to pass ... despite a law in force in the area stating that drivers must remain in the slow lane except when passing, which none of them were doing.
