2) Where did you hear that? The articles I've read said it applies to anything using the "C Block" spectrum which is their 4G.

This disclaimer is not nearly as silly or crazy as one might think. CyanogenMod, for example, has well-documented problems with E911 functionality on various phone models. In fact they completely dropped support for the T-Mobile Samsung Vibrant because dialing 911 didn't work!
I don't know about you, but I can sure see the inability to call 911 to be a "dangerous consequence" that could absolutely lead to "property damage and/or bodily injury, including death" even if it's not the phone itself that's literally the thing killing you. -

Heres the real photo of the two. You may notice the Galaxy II is larger, has the big words "samsung" written on it and a widget displaying the time and date. If you didn't notice them, you need your eyes examined.

Though I still love WebOS and most things it stands for, for the reasons you mentioned. Here's what I did to make it not crap (I have a TouchPad and an HP Pre 3).
1. Install Preware: http://theunlockr.com/2011/09/16/how-to-install-preware-on-the-hp-touchpad/.
1.1. Install the patches that muffle system logging.
2. Install custom kernel and set the lowest CPU frequency allowed to 768, keep the max at 1.4 (for the HP Pre 3, same idea for the Touchpad, different freq.)
3. With your HP Pre 3 which comes unlocked for only ~ $200, sign up for an unlimited "non-smartphone" data plan with AT&T. This'll get you $10/month unlimited data.These simple steps will get you a phone that's just as smooth as an Android device (iOS is still smoother), and $20/month cheaper for unlimited data, and without a contract. The downside is of course that you're now definitely deep inside geek territory installing custom kernels and what not. I'll say that I'm pretty sensitive to basement-nerd induced stress, and so far that's been low on WebOS compared to other open-sourcey crap like the new Ubuntu.

The iPhone has a small marketshare? HAHA! It has a 63.7% marketshare. Article linked to postulates one reason Apple slapped HTC with a lawsuit declaring patent infringement is because Android based phones are gaining on Apple's marketshare.
They might be number one now, but they were number one with the Apple II and look at how quickly they lost that lead.
In the bookstore of the school I attended in 1985, half of the computers sold were Macs. The rest were divided up by the various PC compatible OEMs. Than was 8 years after the Apple II came out. Looking now, Windows "accounted for 92.1% of the operating systems that powered machines visiting the 40,000-plus sites that NetApplications monitors for clients of its analytics service." That is up slightly from previously, but it does not break down OEMs. Now if Linux and other non-OS X OSes raised the percentage of OSes powering PCs to 93% that leaves OS X running 7%. Now how many of the rest are Dells, HPs, Levenos, or one of the dozens more OEMs? Seven percent may not seem like a lot but how does it compare to OEM sales?
